Hazard Removal and Mitigation The sponsor will take appropriate action to assure airspace required to protect instrument and visual operations to the airport will be adequately cleared and protected by removing, lowering, relocating, or lighting or otherwise mitigating existing hazards and preventing the establishment or creation of future airport hazards. 7460-1 is only a determination of impact.
Hazard Removal and Mitigation The Texas Airport Zoning Act, Chapter 241 of the Texas Local Government Code, enables a city, a county, or combinations of Cities/Counties to adopt, administer, and enforce airport zoning regulations. 250+ airports in Texas have some sore of height zoning surrounding their airport. Most adopted zoning was done in the 1970s and 1980s.

Economic Nondiscrimination Lease Agreements Agreement between Sponsor and Tenant May be Commercial or Non-Commercial leases The Leases must be consistent in the application and enforcement of the lease administration and policy Consistency is particularly important for operators of airports with commercial use agreements.

Economic Nondiscrimination Rules and Regulations Safe orderly operation of the airport applied to all persons using the airport for any reason Should be tailored for individual airports with public safety, preservation of facilities, and protection of the public in mind Examples: Aircraft Rules, Personal Conduct, Animals, Smoking, Waste Containers and Disposal, Storage, Pedestrians, Vehicle Ops, Fueling Safety, On-Airport Traffic Rules, Environmental Restrictions, Airport Residences, Hangar Construction, Fire Safety.
Economic Nondiscrimination Fee Schedule (Rates & Charges) Central to the preparation of all airport use agreements is the incorporation of rentals and fees for the use of airport property, equipment, facilities, services, and buildings There are no set guidelines or standards on what individual airport should charge tenants But, a common method of establishing rates and charges is by researching what other neighboring airports are charging for like services and facilities Example: Fort Worth has their Fee Schedule Published On-line
Hangar Use Policy Primary goal is to ensure aeronautical facilities, including hangars, are available to aeronautical users. Aeronautical facilities must be used or be available for aeronautical activities unless otherwise approved TxDOT/FAA Airport Sponsor may permit non-aeronautical items to be stored in hangars provided the hangar is used primarily for aeronautical purposes and the items do not interfere with the aeronautical use of the hangar
Hangar Use Policy (Cont) Hangars may not be used as a residence, with rare exception Also May not: Impede the movement of aircraft in & out of hangar Displace the aeronautical contents of the hangars Impede access to aircraft or other aeronautical contents of the hangar Conduct non-aeronautical business or allow nonaeronautical government agency function (storage)
