LEGAL AID OF NORTH CAROLINA REPORT TO THE GENERAL ASSEMBLY Pursuant to S.L. 2014-100, 18B.17. Third Quarter 2015 Submitted: October 1, 2015 Mission statement. Legal Aid of North Carolina (LANC) is a statewide, nonprofit law firm that provides free legal services in civil matters to low-income people in all one hundred counties in North Carolina, in order to ensure equal access to justice and to remove legal barriers to economic opportunity. Funding through the Access to Civil Justice Act (ACJA), G.S. 7A-473.3, constitutes approximately twenty percent (20%) of the total funding LANC receives from all sources to serve the legal needs of the poor in all one hundred counties. LANC is only one of the agencies that receive funding through the ACJA. Whom we serve and how. LANC serves households with legal issues in housing, public benefits, family integrity, consumer, employment, education, and community economic development. We also serve victims of domestic violence, seniors, and families facing foreclosure whose income qualifications are slightly different. Persons living in poverty not only lack a living wage, but many have health and literacy challenges that severely limit their economic opportunities. In turn, these factors affect the options available to them as they try to resolve legal problems, often without legal representation. LANC does not provide any representation either in criminal matters nor in personal injury cases, nor in class action cases. LANC serves all one hundred counties of the state. Our primary client base comprises the very poorest: generally households with incomes falling below 125% of the federal poverty guidelines (FPG); slightly more than $29,000 per year for a household of four. Our general client base comes from the roughly 3.7 million people, approximately 39% of the state's general population, falling at or below 200% of the FPG. The poverty population in North Carolina has increased in the last ten years. The latest census statistics indicate that the state's poverty rate is 17.9% and North Carolina now has over 1.71 million people living at or below the FPG. Over 2.23 million of the state's population lives on incomes at or below 125% of the FPG. These figures include over 15.5% of all seniors, 32.1% of all children; 24.9% of all women. About 7.9% are considered in extreme poverty and have incomes below 50% of the FPG. Over 19.6% of households are food insecure. Over 606,000 households pay more than 30% of income on housing and just over 12,000 people are homeless; yet only 136,700 households receive federal rental assistance. Contrary to conventional wisdom, only 40,905 of these many poor households in our state receive TANF, which traditionally is "welfare." The majority of the households living in poverty are headed by females. The median gross annual income of LANC clients remains approximately $12,000, significantly less than the living wage annual income of $41,920 for a four-person household and the $45,906 state median income. Poverty is not constrained by geography, and the poor live in both urban and rural areas. 1

North Carolina is about 66.1% urban and 33.9% rural. The major urban areas have experienced a 60% increase in population since 2000. Our legal work focuses on the most basic needs of the poorest households in the state. LANC makes every effort to provide the highest quality legal advice and representation to our clients. As a civil legal services provider, we make every effort to ensure that our work ameliorates poverty and creates economic opportunity for those most in need. We prevent and reduce homelessness, we reduce food insecurity for children, we help enforce consumer protection laws on behalf of seniors and veterans, we help women and children escape domestic violence. Through our 160 staff attorneys, along with 53 paralegals and 60 support staff, each year we provide direct legal assistance to approximately 25,000 households and legal education and outreach clinics information to an additional 25,000 households. LANC focuses its legal practice on critical basic needs: housing, consumer, public benefits, family, education, employment, health care, and elder law. We operate a toll-free call center so that clients can get easy access to information. Over 50,000 people call our toll-free number each year: 1-866-219-5262. We have an interactive website so that clients can get help online. www.legalaidnc.org. We re also on Facebook and Twitter. LANC employs statewide, special provider units that address specific issues: Our Veterans Project focuses on the many legal needs of the more than 800,000 veterans who reside in our state; over 100,000 of these are in poverty and eligible for our services. Advocates for Children s Services specialize in education issues and combating the School to Prison Pipeline. The Domestic Violence Prevention Initiative and Battered Immigrant Project focus on protecting victims of abuse and reducing the incidence of domestic violence. The Child s Advocate protects children and resolves complex, high-conflict custody matters. The Mortgage Foreclosure Project saves homes and home equity and protects homeowners from abusive lending and loan servicing practices--the project is a multi-partner project with a thousand open cases on any given day. The Senior Law Project and its toll-free hotline focus on the needs of the 240,000 seniors in poverty in our state. The Fair Housing Project works across the state to educate renters, owners, and landlords in order to fight housing discrimination in all its forms. LANC produces and presents, in rotation, over 45 separate clinics for clients in its twenty locations. These clinics range from information on housing and homelessness prevention, domestic violence, custody, foreclosure, veterans issues, expungements, and senior citizen issues. These clinics are designed to give people the information they need to avoid legal entanglements. Thousands of clients attend these clinics annually. LANC settles about 65% of its cases without litigation. When it goes to court however, it prevails over 90% of the time. When litigation is the best legal strategy for the client, LANC has a highly trained and experienced staff that is prepared to go to court to fight for its clients rights. LANC zealously litigates cases in every forum and at every level in the state and federal courts, including jury trials and through appeal in all jurisdictions. LANC s legal advocacy also includes 2

