The Executive Committee, having regard to the legally set special noise regime during the night and early morning period (00:00 06.00 LT) Whereas (1 ) - EC Regulation 95/93, as amended Article 5(3) At the request of the coordinator, the coordination committee shall discuss suggested local guidelines for the allocation of slots as well as those suggested for the monitoring of the use of allocated slots. A report of the discussions in the coordination committee shall be submitted to the Member State concerned with an indication of the respective positions stated within the committee. 4
Whereas (2) - Decree Law 109/2008 Statutes of the National Coordination Committee Article 6 / Powers 1 The NCC shall be responsible for presenting proposals and providing official opinions to the national coordinating body, regarding: d) Local guidelines for the allocation of slots; 5
Whereas (3) Lisbon Airport frequently reaches the limit per week during the night period but at S14, since June, all the night slots available at Lisbon Airport were allocated. 6
Regular Procedures
Regular Procedures Slot monitoring is performed by the coordinator in cooperation with the airport authorities by comparing the most recent slot information with the actually operated block times of an airline in order to determine whether off slot operations have occurred. Furthermore it is established whether the deviations have happened repeatedly and intentionally, whether the actual times were significantly different from the allocated slot times and whether the deviations have caused prejudice to the airport operations. Special attention is focused on airlines that operated without a previous allocated slot. 8

Local Guideline Proposal - Lisbon One of the main issues of slot monitoring is caused by the legally set special noise regime during the night and early morning period (00:00 06.00 LT). Special Procedures: a) Whenever a night slot is involved, it is the airline's responsibility to monitor its off slot operations and to inform the coordinator. b) Within one working day after the off slot operation the involved airline must advise the coordinator about the reason(s) thereof. c) Upon receipt of this information the coordinator informs the concerned airline, within two working days, whether the off slot operation is to be regarded as 'beyond control' or if a C/R should be sent. d) If a night slot becomes available along the week the situation may be corrected. 10
Local Guideline Proposal - Lisbon e) If the airline involved fails to report the off slot operation within one working day to the coordinator it will be classified as an abuse. f) After four formally registered abuses in each IATA season, the involved airline will receive a warning from the coordinator confirming the four violations, requesting an explanation and corrective action to prevent future violations. The coordinator will also give the airline the opportunity to discuss the situation in a meeting. g) After the fifth violation without a valid reason the coordinator will inform both the airline and the Civil Aviation, INAC of the respective infraction. h) The NCC will be informed of the development of the situation throughout the process. 11
Local Guideline Proposal - Lisbon The following reasons can be considered as beyond control and unforeseen: 1. Aircraft operating humanitarian, emergency or evacuation mission; 2. Aircraft to come across with urgent situations, taking into account weather, technical failure or flight security reasons (such as medical, violence on board, technical); 3. Local ATC directives severely disturbing 'normal' operations; 4. Unforeseen ATC delays local and/or en-route (strikes, radar failures, political); 5. Limited runway use for exceptional reasons at foreign stations or at home stations major schedule change due to political reason; 6. Political instructions (for instance major events with possible effects on safety, Heads of State on board, military); 12
Local Guideline Proposal - Lisbon The following reasons can be considered as beyond control and unforeseen: 7. Air movements operated up to 01:00 LT which were actually scheduled for periods up to 00:00 LT, due to delays for which neither the airport management authority nor the operator were to blame; 8. Air movements from/to Autonomous Regions of Madeira and Azores, due to meteorological conditions; 9. Landings operated during the period comprised between 05:00 LT and 06:00 LT, due to weather reasons, as far as the arrival had been scheduled for a time after 06:00 LT. 13

Conclusion To be considered as a local rule, the proposal has to be approved by NCC and by INAC. Our goal is: - Optimization of the use of airport capacity; - Flexibility; - Harmonization with other European coordinators practices; - Total respect of the noise limits established by the law.
