Approval of Minutes Perry Lorah made a motion to approve the August 8, 2016 Borough of Akron Council meeting minutes. Earl Shirk seconded the motion. Motion carried. Perry Lorah made a motion to approve the August 22, 2016 Borough of Akron Council meeting minutes. Philip Benigno seconded the motion. Motion carried. Visitors Philip Benigno made a motion to allow Akron Grace EC Church to place signs for their November 3, 2015 Craft Show on three separate properties (530 Main Street, 1141 Main Street and 132 N. Seventh Street) Signs can be placed on property thirty days prior to the event and taken down the day after the event. Tammy Ruth seconded the motion. Motion carried. Ryan Cochran, 1235 Main Street who serves as a member of the Akron Borough Planning Commission had comments on the proposed in lieu of taxes agreement with Handi Vangelism. Ryan mentioned that the Borough would have no recourse if Handi Vangelism would have financial difficulty and could not pay taxes and this is unfair to tax payers. Ryan Cochran also mentioned that Handi Vangelism is a good organization. Ryan also mentioned Council could do nothing is Handi Vangelism would re organize under another name (another non profit) and it is important to protect tax payers. Earl Shirk commented neither himself, Council or Ephrata Area School District are interested in the proposed in lieu of taxes agreement from Handi Vangelism. Sam Baughman, S. Ninth Street, Akron and a member of the Akron Borough Planning Commission mentioned at the last Planning Commission Meeting a few people spoke out against the Borough. Sam also mentioned that Handi Vangelism has not purchased the property and has not come forward to tell us what they are doing. Sam Baughman mentioned the tax issue is separate and the Planning Commission is here to do what is best for the Borough of Akron. Hope Stayer, Bomberger Road, Akron asked if Council has made a decision in regards to the bank behind her property. Dan Guers mentioned he met with DEP. DEP recommended placing large boulders along 1

the stream bank rather than the rip rap and limiting additional land disturbance. This work won t take place until next year. Brian Boyer mentioned the cost of the Front Street project seemed low at $16,000.00. Dan Guers mentioned the figure did not include the black top of approximately $9.000.00. Dennis & Dawn Stauffer, 209 S. Tenth Street, Akron commented to Council about the abandoned property at 203 S. Tenth Street. Dennis Stauffer mentioned the property is not maintained and the back of the house is covered with black mold and there are a lot of bugs. A sign has been posted on the door stating all personal property has to be removed within thirty days. Dawn Stauffer mentioned this property is an eyesore and there are health and safety concerns. Dan Guers mentioned he sent a notice of violation to a company in North Carolina and will try to contact them again. Council asked if fines have been issued. Dan Guers said no. Dawn Stauffer mentioned something needs to be done and should I get a petition. Dawn Stauffer will contact Sue Davidson will phone numbers to try to contact those who should be maintaining this property. Jeff Shirk, 307 Main Street, Akron PA applauded the Main Street project. Jeff mentioned there was very little disruption with parking etc. Jeff Shirk also mentioned the water main project on Front Street and wanted to know why Aaron Murray was helping and is he on the Borough payroll. Dan Guers will follow up on this issue. George Wolf, 16 Miller Road, Akron asked if the Borough newsletter can included the dates of times of Council committee meetings. George Wolf showed a picture of an abandoned vehicle behind the Akron Fire Hall and it has been sitting there for months. It was mentioned that the Fire Company was using the car for training and it has been removed. Mayor Mayor John McBeth Mayor McBeth shared two newspaper articles the first was about the Akron EC Church presenting a fruit basket to the Akron Police Department. The second article was 50 years ago Akron Borough got financing to place sewer lines in the Borough. Mayor McBeth also mentioned a ribbon cutting ceremony for a building recently purchased by the Ephrata Public Library. Police Chief Zell Distributed August 2016 report Kirby Smith Chairperson of the Akron Civil Service Commission recommended the hiring of Paul Cook for the full time police officer position. Paul Cook is already MOPEC certified and will only need to have a physical. 2

Earl Shirk made a motion to hire Paul Cook as a full time Police Officer (as recommended by the Akron Civil Service Commission) at a base salary of $66,414.00 beginning October 1, 2016 pending a physical examination. Philip Benigno seconded the motion. Motion carried. It was also mentioned that Mr. Cook resides in Akron. Motion carried. Chief Zell shared a list of items the police department oversees other that enforcement. House check registers, emergency vehicle unlocks, fingerprinting, missing persons, faulty equipment cards, safety talks at schools and daycares, unannounced porch visits, death calls, NARCAN. Chief Zell also mentioned that Akron Borough Police Dept has the highest calls per officer in the County. George Wolf mentioned Akron Police Dept is the best department around and he was Mayor of Akron at one time. George Wolf also mentioned he has slides and a projector given to him by Wilmer Hall and would like to share this with the Borough. Mayor McBeth mentioned sharing with the pictures with Historical Society of the Cocalico Valley. Committee Reports Administration and Finance Committee Thomas Murray (not present) Perry Lorah had a question on two invoices 1) Martin s Paving for Front Street and WEX for gasoline/diesel. Martin s Paving invoice was correct. Sue Davidson will follow up on the WEX invoice. Perry Lorah made a motion to pay the bills as reviewed by the Finance Committee (except WEX Bank). Earl Shirk seconded the motion. Mayor McBeth mentioned that the Solicitor invoices seem high for his work on the Handi Vanglism tax issue. Motion carried. Perry Lorah read into the minutes the August 2016 month end balances. General Fund $101,045.33 Water Fund $ 27,421.55 Sewer Fund $ 26,481.68 Highway Aid Fund $122,602.29 General Reserves $136,699.12 Water Reserves $125,747.86 Sewer Reserves $186,778.75 Capital Const $.58 Community Fund $ 3,813.07 Total $730,590.23 Escrow $ 60,119.54 Perry Lorah mentioned the budgeted revenues are at 65% and budgeted expenditures are 58% Council reviewed the 2016 Capital Projects list. Dan Guers mentioned he will be checking on prices for an aerator. 3

