No: 12/01578/LBC Ward No: 8 Kinross-shire Summary This report recommends approval of the application for alterations and replacement windows as the development is considered to comply with the Listed Building Legislation, the provisions of the Development Plan and supplementary Planning Guidance subject to compliance with conditions. BACKGROUND AND DESCRIPTION 1 Milnathort Town Hall is an imposing category B listed 19 th century community hall located in the centre of the village of Milnathort. The proposal is to refurbish the general fabric and decorative order of the building, whilst introducing additional and more up-to-date accommodation and services through internal adaptation. 2. In detail this application will include the proposed renewal of 5 and the refurbishment of 10 of the original 15 windows, and the proposed renewal of 2 blind windows. This refurbishment will also include significant internal alterations: 1. for the central 2 storey section of the building between the clock tower and the hall; 2. removal of the first floor level, upper floor partitions and details, the insertion of a mezzanine, a storage floor within the clock tower and a helical stair and lift; 3. existing balustrade to be removed to the lower tower flight. 3. In accordance with Regulation 5 of the Town and Country Planning (Listed Buildings and Buildings in Conservation Areas) (Scotland) Regulations 1987 the Listed Building application has been advertised in the Local Press, Edinburgh Gazette and a site notice was displayed on the 27 September 2012. NATIONAL POLICY AND GUIDANCE The Scottish Planning Policy 2010 4. This SPP is a statement of Scottish Government policy on land use planning and contains: the Scottish Government s view of the purpose of planning, 123

the core principles for the operation of the system and the objectives for key parts of the system, statutory guidance on sustainable development and planning under Section 3E of the Planning etc. (Scotland) Act 2006, concise subject planning policies, including the implications for development planning and development management, and the Scottish Government s expectations of the intended outcomes of the planning system. 5. Of relevance to this application are Paragraphs 110-124 : Historic Environment Paragraphs 113-114: Listed Buildings Scottish Historic Environment Policy (SHEP) 6. Sets out Scottish Ministers policies, providing direction for Historic Scotland and a policy framework that informs the work of a wide range of public sector organisations. Managing Change in the Historic Environment (Windows) 7. Is one of a series of guidance notes from Historic Scotland on managing change in the historic environment. The series explains how to apply the policies contained in the Scottish Historic Environment Policy and Scottish Planning Policy. DEVELOPMENT PLAN 8. The Development Plan for the area consists of the TAYplan 2012 and the Kinross Area Local Plan 2004. TAYPlan June 2012 9. Under the TAYplan the principal relevant policy is in summary: Policy 3: Managing TAYplan s Assets 10. This recognises the importance of historic buildings and townscapes and identifies the importance of only allowing development where it does not adversely impact upon or preferably enhances these assets. Kinross Area Local Plan 2004 11 Under the Local Plan the site lies within the settlement boundary for Kinross and Milnathort where the principal relevant policies are in summary: 124

Listed Buildings Policy 31 12. There will be a presumption against the demolition of Listed Buildings and against works detrimental to their essential character. There will be a presumption in favour of consent for development involving the sympathetic restoration of a Listed Building, or other buildings of architectural value. The setting of Listed Buildings will also be safeguarded. Policy 32 13. The Council will encourage the restoration, correct maintenance and sensitive enhancement of Listed Buildings by the use of the powers available to them under the Planning Acts. PERTH & KINROSS PRPOSED LOCAL DEVELOPMENT PLAN 2012 14. Members will be aware that on 30 January 2012 the Proposed Local Development Plan was published. The adopted Local Plan will eventually be replaced by the Proposed Local Development Plan (LDP). The LDP has recently undergone a period of public consultation. The Proposed Local Development Plan may be modified and will be subject to examination prior to adoption. It is not expected that the Council will be in a position to adopt the Local Development Plan before December 2014. The Plan may be regarded as a material consideration in the determination of this application, reflecting a more up to date view of the Council. 15. Under the Proposed LDP the application site lies within the defined settlement boundary for Milnathort, where the principal relevant policy is in summary:- Policy HE2 : Listed Buildings 16. States that there will be a presumption in favour of the retention of listed buildings, and the protection of their settings. OTHER POLICIES 17. None. Historic Scotland Although they broadly supported the refurbishment of this key historic building they objected to the replacement of windows (W.11 and W.12) and the door leaves and frame (D.01) as they were important architectural features of the building. 125

