GENERAL TARIFF PROVISIONS : a) Overtime working hours are considered from 22.00 hrs to 06.00 hrs of the next day, and from 22.00 hrs on Friday to 06.00 on Monday as well as during holidays. b) Service ordering party is obligated to inform the service provider 12 hrs in advance, and to place an order 6 hrs prior to the service requested. c) Vessels transporting crude oil, oil derivates, chemicals and liquefied gas and in possesion of gas-free certificate will not be charged for additional or increased costs. d) Services not stated in this Tariff to be agreed separately. e) In case of increased fuel and lub oil prices up to 10%, being increased either at once or partially, the proportional tariff correction will be applied. Same will be applied if other materials prices needed for rendering the service increase accordingly. f) Items shown within the tariff do not include the value added tax (VAT), which is separatelly calculated and indicated on the invoice. g) Vessels with double tonnage measurement will be calculated the tariff considering the greater GT. h) Service tariffs for domestic ordering parties is calculated in Croatian kunas, by converting EUR rates into kunas at the mean exchange rate of Croatian National Bank on a day when the service invoice is issued. i) Invoice for services rendered must be remitted within 15 days for domestic clients and within 30 day for foregin clients from the date when invoice is issued. j) If the service is not requested in prescribed time Jadranski pomorski servis d.d. does not guarantee for providing the service in requested time and cannot be held responsible of the delays that may arise out of such situation. k) Common tariff provisions are constituent parts of the tariff and are applied at the whole tariff unless defined differently by the separate tariff provisions table. l) Tariff tables shall apply from July 1st, 2008.

CHART A Towage is any operation rendered by tugs to the vessel by pulling, pushing and/or holding during the course of entering, departing or shifting in the Port of Rijeka, basin Rijeka and its aquatorium, comprising also other services performed on the basis of the client s order or special agreement by the service provider (hereinafter referred to concessionaire for port towing JADRANSKI POMORSKI SERVIS d.d.) with its tug-boats and/or crew. FROM 75.001 GT OVER 663,04 TARIFF PROVISIONS TO BE APPLIED TO TABLE A: 1. The Tariff chart is calculated per movement of one hour per tug in normal conditions during ordinary working time. For each additional commenced half hour after one hour in the area of Port of Rijeka (basin Rijeka, Sušak i Bakar) and its aquatorium, 50% of the basic tariff will be charged. 2. To the actual time worked on Port s territory 15 minutes are to be added for the arrival of tugs from the base to the vessel and 15 minutes for its return. 3. Surcharges to the tariff chart For extra services and conditions the tariff chart shall be increased by: - 25% for the overtime on working days and Saturdays, - 50% for operations performed on Sundays and holidays and non-work days., - 25% for vessels with dangerous and inflammable cargo, - 100% for vessels with nuclear substances on board, - 100% for vessels who was not under his own power, - 10% for supply of the towing cable by the tug, - 25% for use of a tug with over than 1.500 kw 4. Ordinary working time is on Monday from 04.00 to 22.00 and from Tuesday to Friday from 05.00 to 22.00 hrs and on Saturdays from 05.00 to 14.00 hrs. Overtime work is on Sundays and holidays, from 22.00 hrs on Saturday or on a day before holiday to 04.00 hrs on Monday or to 05.00 on a day after holiday.

