Air Navigation (Restrition of Flying) (TT Raes) Regulations 2017 Regulation 1 Statutory Doument No. 2017/0133 Air Navigation (Isle of Man) Order 2015 AIR NAVIGATION (RESTRICTION OF FLYING) (TT RACES) REGULATIONS 2017 Laid before Tynwald: 16 May 2017 Coming into Operation: 27 May 2017 The Department of Eonomi Development makes the following Regulations under Artile 92 of the Air Navigation (Isle of Man) Order 2015 1. 1 Title These Regulations are the Air Navigation (Restrition of Flying) (TT Raes) Regulations 2017. 2 Commenement, duration and interpretation (1) These Regulations ome into operation on 27 May 2017 and ease to have effet at the end of 10 June 2017. (2) In these Regulations the Coordinator means the Aviation Coordinator for the Isle of Man TT Raes appointed jointly by the Department of Health and Soial Care and the Department of Eonomi Development. 3 Restrition of Flying (1) Subjet to regulation 4, an airraft must not fly within the airspae speified in paragraph (2) exept () with the permission of the Isle of Man Civil Aviation Administration; and with the permission of and in aordane with any instrution given by the Coordinator; and in the ase of any part of that airspae whih falls within Isle of Man ontrolled airspae, with the permission of and in aordane with any instrution given by the Air Traffi Control Unit at the Isle of Man Airport. 1 SI 2015/870 as amended by SI 2016/155 SD 2017/0133 Page 1
Regulation 4 Air Navigation (Restrition of Flying) (TT Raes) Regulations 2017 (2) The airspae referred to in paragraph (1) is the airspae whih, when notified as being ative by a NOTAM, extends from the surfae to 3000 feet above mean sea level within (3) In this regulation the area bounded by the TT Rae Course; and an area 1000 metres wide outside and abutting on the TT Rae Course. CAA means the Civil Aviation Authority of the United Kingdom; Isle of Man ontrolled airspae means the airspae desribed as Isle of Man Control Zone (CTR) in setion EGNS AD 2.17 of the United Kingdom Aeronautial Information Publiation published by the CAA; NOTAM means a Notie to Airmen set out with the authority of the CAA in a doument published by or under an arrangement entered into with the CAA and entitled United Kingdom NOTAM or United Kingdom Aeronautial Information Publiation and for the time being in fore; and TT Rae Course means the road rae ourse illustrated in the Shedule. 4 Exeptions (1) Regulation 3 does not apply to any twin-engined heliopter whih is operated by Atlas Heliopters Limited and is being used for (i) (ii) the evauation in an emergeny of a sik or injured person from within an area speified in regulation 3(2); or the transfer of a sik or injured person from any plae in the Island to a hospital; and any heliopter operated by Arena Aviation Limited and is being used for aerial filming, subjet to the onditions speified in paragraph (2). (2) A heliopter referred to in paragraph (1) must be authorised to fly in aordane with a permission granted by the Department under rule 5(3), () or (e) in Shedule 1 to the Rules of the Air Regulations 2007 2 as they have effet in the Island 3 ; and omply with any instrution given by the Coordinator. 2 SI 2007/734 as amended by SI 2007/1371 3 SD 835/08 Page 2 SD 2017/0133
Air Navigation (Restrition of Flying) (TT Raes) Regulations 2017 Regulation 4 (3) Regulation 3 does not apply to any small unmanned surveillane airraft whih is operated by the holder of a permission issued by the Department in aordane with Artile 98(1) of the Air Navigation (Isle of Man) Order 2015 and whih is used in aordane with the terms of a Memorandum of Understanding between the operator and the Isle of Man Emergeny Servies; and omplies with any instrution given by the Coordinator. Explanatory Note Air Navigation (Restrition of Flying) (TT Raes) Regulations 2017 EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations restrit flying in the viinity of the Isle of Man TT road rae ourse so as to keep the airspae lear in ase of a possible need to evauate any sik or injured person by air. The restritions also prevent disruption to authorised heliopters undertaking aerial filming of the raes and prevent unauthorised aviation ativity (inluding the use of drones) from interfering with the raes diretly. Flying is temporarily restrited below a ertain height in the area speified in regulation 3(2) between 27 May 2017 and 10 June 2017 inlusive. The dates and times when flying is restrited will be promulgated in advane by a Notie to Airmen (NOTAM). Contravention of the restrition is an offene under the Air Navigation (Isle of Man) Order 2015 (SI 2015/870) and punishable on summary onvition by a fine not exeeding 2,500. Page 6 SD 2017/0133
