PUBLIC DISCUSSION Mr Chapman advised the Council that he may possibly apply for permission for a small development. Council Meeting Minutes To confirm and sign the Minutes of the Parish Council Meeting on 14 th August 2018 Proposed by Cllr T Mott seconded by Cllr P Bishop it was AGREED that the Minutes of this meeting be a true and accurate record. All present at the meeting in favour. 5080. Matters Arising Cllr Rowe remarked on the excellent resurfacing work that Cormac had recently completed by the school by increasing the width of the tarmac to the hedge. It was agreed that the Clerk write a letter of thanks as these were rarely received by Cormac. (5073) The Clerk reported that she had been advised that the drainage works at Chapel Amble and road marking at St Kew were in hand.. 5081. Correspondence CC- Commercial Waste A letter regarding possible changes to commercial waste collection has been distributed 5082. It was proposed by Cllr Rowe and seconded by Cllr Bishop that the Parish Council APPROVE this application. All in favour Planning Decisions PA18/06088 Mr Paul Frost Rumbletums Fish and Chip Shop, Trelill Rd Demolition of existing fish and chip shop, construction of detached dwelling WITHDRAWN 1

Schedule of Monthly Accounts Proposed by Cllr T Mottand seconded by Cllr Rowe that the August monthly accounts be approved en bloc. All in favour 5084. Playing Field Grant A request was received and accounts given from the Playing Field Trust for financial assistance to enable them to update and repair the playing field equipment and provide a quality skate ramp. Cllr R Godden as the Finance Officer reported by email that he had seen the accounts and that the committee was doing everything possible to keep costs to the minimum. It was agreed in view of the excellent work and support of the small committee, and acknowledgement of the unfortunate weather for several years that had impeded fund raising that a grant of 800 be given. This was proposed by Cllr Mott and seconded by Cllr P Bishop. All in favour. 5085. Remembrance Sunday Wreath It was proposed by Cllr Rowe and seconded by Cllr Bishop that 40 be donated for the wreath 5086. Community Infrastructure Levy An email was received from CALC asking for councils to make their views known on the proposed levy on new developments given planning permission from January 2019. It was agreed that there could be a division of these monies between all parishes and towns in Cornwall on a per capita basis, to be spent on capital projects for their communities. Those with the 15% or 15 + 10% from their own communities would have their share in addition to this. These monies should stay within the local councils and not be absorbed into Cornwall Council. 5087. Parking in Chapel Amble (5073) The Clerk has been in discussion with Mr Henry Mably regarding the damaged kerb stones who says that he will reinstate them. He reported that the collision occurred because of cars parking close to the junction and impending traffic flow. Cllr Rickard sent an email to the meeting agreeing that there were parking problems and suggested a site meeting. As there were so few Councillors in attendance to set a date it was decided to put this matter back on the Agenda next month. 5088. Parish Councillor Reports and any other matters Cllr Bishop queried the undermining of St Kew bridge, and was advised that this has been ongoing for the past year with requests for repair. The Council was informed that a feasibility study was taking place. ACTION : Clerk to request an urgent update from Highways. Cllr Mott said that he had spoken to the owners of Benbole farm regarding the recently installed mountain bike track. He was advised that the planning department were in discussions, although planning permission was not currently required and it was agreed to keep an eye on the project. He also reported that there had been several reports of dogs causing problems at Tipton and police have been in attendance. The public have been asked to report any further incidents. 2

Finally he informed the Council that Cllr Godden had purchased a new printer. He did not require reimbursement but the Council may have the use if they pay for the consumables. 5089. We hope you find this update useful and if you have any questions or comments, please do send us an email at: enquiries@cornwallalc.org.uk Consultation on the Community Infrastructure Levy (CIL) We have been asked to remind members about a survey on the Community Infrastructure Levy (CIL) which Cornwall Council will begin to charge on new developments given planning permission from January 2019. 15% of any Community Infrastructure Levy will be given to Town and Parish Councils to use in the area where the levy was paid. An additional 10% of the levy raised will be given to local councils that have a Neighbourhood Development Plan. The allocation of the remaining 70% - 80% 'strategic share' is at the discretion of Cornwall Council, which is the focus of the current survey. The Council is seeking views on how the 'strategic share' should be allocated and the type of infrastructure it should be spent on. More information can be found on the Council s website at www.cornwall.gov.uk/cil The public consultation officially ended on 23 rd September but to give local councils the opportunity to provide feedback, Cornwall Council will accept completed surveys after the closing date. They ask that if your council has been unable to submit a formal response so far, to please provide an initial informal response with a holding position which you can confirm with a formal response later. CALC Website changes Our website providers, 2Commune, have recently made some changes to the Cornwall ALC website, so that if you have a problem logging in, you are now able to reset your own password, rather than going through the CALC office. At the login screen, you will see an additional button labelled Reset under the email address and password boxes (as shown in the image below). You just need to click the button and follow the instructions. Of course, if you encounter problems, don t hesitate to contact us at enquiries@cornwallalc.org.uk and we will be pleased to help. CALC Conference - Update As members may be aware, we had originally planned to hold our Conference in October, based around the Community Governance Reviews which are due to be started by Cornwall Council over the coming months. However, following discussions with officers of Cornwall Council and after consultation with the CALC Chairman, Cllr Paul O Brien, it has been decided to reschedule the event to early in the New Year, when Cornwall Council will be further along with its preparations and better able to engage with members on the CGR arrangements, including details of how the exercise will be undertaken. Beacon lighting safety guidance Many local councils are busy preparing to mark 100 years since the end of World War I by lighting a beacon at 7pm on the 11 November. NALC has asked us to draw to your attention some helpful beacon lighting safety guidelines issued by BHIB Councils Insurance. 2