5. In normal conditions, the company Jadranski pomorski servis d.d. shall deliver the water supply to the ship by its tug on the basis of an order received no less than 12 hours before the delivery. The single water delivery depends on the capacity of the tug s tank. Jadranski pomorski servis d.d. shall not be held responsible for the speed of water pumping. The price of this service is EUR 336,10 for each commenced hour, exclusive of the price of water. The price of water is charged by water suppliers of port of Rijeka. The quantity of water is determined by the counter reading at the outlet on shore. 6. In case of idle time caused by a delay on the part of the ship (e.g. anchor lifting, nonreadiness of the engine or other facilities, nonperformed formalities, etc.) and lasting more than 30 minutes, each commenced hour of idle time shall be charged at 30% of the applicable rate. If the towage has been cancelled after the tugboats have sailed out or been placed at the disposal of the ship, 50% of the rate shall be charged. In case the ship bears two different gross tonnage designations, the higher one shall apply for the account of services. 7. Liquid cargo ships (tankers) not carrying dangerous or inflammable cargo shall submit the gas-free certificate for not being charged for additional costs. 8. For vessels of an individual Shipowner whose ships have regularly entries in port of Rijeka, Jadranski pomorski servis d.d. will approve privileged Tariff conditions in agreement with Port of Rijeka Authority. In order to exercise the Tariff from the preceding paragraph, the Shipowner shall file an application in writing to the Licensed performer no later than by the time of vessel s departure from the Port. 9. Tariff rates are exclusive of V.A.T., which is accounted for to the users in accordance with the current law. 10. Services not included in this tariff shall be charged according to a separate agreement.

For each additional commenced half hour after one hour 50% of the basic tariff will be charged. b) For towing of the vessels carrying crude oil and oil derivates (tankers), the rates listed shall be increased by 25%. c) For towing of vessels and other tug services rendered by tugboats on Oil terminals Sepen and Sršćica, the rates of this Table shall be increased by 40%. d) For towing vessels with engine troubles or without engine usage (without using their steering gear, windlass and warping winches), an additional 50% charge will be calculated. e) For supply of the towing cable by the tug, an additional 20% charge will be calculated. f) If towage order or tug service ordered of the already departed tug/s is cancelled, a charge amounting to 50% of the rate comprised by this Tariff will be applied. g) In case of tugs waiting on the determined service spot for more than half an hour caused by the vessels delay, 30% of the rate shall be charged. h) Towing in week working days after regular working hours and on Saturday shall be increased by 25%, while on Sunday and holidays by 50%. i) Effective towage which started or completed in overtime will be charged on overtime work basis. j) When towage service is rendered in fire fighting, the rate does not include expenses of the materials, chemicals means, and other used or destroyed things. These expenses will be charged on basis of their purchase price valid on the day of service rendered.

k) To the actual time worked in basin of shipyard 3. Maj 20 minutes are to be added for the arrival of tugs from the base to the vessel and 20 minutes for its return ; and for basin of shipyard Viktor Lenac 30 minutes are to be added for the arrival of tugs from the base to the vessel and 30 minutes for its return. To the actual time worked in basin of shipyard Kraljevica 60 minutes are to be added for the arrival of tugs from the base to the vessel and 60 minutes for its return. l) To the actual time worked on INA Berth Mlaka territory, 20 minutes are to be added for the arrival of tugs from the base to the vessel and 20 minutes for its return ; and for INA Berth Bakar and terminal Sršćica and Sepen territory, 60 minutes are to be added for the arrival of tugs from the base to the vessel and 60 minutes for its return. To the actual time worked on INA Berth Urinj territory, 45 minutes are to be added for the arrival of tugs from the base to the vessel and 45 minutes for its return.

