He stated that the technical qualifications of the Commission and the staff are on file with the City of Frederick and are made a part of each and every case before the Commission. He also noted that the Frederick City Historic Preservation Commission uses the Guidelines adopted by the Mayor and Board of Aldermen and the Secretary of the Interior s Standards for Rehabilitation published by the U. S. Department of the Interior, National Park Service, and these Guidelines are made a part of each and every case. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. I. III. Approval of Minutes 1. May 12, 2016 Hearing/Workshop Minutes Motion: Scott Winnette moved to approve the May 12, 2016 hearing and workshop minutes as written. IV. HPC Business There was no HPC Business to discuss. V. Consent Items 2. HPC16-376 72 S. Market Street All Saints Mound Replace front stoop Richard Kline, agent Motion: Scott Winnette moved to approve the consent agenda which includes HPC16-376 at 72 S. Market Street. VI. Cases to be Heard 3. HPC16-297 137 E. 3 rd Street Jim Callear Install siding at storefront Lonnie Bane, agent Motion: Rebecca Cybularz moved to approve the application as submitted. 5. HPC16-213 526 N. Market Street John Kirby Pontiac Inc. Carl Clingan, agent Ms. Martinkosky entered the entire staff report into the record. Motion: Rebecca Cybularz moved to approve the modified design which was originally approved under HPC14-704 to reflect the main entrance recessed at 24 and the front glass panels divided into two panels as shown on Exhibit A. The new design is similar to the original appearance which has been identified through physical evidence and is in keeping with the remainder of the building. 6. HPC16-298 154 N. Market Street North Market, LLC Entry modifications Jim Mills, agent Ms. Martinkosky entered the entire staff report into the record. Motion: Dan Lawton moved to approve the application to remove the pipe railing on the existing ramp and replace it with new painted wrought iron railing, to remove the canvas awning and to install a new steel and glass canopy at that same entrance and to replace the existing lights of that entrance with new fixtures as specified in the application and to repair in-kind and replacing parts as necessary the two windows on the upper floor to the west of that entrance and removal of the two brick cheek walls and repair the basement access door and to remove the steel gates at the drive through area with the conditions that the photograph of existing conditions and a revised drawing is submitted for staff approval. Second: Michael Simons 7. HPC16-383 59 S. Carroll Street TGEC, LLC Construct roof on 3-story portion of building Jim Mills, agent Motion: Alan Miner moved to approve the installation of the gable roof on the main section of the building and approval of the center monitor and the approval of the concept of dormers for location of which to be approved by staff with the following conditions: The roof color of the matching the color of the existing roof; All trim should be painted wood; 3
The gutters and downspouts should be metal and round profile; The standing seam metal roof material be a traditional rolled ridge; The dormers are limited at this point in time to the east side only; The siding for dormers should be a flat seam panel with no ribs; and The windows should have a 5/8 inch simulated divided light with a dark spacer bar. 8. HPC16-386 232 E. 7 th Street Shawn Putnam William J. Holtzinger, agent Motion: Dan Lawton moved to approve the increased building height due to conditions that were encountered during construction and the approval on this case by case basis only a standing seam metal roof with 1 ¾ seams because deviation from the Guidelines on these two points will not be detrimental to the historic district or the character of the neighborhood. Motion: Rebecca Cybularz moved to approve the addition of wood railings to the front porch with the condition that they match Typical Wood Porch Railings Detail drawing previously approved in HPC14-66 for the rear porch and the metal railings are an option for the porch stairs subject to the approval of a detail to be submitted to staff for approval. Motion: Michael Simons moved to deny the request to install fiber cement siding and trim with a wood texture because page 142 of the Guidelines specifically says Siding with fake texture will not be approved. Vote: 7 0 VII. Citizen Comments Barry Weller, in reference to case HPC16-386 located at 232 E. 7 th Street, stated that he has never seen a bunch of bureaucrats give less importance to what is going on in the real world. He added that he would have thought that they would be there serving the City of Frederick and if you drive down that street that guy took a vacant building lot that sits across from one of the ugliest factories and invested his hard earned money and put his heart and soul into the building. He said that what they have is one more business man who will never do business in the Historic District. He stated that he is in real estate and if he could tell them how many clients he calls with projects and the first words out of their mouth are is it in the historic district and if he answers yes they say knock 25% off because that is what the additional 4
costs will be at a minimum. He added that this guy did something good for the City of Frederick and he could have built this house out in the county but he chose to go down there in a transitional neighborhood in an area that looks awful and built a gorgeous brand new house. He said that they exist to add value and help maintain this beautiful city the way it is but they don t exist to enforce rules that decrease the value in the City of Frederick. He stated that the decision that they just made could break a small builder and put a little guy out of business. The meeting was adjourned at approximately 8:00 PM.
