PMA Statements The technical implementation procedures (TIP) allow three statements on the FORM 8130-3 in the case of exported PMA parts: For a PMA part which is not a critical component, the following statement should be written in the remarks block of the FAA Form 8130-3: This PMA part is not a critical component. For a PMA part conforming to design data obtained under a licensing agreement from the TC or STC holder according to 14 CFR Part 21, the following statement should be written in the remarks block of the FAA Form 8130-3: Produced under licensing agreement from the holder of [INSERT TC or STC NUMBER]. If the PMA holder is also the holder of the EASA STC design approval which incorporates the PMA part into an EASA certified or validated product, the following statement should be written in the remarks block of the FAA Form 8130-3: Produced by the holder of the EASA STC number XXXXX. Multiple statements were not envisaged, but are acceptable if they provide at least one of the required information and do not contradict each other. Inacceptable Forms 8130-3, e.g. when none of the required statements is present, should be refused and the parts rejected. 23

In accordance with the BASA, EASA M.S. should accept a new part coming from USA if it meets cumulatively the following conditions: 1. It was manufactured under an U.S. production approval; 2. Conforms to an EASA approved design; 3. Is eligible for installation in a product or appliance which has been granted an EASA design approval; 4. It is accompanied by an FAA form 8130-3 authorized release certificate. All these conditions are reflected in MAG. In particular in the supplement example contained in the MAG, item 10 it is stated: New Components. i. New components should be traceable to the OEM as specified in the Type Certificate (TC) holder s Parts Catalogue and be in a satisfactory condition for installation. A release document issued by the OEM or Production Certificate (PC) holder should accompany the new component. ii. For U.S. OEMs and PC holders, release should be on the FAA Form 8130-3 as a new part. 30
This means that only FAA Form 8130-3 issued by U.S OEM s and PC holders are acceptable. There are two possibilities in relation to signature of those forms: 1. Designated Manufacturing Inspection Representative (DMIR) 2. Under the ODA System 31
1-Designated Manufacturing Inspection Representative (DMIR) A DMIR may, among others, do the following: Issue Export certificates of airworthiness and airworthiness approval tags in accordance with subpart L of FAR part 21; A DMIR must possess aeronautical knowledge and experience, be employed by a Production Approval Holder (PAH), or a PAH's approved supplier, and meet the qualification requirements of Order 8100.8. 32
2-Under the ODA System Organisation Designation Authorisation (ODA) is an authorisation by the FAA for an organisation, comprised of an ODA unit(s) using approved procedures, to make approvals on behalf of the FAA. An ODA unit is an identifiable unit of two or more individuals within an organisation that performs the delegated functions on behalf of the FAA. 33
The relevant types of ODA system could be but not limited to: Production Certification ODA (PC ODA). A production certificate (PC) ODA holder may issue airworthiness certificates and approvals, determine conformity, perform evaluation leading to amendment of its production limitation record, and approve minor changes to its quality control manual. To qualify for a PC ODA, an applicant must be an existing PC holder, or have applied for a TC and PC. Technical Standard Order Authorization Holder ODA (TSOA ODA). Holders of a technical standard order authorisation (TSOA) ODA may issue airworthiness approvals and determine conformity of articles, test articles and test set-ups in support of FAA managed TC or STC projects. Only existing technical standard order (TSO) authorization holders qualify for a TSOA ODA. 34

A DMIR may, within limits prescribed by, and under the general supervision of, the Administrator, do the following: Issue Original airworthiness certificates for aircraft and airworthiness approvals for engines, propellers, and product parts that conform to the approved design requirements and are in a condition for safe operation; Export certificates of airworthiness and airworthiness approval tags in accordance with subpart L of part 21 of this chapter; Experimental certificates for aircraft for which the manufacturer holds the type certificate and which have undergone changes to the type design requiring a flight test; and Special flight permits to export aircraft. Conduct any inspections that may be necessary to determine that Prototype products and related parts conform to design specifications; and Production products and related parts conform to the approved type design and are in condition for safe operation. Perform functions authorized by this section for the manufacturer, or the manufacturer's supplier, at any location authorized by the FAA. A DMIR must possess aeronautical knowledge and experience, be employed by a Production Approval Holder (PAH), or a PAH's approved supplier, and meet the qualification requirements of Order 8100.8. 36

There are two types of DARs, manufacturing and maintenance. Manufacturing DARs must possess aeronautical knowledge, experience, and meet the qualification requirements of Order 8100.8. Maintenance DARs must hold: a mechanic's certificate with an airframe and powerplant rating under 14 CFR part 65, Certification: Airmen Other Than Flight Crewmembers, or a repairman certificate and be employed at a repair station certificated under 14 CFR part 145, or an air carrier operating certificate holder with an FAA-approved continuous airworthiness program, and must meet the qualification requirements of Order 8100.8, Chapter 14. Specialized Experience Amateur-Built and Light-Sport Aircraft DARs Both Manufacturing DARs and Maintenance DARs may be authorized to perform airworthiness certification of light-sport aircraft.
