CONTEXT Located in the south-east of France and bordering the Mediterranean Sea, the Département des Alpes-Maritimes, owns worldwide famous tourist treasures. Steep landscapes nearby the coast offer gorgeous panoramas where Belle Époque palaces and luxuriant gardens stand with pride. Appreciated for its mild climate and famous for its coast line and lifestyle, the Côte d'azur welcomes more than 11 million tourists a year. It is also the chosen land for flowers, scents and the art of gardens, along with: 80 gardens including 13 magnificent gardens under the "Jardin Remarquable" label; a world-famous know-how on perfume flowers; many landscape companies. Whether they are a living testimony of a luxuriant past or designed by contemporary creators, the gardens of the Côte d'azur offer exquisite views and delighting pieces of heaven for visitors and tourists. Discovering this magnificent heritage is like immersing in the History of the département des Alpes- Maritimes which appealed the big bourgeoisie and the aristocracy of all Europe, during the second half of the 19 th Century. The gardens created at that time enabled worldwide originated rare species to acclimatise and disseminate. Ornamental and spectacular gardens with lush plants have emerged on the Côte d'azur. The département des Alpes-Maritimes managed to preserve a natural heritage of exceptional richness and diversity. In order to highlight it, the Département des Alpes-Maritimes decided to set up an event dedicated to the gardens of the Côte d'azur. Thus, in April 2017, during a full month, was held the first Côte d'azur Gardens Festival, intended for the general public and turned into success by its media impact: - 150 journalists were welcomed as well as thirty international media (Italy, Great Britain, Germany, Belgium, Sweden, China...); - More than 5,000 postings on Twitter, Facebook and Instagram; - 220 press releases were published at local, national and European level. Building on this success, the Côte d Azur Gardens Festival will be held for a second edition: from 30 th of March 2019 till 28 th of April 2019. Within this event, the Département des Alpes-Maritimes will set up a pop-up ephemeral landscape creation contest along with various events throughout the Alpes-Maritimes. ****** Côte d Azur Gardens Festival 2019 Landscape Creation Contest Updated on April 16th 2018 Page 2 sur 15

Section 1 - Aim of the contest The contest is launched by the Département des Alpes-Maritimes as part of the "Côte d'azur Gardens Festival". Managed by the Service Europe et Tourisme with the partnership of the municipalities hosting the creations, it aims to reward through a jury selection, a 200 m2 landscape creation in connection with the Festival theme. For this 2nd edition, the creations made by local, national and international teams will be spread among 5 municipalities within the département with day free public access, throughout the Festival duration. Each municipality will host 3 pop-up ephemeral gardens, for a total of 15 creations from the 30 th of March till the 30 th of April 2019 (including dismantling). Section 2 - Theme For the second edition of the Festival the chosen theme is: Mediterranean dreams The 2nd edition is an invitation to travel around the Mediterranean, in the world of gardens: Gardens of Provence, Andalusian gardens, Italian gardens reflecting the magic of the Renaissance, gardens reminiscent of ancient Greece, gardens of Maghreb and green oasis... The creations will reflect the richness and diversity of these Mediterranean territories. It is a welcome to a world of dreams where visitors are free to wander, relax and enjoy the blessing of Nature on the discovery of the coast along the Big Blue. Section 3 - Competitors The contest is open only to professionals: - Landscape architects, landscapers, landscaping companies and landscape gardeners; - Architects, designers, artists, developers, scenographers, decorators... provided that they are backed by a landscape company for the realisation of the garden. Each team will be autonomous, from the conception to the realisation of the creations (assembly / dismantling). It will appoint a project leader who will be the referent contact person with the Conseil Départemental. Teams may be multidisciplinary according to the needs of the project. The Technical Manager appointed by the Conseil Départemental will be the main contact with the team for the creations setting up. The open air land plots where the creations will be installed are subject to bad weather conditions (rain, wind, etc.). The competitor will keep it in mind when selecting materials and supplies in order to plan ahead any possible damages. Each 200m2 plot will be located on existing surfaces and may be slightly sloping. Each plot will have water access and power supply. Water tapping and electricity plugging will be at the hosting municipality s expense as well as the consumption (220V connection, 3m 3 /h of water supply, subject to potential exceptional water shortage situation). In order to reduce environmental impact, a special involvement in power and water savings is expected from the competitor. Ground protection: the plots