TOWN OF MANCHESTER PLANNING DEPARTMENT TO: FROM: Planning and Zoning Commission Renata Bertotti, Senior Planner DATE: October 10, 2017 RE: Main Pub Realty, LLC 300 Main St. (a.k.a. 304-306 Main St.) Special Exception - Outdoor Entertainment (2017-063) Design Overlay Review (2017-064) Introduction The applicant, Main Pub Realty, LLC, is seeking a special exception under Article II Section 12.02.11 to allow outdoor entertainment at the above listed address. If approved, the special exception will allow the applicant to install a staging area and provide outdoor entertainment on the previously approved and constructed outdoor patio at the Main Pub restaurant. Since the property is located within the Design Overlay Zone, the Commission is also asked to review the proposed stage under the provisions of Article II Section 25. History In July 2016, the Commission was approached by the owner of the Main Pub, Mr. Keith Beaulieu, who recently added an outdoor patio to his restaurant. Mr. Beaulieu expressed to the Commission his desire to provide outdoor music. The Commission members thought this idea was interesting for other areas in town as well, provided that no negative impact is caused to the neighboring residential uses, and subsequently approved a zoning regulation amendment to add outdoor entertainment use as a special exception use in the BIII zone. Project Description The attached site plan shows the location of the existing patio and location and detail for the proposed stage. According to the attached narrative, the Main Pub currently provides indoor musical entertainment, which, if this application is approved, will be moved to the proposed stage area. The late evening occurrences of the outdoor entertainment will be moved back inside at 10 p.m. Based on that, and as indicated in the attached application narrative Impact Statement, the applicant does not anticipate any increase in traffic in the area that has not already been considered during the previous construction of the parking lot, ingress and egress. The applicant s sound engineer, KJR Engineering, LLC, performed the sound testing in June 2017. According to the attached narrative, the music was played at the proposed staging area, and the
sound was directed towards the back parking lot. The sound test results are included in the attached narrative. In addition, the attached narrative addresses the compliance with the general special exception requirements point by point. For the Commission s Consideration The Commission should determine whether the proposed outdoor entertainment meets the general criteria of Article IV Section 20 of the zoning regulations, as well as the specific criteria of Article II Section 12.02.11, which are listed below: a. To the extent possible, sound amplification and light equipment is oriented in a manner that directs the sound and light away from abutting properties, and buffering is provided to mitigate noise and light trespass; b. Outdoor entertainment shall start no earlier than 11 AM and shall cease no later than 10 PM; c. The Planning and Zoning Commission may impose additional requirements regarding buffering and days and hours of operation in cases when the site on which the outdoor entertainment is proposed is located within 200 feet of a residential property, place of worship or school. As noted above, because this site is inside the Design Overlay Zone, the Commission is also asked to review the proposed stage under the provisions of Article II Section 25.