REPRESENTATIONS 20. The Kinross-shire Civic Trust submitted a late comment supporting the application for replacement windows. ADDITIONAL STATEMENTS 21. The determining issues in this case are:- the statutory requirement under Section 14 and 59 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 for the planning authority to have special regard to the desirability of preserving the building or its setting or any features of special architectural historic interest which it possesses; whether the proposal complies with development plan policy; whether the proposal complies with supplementary planning guidance; or if there are any other material considerations which justify a departure from policy. Window Replacement 23. Following consultation with Historic Scotland and input from the Conservation Officer, the agent has agreed to refurbish 3 of the 5 windows, that is, W.02, W.11 and W.12 with the renewal of window W.01 and the upvc window W.13, which are both to be changed to timber sash and case windows. 24. Historic Scotland would prefer the retention of the blind windows and agree that caution should be exercised in proposing the insertion of real windows. However I consider the creation of an additional column of windows at the far right side of this elevation preserves the special character of the building and assists in enhancing the internal environment of the new spaces in a historically-appropriate way. Internal Alterations 25. The proposed internal alterations are regarded as being acceptable and the comments of the Conservation Officer have been incorporated. 26. Although the area retains some panelled doors it otherwise contains no features of decorative or historic interest; and the alterations are restricted to the areas which have already undergone significant alteration and retain the least significant internal features. Although plain the existing ironwork balustrade appears original to the stair and this part of the building. I have no 126

objection to the removal of later clutter and over-cladding from the stair but the balustrade itself should be retained. 27. The agent also agreed that door D.01 will be repaired if possible. Whilst the existing Milnathort Town Hall fulfils the basic provisions required of a community hall it is widely recognised that the building is in need of comprehensive refurbishment to provide an up to date community facility. A refurbished building would improve the quality of accommodation for existing users and also make the building more appealing to a broader section of the local community. 28. The completed project would provide additional floor space available for public use and improved heating, welfare, access & storage facilities. The reconfigured accommodation & refurbished entrance hall will create a more inviting entrance to the main hall, enhancing the internal space, and more of the original building fabric will be visible and uncluttered. PLANNING AUTHORITY WITH AN INTEREST IN THE LAND 29. The Town and Country Planning (Notification of Applications) (Scotland) Direction 2009 advises on the procedure for notification of planning applications to the Scottish Ministers for developments in which planning authorities have an interest in. The Direction states that notification to the Ministers is only required where the proposal involves a significant departure from the authority s own Development Plan. As the recommendation of approval is not a significant departure from the Development Plan, a notification to the Ministers is not required. LEGAL AGREEMENTS 30. A legal agreement is not required for this application. DIRECTION BY SCOTTISH MINISTERS 31. Under the Planning (Listed Buildings and Conservation Areas)(Scotland) Act 1997 section 73 there is a direction by the Scottish Government in respect of notification relating to this application. CONCLUSION AND REASONS FOR RECOMMENDATION 32. In conclusion, the proposal is considered to comply with the requirements set out in legislation to preserve the special architectural historic interest which the buildings possess. Additionally I do consider the application to be in accordance with the adopted Development Plan, I have taken account of material considerations and find none that would justify refusing the application. The application is therefore recommended for approval subject to conditions. 127

RECOMMENDATION A Approve the application subject to the following conditions: 1 All new external and internal works and finishes and works of making good to the retained fabric, shall match the existing adjacent work with regard to the methods used and to material, colour, texture and profile, unless shown otherwise on the drawings or other documentation hereby approved or required by any condition(s) attached to this consent. 2 The new facing masonry shall match the existing masonry adjacent in respect of type, colour, texture, face bond and pointing, unless shown otherwise on the drawings or other documentation hereby approved or required by any condition(s) attached to this consent. 3 Details in respect of the following shall be submitted to and approved in writing by the Council as local planning authority before the relevant work is begun. The relevant work shall be carried out in accordance with such approved details. a. Details of the proposed replacement stone to be used in repairs, including evidence of petrographic matching to ensure as close a match in appearance and weathering qualities as possible. b. Specification and method statements for lime putty, mortar repairs and repointing. c. Details of the Rinceau work repair including specifications and method statements from a suitably qualified conservation professional. d. Details of secondary glazing to historic window openings. e. Sample of proposed slate for the new boiler house roof. 4 No works authorised by this consent shall take place until the applicant has implemented a programme of building recording and analysis. This programme shall be in accordance with a written scheme which has been submitted by the applicant and approved by the Council as local planning authority. A copy of the resulting survey shall be deposited in the local Sites and Monuments Record upon completion. 5 Window numbers W.02, W.11 and W.12 shall be retained to the satisfaction of this Council as planning authority 6 Door number D.01 shall be refurbished unless evidence is provided that this is not possible, to the satisfaction of this Council as planning authority, in which case the replacement shall match the existing in terms of design and material. It is considered that the development complies with the relevant provision of the adopted local plan as well as the listed building legislation and supplementary planning guidance. C PROCEDURAL NOTES Milnathort Town Hall is a category B listed building and this application requires to be referred to Historic Scotland for determination. D INFORMATIVE This listed building consent will last only for three years from the date of this decision notice, unless the development has been started within that period.
