BRISTOL CITY COUNCIL BYELAWS (ALTERNATIVE PROCEDURE)(ENGLAND)REGULATIONS 2016 ( The Regulations ) NOTICE OF PROPOSAL TO MAKE BYELAWS FOR PLEASURE GROUNDS, PUBLIC WALKS AND OPEN SPACES TAKE NOTICE THAT 1. Bristol City Council proposes to make those byelaws identified in Schedule 1 and having the effect there described in relation to certain pleasure grounds, public walks and other open spaces ( OS ) within its administrative area held for the purpose of section 164 of the Public Health Act 1875; section 15 of the Open Spaces Act 1906; or sections 12 and 15 of the Open Spaces Act 1906. The said land is more particularly identified in Schedules 2 and 3. 2. The draft of the byelaws, the statement and report prepared under paragraphs 5(2)(c) and 6(2) (c) of the regulations may be inspected free of charge online at https://bristol.citizenspace.com/neighbourhoods/parks-byelaws and at all reasonable hours at the council s principal office at: Bristol City Council City Hall College Green Bristol, BS1 5TR 3. The documents referred to in paragraph 2 above may be inspected and representations or objections made during the period of 28 days beginning with the date of publication of this notice. Schedule 1: Proposed byelaws and summary of intended effect. Byelaw number and description and summary of its intended effect: 3. Opening times: Prevent people entering or remaining in the ground except during opening hours 4. Protection of structures and plants: Stops people taking moving or damaging plants and structures that have been provided for the benefit of the public and protects landscaping works 5. Unauthorised erection of structures: Ensures structures only erected where the council consents 6. Grazing: Ensures grazing only happens with the council s consent 7. Protection of wildlife: Prohibits killing, injuring, hunting, trapping, snaring or shooting of wildlife 8. Camping: Ensures camping only takes place with the council s consent 9. Fires: Ensures fire lighting and barbecuing only takes place where the Council consents and/or in designated areas 10. Missiles: Prevents injury to others using the public space 11. Interference with life-saving equipment: Ensures equipment is available for use in an emergency 13 Horses: Ensures no horse riding takes place in the grounds identified in Schedule 2 except on permitted or designated routes or in exercise of a lawful right/privilege and then only in a safe manner 14. Cycling: Prevents cycling causing danger or fear of injury to other users of the ground 15. Motor Vehicles: Ensures cycles, trailers and vehicles only used where there is a right of way or a designated route in the ground 16. Overnight Parking: Prevents motor vehicles being left without consent of the council between 22:00 and 06:00 18. Archery: Ensures safety by prohibiting the sport of archery except with the Council s consent as part of an organised event 2

19. Field sports: Ensures safety by prohibiting throwing of javelins, hammer, discus or shot except with the Council s consent as part of an organised event or on land set aside by the council for that purpose 20. Golf: Ensures golf may only be played on the golf course 22. Fishing: Ensures fishing only takes place in designated areas 23. Blocking of Watercourses Helps to prevent blocking of watercourses and flooding of land 25. Model aircraft: Ensures model aircraft only flown in designated areas 26. Provision of Services: Ensures services for which a charge is made are only offered or provided with the council s consent 27. Excessive Noise: Except as part of an event that has the council s consent, enables other user to request a person to desist from shouting, singing, playing instrument or operating radios or other sound equipment which is so loud or repetitious as to cause annoyance, except 28. Public shows and performances: Ensures these only happen with the council s consent 29. Aircraft, hang gliders and hot air balloons: Ensures that expect in an emergency council consent needed for taking off or landing of these craft 30. Obstruction: Prevents obstruction of council officers, contractors and others properly using the ground 31 Savings: Makes sure that things are permitted when done by council officers or contractors to meet their duty and to preserve any pre-existing lawful rights that people might have in the ground, such as public rights of way 32. Removal of offenders: Allows a constable or a council officer to remove any person offending against any of these byelaws 33. Penalty: Sets maximum penalty for offending against any byelaw to a fine not exceeding level 2 on the standard scale 34. Revocation: Revokes byelaws made in respect of some of the affected land between 1886 and 1986. 3