community education and outreach, consultations, and negotiation before litigation. We employ an informative website that permits clients to gain knowledge about legal issues and to contact any office in the state for direct help or for local pro se information. We also employ social media tools such as Facebook, Twitter, and e-newsletters. Much of our Helpline, our call center, work involves specific legal advice to address important legal issues or some brief service before litigation is pursued. The Helpline is set up and staffed to help thousands of clients each year. Each year, LANC recruits lawyers from corporate firms and the private bar to provide pro bono representation to our clients. These lawyers donate hundreds of hours to provide access to justice for our fellow citizens. Expanding Legal Services In 2014, LANC began an intensive expansion of its work with veterans that has continued throughout 2015. The state is home to approximately 800,000 veterans and over 100,000 of these are financially eligible for free legal services. We trained and certified approximately 30 advocates on veterans law. We participate in veterans "Standown" outreach events all over the state. LANC is part of the Veterans Pro Bono Network, which includes the North Carolina Bar Association and the state's law schools. We focus not only on veterans' benefits, but we strive to serve comprehensive legal needs, including issues affecting veterans' abilities to obtain employment and decent housing. In the past year, LANC directly served over 1,600 veterans as clients and over 2,700 households in which a veteran was a member. The second project is what we call "Re-entry." Re-entry advocacy helps clients clean-up arrest, conviction, and discharge records so that they again can qualify for employment and decent housing. Removing barriers to employment helps reduce the rate of recidivism for those, mostly, young men who have earned an opportunity for a second chance. The third project of note is called "Lawyer on the Line (LOL)." The LANC Helpline, the name of our toll-free call center that receives 2000 calls per month. The Helpline provides first-rate legal advice or brief service in situations where the client needs actual legal assistance but may not need to go to court right away. Lawyer on the Line is the project that recruits lawyers from the private bar to provide free consultations on poverty law issues to eligible clients. The average LOL case requires about two and one-half hours. LOL has recruited nearly one thousand lawyers and has served over 3,000 clients. Other noteworthy projects: Our Mortgage Foreclosure Project continues to save homes and the credit of thousands of families. Our collaborative, multi-agency project to become the most vigorous foreclosure defense projects in the country. We continue to shape and to expand our Medical-Legal Partnership Project. MLPs place lawyers in public health clinics to give medical staff the resources they need to change the social determinants of health. MLPs can reduce unnecessary returns to clinics and ERs, reduce community healthcare costs, and actually improve community health. The initial efforts in Durham have enabled LANC to obtain funding for similar projects at UNC, in Winston-Salem, Charlotte, Greensboro, and Moore County, which received a grant to help reduce unnecessary--and costly--return trips to the emergency room. LANC has initiated a partnership with Duke Law School to expand its clinical program by directly placing a Duke Law clinical professor and the clinical law students in our Durham office to handle complex housing cases and other matters. This model gives the law students direct experience with clients in the milieu of a busy legal aid office. The students not only learn valuable practical skills, but they learn how to interact with clients and they see first-hand the 3

collegiality and the indispensable teamwork that is part of effectively representing the poor. In a similar fashion, LANC also has begun discussions with Elon Law School to create--if sufficient funding is available--a joint clinic in Boone that will serve clients in Wilkes County and the surrounding area. The clinical model here will follow the model established by Duke and LANC in Durham. Both of these projects are at the very cutting-edge of clinical training for law students. The legal needs and resource demands vary as one goes across the state. LANC initiated a statewide needs assessment that will determine the legal needs of various client populations around the state so that we can target the neediest populations and be more effective in the utilization of our limited resources. The project will take up to six months to complete. Funding Cut For 2015, our state legislative and ancillary state funding was reduced by approximately $1.5M. We didn t cut staff at the beginning of the calendar year in the hopes that the legislature could restore our $1M appropriation. We did not accomplish that goal in the recent session, so LANC has been forced to lay off 48 employees in this quarter in order to balance its budget for 2016. We are proud of the fact that keeping these employees aboard through three quarters of 2015 helped us serve over 4,000 households that otherwise would have gone without counsel or representation. Due to the funding cuts, LANC is restructuring its intake and possible closing or merging office so that we can continue to provide the highest quality legal representation to as many families as possible.