Streets & Sewer Committee Justin Gehman (not present) Dan Guers mentioned the micro surfacing on Main Street has been completed. Personnel & Public Safety Commission Earl Shirk Earl Shirk made a motion to appoint Susan Davidson as Borough Manager/Borough Secretary with a ten percent increase for an annual salary of $73,000 beginning October 1, 2016. Earl Shirk amended his motion to include permit officer as part of the appointment and the job description is described in Borough Ordinance 204 Section 201 217. Perry Lorah seconded the motion. Motion carried. Earl Shirk wished Dan Guers well in his future endeavors. Water Committee Philip Benigno Philip Benigno had nothing to report. The August 2016 water report will be e mailed to Council members tomorrow. Parks, Property & Planning Committee Tammy Ruth Council discussed the access trail from the Colonial Park and getting estimates. John Williamson mentioned an Akron resident is willing to coordinate volunteers to plant trees along the Rail Trail and it would like to get the trees planted this year. John Williamson will e mail the information to Tammy Ruth and Sue Davidson. Kay McEllhenney, Scenic View Drive Akron mentioned with the new parking lot at the Lions Lodge, there should be a weight limit. McEllhenney also mentioned repairs and painting should be included in the park budget for next year. Community Relations & Special Projects Committee Perry Lorah Perry Lorah mentioned Movie Night is scheduled on September 17 th at 7:30 p.m. at the Broad Street Park. Two Disney movies will be shown. Borough Manager Dan Guers Distributed September 2016 report The Lions Lodge paving project began today and should be completed by this Wednesday. Route 272 repairs through the Akron corridor should be completed by the middle of September. Micro surfacing on Main Street is competed. Dan Guers will make arrangements for final inspection and to include Justiin Gehman and Sue Davidson. The Borough should receive $14,500.00 for the final reimbursement claim from PEMA for the January snow storm. The public works position has been filled. Evan Shupp was hired and began work on September 6, 2016. 4

The next Brorough s Association is September 28 and the Arro Golf outing is scheduled for September 29, 2016. Dan Guers received a copy of the 2017 2019 revised SRO contract and will e mail to Council. Gazebo at Roland Park repaired and forwarded to two NOV s to properties in Akron. Borough Solicitor No rate increase for 2017 Fire Chief Distributed August 2017 report Planning Commission Earl Shirk made a motion to recommend for advertisement of the amended Zoning Ordinance in the C 1 Commercial District and the Temporary Sign Ordinance for approval on October 10, 2016. Philip Benigo seconded the motion. Motion carried. Reid Myers, Akron PA submitted a letter to Council requesting a special exception to allow multi family dwellings under C1. Reid Myers will be submitting another letter from his engineer with more information. Sam Baughman mentioned that in 2017 the Planning Commission meetings will be scheduled for the week before Council meeting. These meetings will be properly advertised at the beginning of 2017. New Business John Williamson mentioned a lot of residents responded to the newsletter asking for Steering Committee volunteers. Will try to schedule a meeting after October 14. 5

Earl Shirk made a motion to appoint to the Akron Steering Committee. The names of those appointed for the Steering Committee Denise Auker, Chris Beiler, Tim Cable, Ryan Cochran, Kenneth Harmes, Sean Molchany, Joyce Moyer, Mike Reading, Bob Sherman, Sam Shoemaker, Penny Talbert, Andrew Will. Perry Lorah seconded the motion. Motion carried. Earl Shirk made a motion to accept with regrets the resignation of Philip Benigno (signed resignation letter attached) from the Borough of Akron Council. Philip is moving out of Akron Borough. Tammy Ruth seconded the motion. Philip Benigno recommended Nate Imhoff to serve as his replacement. Motion carried. An appointment will be made to fill the Council vacancy at the October 10, 2016 Council meeting. Committee Meeting September 26, 2016 Codification 6:30 p.m. Perry Lorah on behalf of Council presented a plaque to Dan Guers, Borough Manager who will be retiring the end of this month. Dan Guers thanked Council, Mayor and staff and mentioned how much he likes Lancaster County and the many friends he has made over the years working at the Borough.