provided will be laid out and open to the public. The competitor will provide appropriate precautions and protections. Any damage by the competitor during assembly and dismantling will be supported by him. A plot will be allocated to each competitor agreed by the Technical Selection Committee at the end of the first selection phase, ensuring that each project matches with a plot. 5.2 - Public access and specific requirements: The "Côte d'azur Gardens Festival" plans to welcome around 500,000 visitors within the festival period. Landscaping creations will be located in significant flow areas. It will thus be necessary to: - provide at least one entry and one exit in the garden and sufficient circulation space (clearance) for the public, including groups of visitors and school groups; - provide easy wheelchairs access for disabled visitors; - avoid dangers (such as risks of falling, cutting, poisoning, etc.); - consider the durability of the garden, as its appearance must be preserved since the first to the last day of the Festival with easy maintenance. The maintenance will be provided by the hosting municipalities green spaces and gardens department (refer to section 8.5). The competitor will ensure that the garden is realised under conditions limiting theft and vandalism. Depending on the sites, security arrangements will rely on the municipality s services or external providers. 5.3 - The Conseil Départemental s expectations: The Conseil Départemental is expecting innovating, colourful creations in places of cultural heritage throughout the département to be showed to the visitors who will absorb the atmosphere of the Mediterranean countries, between sky, earth and sea and succumb to enchantment during their visit. The creations will invite visitors to travel around the Mediterranean, Provence, Greece, Morocco, Spain, Italy, etc. The creations will reveal a studied layout, a quality finish and will match with sustainable development (environment friendly materials, ashes, wood, recycled materials, water management, ecoresponsible behaviours, no use of chemicals, etc.). The competitor will submit an appealing and spectacular garden, in particular in its volumes, its colours and the variety of the species used. Concerning the plants, they will be sufficiently grown at the Festival opening time and will last until the closing of the event. Section 6 - Application conditions The official language of the contest and the Côte d'azur Gardens Festival is French, however any application formulated in English will be accepted. At the reception of the present specification, the competitor wishing to enter the contest will have to send by return of email or by registered mail all the documents requested hereafter: no later than the 28 th of September 2018, 12 AM 1. Supporting documents: Competitor s full details (project leader) representing the whole team, who will be the referent for the Département, and will collect the Département s allowance; The presentation and the CV of the team members who will realise the creation; The administrative data form in accordance with the model (Annex 1); A book of the last 3 years achievements to appreciate the previously created gardens quality of design and realisation; The competitor s (project leader) Kbis extract and if the project is submitted by a group in cooperative form, the statutes of the co-operative; Competitor s bank account statement (project leader). 2. Project presentation file : The project summary sheet (annex 2); An explanatory note presenting the designed landscaping contest project and pointing out the attractive and spectacular appearance of the garden, the originality, the adequacy with the theme, the environmental impact and the compliance with safety rules, as well as the elements considered useful to value it : sketches, list of materials, photomontages, model A list of the plants to be used; A list of expected partners and suppliers; A projected ground plan in colour (scale 1/50 ) indicating the planting plan, the foreseen materials, the accesses (entrance / exit), the visitors flow within the garden; A significant sectional view (scale 1/50 ); A provisional budget by object of expenditure (accommodation, labour, equipment rental, supplies...). The file in A3 format must be sent electronically to the following addresses: - concoursfestivaljardins06@departement06.fr - atelier@ladanum.fr (Contest Technical Manager : Nikola WATTE) and also by registered post with recorded delivery or delivered by hand against receipt to the following address: Département des Alpes-Maritimes Direction de l Attractivité Territoriale - Service Europe et Tourisme Flora Hugues - bureau 625-6 ème étage - bâtiment Mounier Centre Administratif Départemental des Alpes Maritimes (CADAM) 147 boulevard du Mercantour - BP 3007-06201 NICE CEDEX 3 Section 7 - Selection of the competitors The competitors will be selected by the Technical Selection Committee which will comprise representatives of landscape architects, professional associations of the French Landscape Federation (FFP Fédération Française du Paysage), Landscape Companies National Union (UNEP Union Nationale des Entreprises du Paysage), hosting