BY-LAW NO. - 133 A by-law of the City of Ottawa to impose, levy and collect a rate for the purposes of The Sparks Street Mall Management Board with respect to the Sparks Street Mall for the year. WHEREAS section 2 of the City of Ottawa Act, 1984, S.O. 1984, Chapter Pr23, provides that the cost of establishing, operating and maintaining a pedestrian promenade in the City of Ottawa shall be apportioned between the City and the owners of property abutting on a pedestrian promenade as the Council may prescribe; AND WHEREAS By-law No. 200-86 entitled A by-law of The Corporation of the City of Ottawa to establish Sparks Street as a pedestrian promenade was amended by By-law No. 89-95 to define the Authority as the Sparks Street Mall Management Board as defined in By-law No. 77-92 of The Corporation of the City of Ottawa; AND WHEREAS the Council has prescribed in Section 16 of By-law No. 77-92 entitled A by-law of The Corporation of the City of Ottawa to establish a pedestrian promenade authority to be known as the Sparks Street Mall Management Board, as amended, that the annual cost of maintenance and operation of the Sparks Street Mall as shown in the estimates of the Sparks Street Mall Management Board, for the current year shall be levied against the abutting owners on a per metre frontage basis on Sparks Street on the north side from Elgin Street to Bank Street, and Sparks Street on the south side from Elgin Street to Bank Street, for a total of 993.76 metres, and Sparks Street on the north side from Kent Street to Lyon Street, and Sparks Street on the south side from Kent Street to Lyon Street, for a total of 334.97 metres, and Sparks Street on the north side from Bank Street to Kent Street, and Sparks Street on the south side from Bank Street to Kent Street, for a total of 349.36 metres; AND WHEREAS the estimates of the said Board show that the cost of maintenance and operation to be levied against the abutting owners in is FOUR HUNDRED TWENTY FIVE THOUSAND DOLLARS ($425,000) calculated at TWO HUNDRED FIFTY THREE DOLLARS AND TWENTY SIX CENTS ($253.26) per metre. THEREFORE, the Council of the City of Ottawa enacts as follows: 1. For the purpose of defraying the cost of maintenance and operation of a pedestrian promenade in the City of Ottawa, the rate of TWO HUNDRED FIFTY THREE DOLLARS AND TWENTY SIX CENTS ($253.26) per metre frontage shall be imposed and levied in addition to all other charges upon the properties set forth in Schedule A attached hereto. 2. For payment-in-lieu of taxes due upon all rateable property in a business improvement area that is in a prescribed business property class as defined in O. Reg. 406/98, the actual amount due to the City of Ottawa shall be based on the last

assessment roll for the City of Ottawa as amended by the Municipal Property Assessment Corporation and the special charge rate for the year. 3. The Treasurer may mail, or cause to be mailed, to the owner of the property upon whom the special rate is imposed a special notice specifying the amount of the special rate payable by such owner. 4. The special rate hereby imposed shall be payable on or before the final tax due date for the year. 5. The special rate hereby imposed shall be collected in the same manner and with the same remedies as municipal taxes. 6. Any change in assessment or classification of a property during the taxation year may result in an adjustment to the tax levy of such property. ENACTED AND PASSED this 9 th day of May,.
