Amaxi Regional Center Amaxi Regional center facilitates investment in job-creating economic development projects by pooling capital raised under the EB-5 immigrant investor program. About EB-5 EB-5 is a United States immigration program that offers citizens of other countries the opportunity to seek permanent U.S. residency through job creation in the U.S. The EB-5 Regional Center Program began in the early 1990 s to spur economic growth by giving immigrants a way to obtain permanent U.S. residency through job creation. Administered by the United States Citizenship and Immigration Services (USCIS), the EB-5 program directs foreign investment into projects that revitalize local economies. Investors whose money creates at least 10 full-time jobs for U.S. workers become eligible for a U.S. green card. Regional Centers, designated by the U.S. government, promote job creation in a defined geographic area. Regional center An EB-5 Regional Center is an organization, designated and regulated by USCIS, which facilitates investment in job-creating economic development projects by pooling capital raised under the EB-5 immigrant investor program. Regional centers can be publicly owned, (e.g. by a city, state, or regional economic development agency), privately owned, or be a public-private partnership. Step One: Filing of Eligibility Petition Individuals first file an I-526 petition with USCIS to determine their eligibility to participate in a visa category. 1. The I-526 petition must include information on the lawful source and path of funds to be invested, along with information documenting how the funds will be invested to create jobs. This is more detailed information than is required for petitioners under other visa categories. 2. For EB-5 approval of an eligibility petition does not constitute approval of a visa on the petitioner. 3. USCIS has well-established procedures and criteria to request expedited review. This does not mean expedited approval. Step Two: Determining Admissibility and Granting of Visas Once eligibility is approved, the next few steps are the same as EB-5 applicants; similar to applicants under any other visa category. 3

1. Depending if they already reside in the U.S. or not; Immigrants must file either a visa application with the State Department, or an adjustment of status application with USCIS. 2. Approved petitions with immigrants residing outside the U.S. are sent by the U.S.C.I.S. to the National Visa Center and the State Department s clearinghouse. 3. The N.V.C. then requests supporting documentation from the visa applicants before sending the completed file to the appropriate U.S. Embassy or Consulate. 4. Consular affairs officers will then determine if the individual is admissible to the United States and whether or not a visa will be granted. This is based on in person interviews, a review of the entire application, petition files, background checks and national security screenings in conjunction with federal intelligence and national security agencies. 5. Applications for adjustment of status are sent to USCIS for review which includes background checks and may also include an interview. USCIS can conduct its own independent investigation by internet databases and assistance from the State Department for in-country investigations. 6. Visa investigations processing can take months or years. If the EB-5 applicant is found to be admissible to the United States, a conditional visa is granted allowing the applicant to reside in the United States for two years. Before the end of the two-year period, the immigrant must file an I-829 petition documenting proof that their investment has created a minimum of 10 U.S. jobs. If USCIS confirms job creation, the petition may be approved, lifting conditions on the visa. If USCIS finds the applicant inadmissible, removal proceedings can be initiated against the investor and his or her family members. 4

Elderly Care Centers According to the United States Department of Health and Human Services the senior population numbered 39.6 million in 2009.They represented 12.9% of the U.S. population, about one in every eight Americans. Who may apply for EB-5? Any person who can demonstrate the ability to: 1) deploy the required amount into the American economy, 2) document that the capital was legally earned, and 3) satisfy general eligibility requirements (e.g., medical, criminal) is qualified to apply for the EB-5 program. There are no language, business, or education requirements for applicants. What is an EB-5 regional center? An EB-5 regional center is an organization, designated and regulated by USCIS, which facilitates investment in job-creating economic development projects by pooling capital raised under the EB-5 immigrant investor program. Regional centers can be publicly owned, (e.g. by a city, state, or regional economic development agency), privately owned, or be a public-private partnership. What is a targeted employment area? A targeted employment area is a rural area or a geographical area that has experienced unemployment at a rate of at least 150% of the national average rate. Individual states are authorized to designate geographical areas within the state that qualify as targeted employment areas. Each EB-5 investor must create 10 direct or indirect permanent jobs for U.S. workers in order to obtain a Green Card. Can money gifted by a parent or other relative be used for and EB-5 investment? 19

Yes. It must be demonstrated that the gift is an actual transaction and is not an undocumented loan or that the gifted funds are expected to be given back after permanent resident status is granted. Is the investor free to travel after obtaining conditional resident status? The green card holder is free to travel in and out of the United States subject to the rules generally applicable to permanent residents. Specifically, he or she must maintain a residence in the United States and must not be outside the United States for a continuous period of one year or more, unless he or she has obtained a reentry permit. What is the difference between conditional and unconditional green cards? Under USCIS regulations, an investor who files an I-526 petition with the USCIS and is approved for the EB-5 immigrant visa receives a conditional green card. A conditional Green Card is a temporary Green Card valid for two years. EB-5 program participants must file the I-829 petition with the USCIS starting 90 days before the end of the two year conditional permanent status period to remove the condition. The applicant s conditional residency will be extended while the I-829 is processed. Once the I-829 is approved, the conditional residency restriction is removed so that the immigrant, their spouse and their unmarried children under the age of 21 can live in the United States permanently. Otherwise, both the temporary and permanent green cards offer the same rights and privileges. Maintaining eligibility until an immigrant visa becomes available is problematic for children-derivatives approaching the age of 21 because ineligibility is established on the 21st birthday. CSPA provides relief for children who would have maintained eligibility but for the time USCIS took to adjudicate the immigrant visa petition. This relief takes the form of subtracting the time the petition was pending from the child s age; this is the child s CSPA age. Provided that the child s CSPA age is under 21 at the time the immigrant visa is issued to the principal, the child will not be ineligible to receive a visa based on age, even if the child s real age has reached 21. CSPA also provides relief in the event of retrogression but not in the case of a significant backlog: if the child s CSPA age is under 21 at the time the priority date becomes current, and the child takes a step toward pursuing that immigrant visa within one year of becoming current, such as filing an I-485, then the child s age is locked-in, and he or she will be protected from aging-out. Child derivatives who are most vulnerable are those who are near the age of 21 at the time of the I-526 filing and whose CSPA age may reach 21 before the priority date becomes current.