Opportunities for sharing consultation costs for updating/renewing car parking orders in 2019 At the most recent meeting of the CALC Larger Councils Committee, it was noted that a number of members were considering reviewing their Car Parking Orders and it was suggested that it might be useful for councils to join together to share the consultation costs. If your council would be interested in pursuing this option, please contact either Julie Larter at julielarter.parishclerk@hotmail.co.uk or Esther Grieg at clerk@camelford-tc.gov.uk Cornwall Site Allocations Development Plan Document consultation A further reminder that Cornwall Council has issued the following document: Cornwall Site Allocations Development Plan Document (DPD): Schedule of Proposed Modifications (Town and Country Planning (Local Planning) (England) Regulations 2012) This phase of the consultation is open from 10 th September to 5pm on 22 nd October 2018. Unfortunately late representations cannot be accepted. The consultation documents can be viewed at www.cornwall.gov.uk/allocationsplan Aviva Community Fund The Aviva Community Fund has recently been launched and offers the chance to secure funding for causes important to local communities. The timescale for applying is quite tight, as online entries close at midday on 9 th October. Voting for projects then runs from 23 rd October to 20 th November and projects with the most votes will become finalists. Updated model byelaws The Ministry of Housing, Communities and Local Government has undertaken an exercise to bring model byelaws up-to-date including accompanying guidance. New Waste and Recycling Community Engagement Team We have been asked to let members know about Cornwall Council s new Waste and Recycling Community Engagement Team. Their job is to encourage residents to reduce, reuse and recycle as much of their waste as possible, by engaging with individuals and community groups. The teams hope to work closely with Town and Parish Councils to carry messages out into the community to promote education, awareness and positive action on issues around waste prevention, re-use and recycling. There are 3 officers in the team: Richard Haycock - covering West Cornwall Rachael Reid - covering Mid Cornwall Peter Blenard - covering East Cornwall Each officer acts as a first point of contact for local projects and engagement but they will come together to work on larger events and projects. They interpret community centres in the broadest sense, which might be a church, sports facility or other building which offers a range of activities throughout the week which all the community can access. CRANTOCK PLANNING CASE SUMMARY After 4 years of working closely with Cornwall Council, Crantock s Neighbourhood Development Plan was overwhelmingly approved (86%) by referendum on 24 May 2018. The Plan was pro-development with a 20% increase in housing stock and the delivery of 45 affordable homes, against a current housing register listing of 30. On 11 June 2018, Cornwall's Central Sub-Area Planning Committee approved, by a majority of 1, a planning application for an affordable led rural exception site consisting of 22 houses located on land outside that identified for development in the Plan. During the determination of the application the Council's Case Officer advised the committee members that Crantock s current requirement should be treated as 30 despite extant permissions to deliver 45 affordable units which have not yet been built-out, but which are eminently deliverable. The Officer also considered that the proposal would offset the affordable housing requirements of the adjoining parishes of Colan and Cubert despite that 'need' being non-local to Crantock. Further, it should be noted that Phase 2 of the Goldings development in Colan had already been approved for the delivery of nearly 300 houses. Crantock Parish Council considers that the Council's decision is wholly inconsistent with the housing policies in our Neighbourhood Development Plan. The housing policies in our plan are rendered redundant by the decision. The decision is contrary to Government policies on devolution and localism and makes a nonsense of the democratic processes through which the Neighbourhood Plan was created and approved. Further, it sets precedent for unnecessary developments across Cornwall and the rest of England. The Parish Council considers the decision to grant the planning permission is wrong in law and to protect our Neighbourhood Plan we have decided to challenge Cornwall Council's decision to grant the permission in the High Court by way of judicial review. This will cost us considerable time and money and we are seeking public subscriptions to fund our challenge.