CHART C COLLECTION AND TRANSPORT OF LIQUIDS WASTES FROM VESSELS EUR SINGLE VESSEL HIRE 890,00 Up to 70 m3 25,00 /m3 From 70 m3 Up to 200 m3 23,00 /m3 From 200 m3 Up to 400 m3 21,00 /m3 From 400 m3 Up to 600 m3 19,00 /m3 Over 600 cbm, the rate will be mutually agreed. Above rates include: a) Berthing and departure. b) Shifting of vessel from which liquids are collected, lasting up until 3 hours. c) Delivery of the line including the international standard connection. d) Tugboat assistance, if necessary. e) Collected liquids quantity determination and corresponding certificates issuance of kind and quantities of liquids which has to be done onbord of receiving vessel. Rates listed above apply Rijeka Bay, while rates for services in other areas and for services amounting in over 1000 cbm, will be agreed separately. If collecting of liquids is interupted by bad weather or by fault of a delivering vessel, the "Jadranski Pomorski Servis " d.d. may terminate the operation and consider it as completed, regardless of quantity collected. In case when liquid wastes to be collected particulary unsuited either for diposal (due to their chemicalor physical properties), or for the collecting process itself, "JPS" Company shall agree on special terms and prices for such operations. The principal is obliged to provide the equipment for transfering liquids, the capacity of which must not be less than 50 cbm per hour. If the principal's equipment does not comply with tha stated capacity, the increased rates will be agreed separately. For the quantaties exceeding 100 cmb, minimum pumping rate will be agreed separately. When presence of security issues experts is needed, according to the regulations, the service user is obligated to ensure their presence.

OUT OF PORT COASTAL TOWAGE: - TUG up to 2500 KW 680,00 EUR/hour - TUG over 2500 KW 820,00 EUR/hour TARIFF PROVISION APPLICATIONS TO CHART D: a) Technical floating means hire rate includes the work of mean s operator. b) Hire of above means in overtime service is to be increased by 25% during regular week working days, while on Saturdays, Sundays and holidays to be increased by 50%. c) Hire of all above means is calculated from departure time from the tugs base until the time of return to the base. d) Rates listed in the chart are reffered to one tugboat single use. For each additional commenced half hour after one hour 50% of the basic tariff will be charged.

CHART E FRESH WATER SUPPLY BY TUGBOAT Vessel fresh water supply by tugboat up to tugboat s full fresh water tank capacity (up to 27 and 36 tons) in the aquatorium (anchorage) of the Port of Rijeka area will be calculated by 336,10 EUR/hour. Vessel fresh water supply by tugboat up to tugboat s full fresh water tank capacity (up to 27 and 36 tons) in the aquatorium (anchorage) of INA Bakar, Omišalj, Sepen and Sršćica will be calculated by 420,13 EUR/hour.

TARIFF PROVISION APPLICATIONS TO CHART F: a) The unified tariff is referred to a single vessel s arrival/departure from the Port of Rijeka area - Basin of Omišalj regardless of number of tugs used and without additions for any overtime work as well as additions for use of the towing cable by the tug. In case of service price division need for arrival and departure, a price will be divided taking a number of tugs used in account for arrival and departure of the vessel. b) For the tugboat that stays on disposition to the vessel for over one hour after vessel berthed, if ordered so by vessel s Master or vessel s agent, a price in amount of 25% of the Tariff item shall be calculated. c) Shifting alongside the same berth shall be calculated by 50% of the Tariff item. d) For towing vessels without its engines use or with improper technical means, an additional 25% charge will be calculated. e) If towage or tug service ordered of the already departed tug/s is cancelled, a charge amounting to 25% of the rate comprised by this Tariff will be applied. f) Shifting of vessels is treated as 2 (two) separate assistances (arrival/departure). g) For tugboat s fire fighting services, the rate does not include materials, chemical means and/or expenses of other materials used. These expenses will be charged based on their purchase price on the day of service rendered. h) Invoice for services rendered must be remitted within 30 days of the invoice issuance date. i) Service ordering party is obligated to inform the service provider 12 hrs in advance, and to place an order 6 hrs prior to the service requested. j) Items shown within the tariff do not include the value added tax (VAT), which is separately calculated and indicated on the invoice. k) Service tariffs for domestic ordering parties is calculated in Croatian kunas, by converting EUR rates into kunas at the mean exchange rate of Croatian National Bank on the day of issuing the service invoice. l) For the proper implementation of Tariff items, vessels Brutto Tonnage (BT) will be determined according to valid regulations. m) Hire of escort tugboat is calculated from departure time from the tugs base until the time of return to the base. Usage obligation is determinate by Port of Rijeka Authority / Harbour Master office Rijeka.
