ALCOHOL CONSUMPTION IN PUBLIC PLACES Portfolio Ward(s) Affected: ITEM Community Town St Michael s Old Dean Heatherside Frimley Green Purpose To consider making an Order prohibiting the drinking of alcohol in certain public places within the Borough. Background. The Licensing Committee, at it meeting on th February 00, resolved, pursuant to Section () of the Criminal Justice Act 00, that the areas and roads on Heatherside, Old Dean, St Michael s and Town Wards be designated as public areas in which the drinking of alcohol is not permitted (minute 0/L refers). The Committee also in relation to the designation of the Frimley Green Recreation Ground and other public parks and recreation grounds as areas where the drinking of alcohol is not permitted decided to seek the views of the Executive before taking a decision on this matter. Current Position. On th February 00, the Executive considered the implications of including a Recreation Ground in the Order and agreed to include Frimley Green Recreation Ground, with a review after a year. The Committee is advised to designate the areas and roads identified in the plans, attached at Annex A, including Frimley Green Recreation Ground, as public areas in which the drinking of alcohol is not permitted pursuant to Section () of the Criminal Justice and Police Act 00. The Council, at its meeting on th February 00, approved a supplementary estimate of 00, to cover the shortfall in the budget allocation for increased advertising costs of the additional area. The bye-law prohibiting the consumption of alcohol in Camberley Town Centre will be revoked if the order is made. It is proposed that the impact of the order be monitored, particularly in respect of Frimley Green Recreation Ground and that, other than under exceptional circumstances, no further areas be considered for designation until the review has been completed and the impact on the designated areas fully discussed. For ease of reference, the relevant Executive minute (/E) is attached at Annex B and the Schedule of Designated Public Places is attached at Annex C.. On th March 00, an advertisement was published in the Camberley News inviting representations from the public in respect of the proposal to prohibit drinking of alcohol in part of Frimley Green Recreation Ground (excluding the land leased by the AGENDA\LICENSING\FEB0
Frimley Green Football and Social Club). The Council may not make an order until after days from publication of the advertisement. To date no views have been received, however an oral update will be given at the meeting.. Once the Order is made, the Council must place a further advertisement specifying the places that have been identified in the order, explaining its effect and indicating when it shall become effective.. Before the Order becomes effective, the Council must also erect, in the places identified, signs to draw the attention of members of the public in that place to the effect of the order.. A copy of the Order will also be sent to the Secretary of State Proposal. The Committee is asked to consider the views of the Executive and to resolve accordingly. Recommendation. The Committee is advised to RESOLVE that, a) part of the Frimley Green Recreation Ground, excluding the land leased by the Frimley Green Football and Social Club, as identified on the attached plan, be designated as a public area in which the drinking of alcohol is not permitted pursuant to Section () of the Criminal Justice and Police Act 00; b) the Borough Secretary and Solicitor be authorised, following the expiry of the consultation period, and after considering any representations received in respect of Frimley Green Recreation Ground, to make an order under Section () of the Criminal Justice and Police Act 00 designating as public places areas and roads within Heatherside, Old Dean, St Michael s, Town Centre and Frimley Green Wards in which alcohol consumption is prohibited; c) the bye-law prohibiting the consumption of alcohol in Camberley Town Centre be revoked, once the Order is made; and d) the impact of the Order be monitored over a one year period, and be reported to the Licensing Committee in April 00. ANNEX B ANNEX B /E ALCOHOL CONSUMPTION IN PUBLIC PLACES This report was considered as a matter of urgency under Chapter., paragraph. of the Constitution by reason of the problems associated with drinking in a number of public places and the need to regulate such problems without delay. The Licensing Committee, when considering the making of an Order to prohibit consumption of alcohol in certain identified areas in the Borough, had noted Police records which indicated that there had been nine alcohol related incidents in the Frimley Green Recreation Ground in the previous year. As a result, the Committee had asked that the Executive consider the implications of including the Recreational Ground in the Order prohibiting the consumption of alcohol in public places. The Executive recognised the specific issues in respect of the Frimley Green Recreation Ground and emphasised the need to monitor the sites included in the proposed order, including the impact on neighbouring wards. RESOLVED, That, (i) the Licensing Committee be advised that: (a) (b) (c) (d) (e) subject to the approval of the recommendations below, the areas and roads identified in the report, including the Frimley Green Recreation Ground, be designated as public areas in which the drinking of alcohol is not permitted pursuant to Section () of the Criminal Justice and Police Act 00; a supplementary estimate of 00 be recommended, to cover the shortfall in the budget allocation for increased advertising costs; the bye-law prohibiting the consumption of alcohol in Camberley Town Centre be revoked, once the Order is made; the impact of the Order is monitored and in particular the impact on the Frimley Green Recreational Ground; and other than under exceptional circumstances, no further areas should be so designated until the review has been completed and the impact on the designated areas fully assessed.