municipalities and the Département. The Technical Selection Committee will validate the projects from a technical point of view and will ensure compliance with the present specifications and the theme of the year Mediterranean dreams (see detail in Section 2). He ensures the quality and the reliability of the selected projects. To select the agreed competitors, the Technical Selection Committee will meet twice: - Beginning of October 2018 to select the 15 agreed projects and 4 replacement projects, and to allocate the plots; - Beginning of November 2018 to validate the final selected projects. The Département reserves the right to modify, if necessary, the projects selection dates. For the first projects selection phase, the Technical Selection Committee will take into account the appealing and spectacular appearance of the garden, the originality, the adequacy with the theme of the year Mediterranean dreams, the variety of plants, the environmental impact (recycled materials, supplies and plants reuse etc.), compliance with the safety and accessibility rules, the forming and multidisciplinary nature of the teams (human and material resources), the technical skills of each team, and the expected partners / suppliers. The selection and the highlighting of plants adapted to the Mediterranean climate will be taken into account by the Technical Selection Committee during the study of the projects. The decision will be sent by email to all competitors whether they are selected or not. At the end of the first selection phase, technical specifications related to the allocated plot by the Technical Selection Committee will be sent to the 15 preselected competitors. Between the two selection phases, it is highly advised to go on site to appreciate all the technical and aesthetic characteristics of the allocated plot. In case of remote location a photographic report will be available on simple request from the Département. The competitor must in all cases make every effort to comply with the characteristics of the plot, the requirements and the public safety. For the second selection phase, the 15 pre-selected competitors will have to return a completed project related to the allocated plot including the following documents, No later than the 14th of november 2018, 12 AM (subject to change) Related to the supporting documents: A certificate confirming the set up partnerships for the realisation of the garden; Copies of the third-party liability insurance certificates for all of the team members; The detailed and updated estimated budget if necessary; Certificates to ensure that the competitor (project leader) as well as the other members of the company (or companies) forming the team have their tax and social obligations in order. Related to the project: A projected ground plan (scale 1/50 ) adapted to the allocated plot after the first selection phase; A planting plan (scale 1/50 ) with the list of plants used; The summary form for the presentation of the project (Annex 2) completed according to the allocated plot to be used for the communication documents; A provisional planning of intervention; A notice ensuring the stability and security of the project (supervising office if necessary, at the competitor's expense). The 15 selected competitors (one person per team who will preferably be the project leader mentioned in the project file) will be invited during an immersion day in January 2019 to discover the plots on site, meet the Technical Manager and other competitors. The Département will organise the conduct of this day and the costs will be borne by the organiser (meals and transportation on sites within the département des Alpes- Maritimes). Travel expenses to attend this day will be borne by the competitor. No compensation can be requested by the competitor. The attendance of the competitor on this day is welcome but not compulsory. Section 8 - The obligations of the competitor 8.1 - Attendance The competitor or a team member must be attending: - Before the assembly, the meeting with the Technical Manager and the viewing of the plots; - During the entire assembly and dismantling duration; - The opening weekend. The juries approximate time tour will be known on short notice. He will have to explain and introduce his creation to the three juries during their tour; - The winner of the Jury Award must be available at least a couple of days during, or, at the end of the Festival, and upon the Département s request, for possible interviews and the launch of the next edition. His travel expenses will be supported by the Département; - The award ceremony on Sunday 31/03/2019 by the President of the Département; - The competitor and his team will attend at least 10 days on site in 2019. 8.2 - Safety The competitor and his team must comply with all safety rules including the wearing of personal protective equipment when required. They must also comply with all regulations in force. 8.3 - Insurances All team members must be covered by third-party liability insurance. Copies of the certificates must be provided to the Département together with the project file. 8.4 - Assembly / dismantling Before the assembly, the Technical Manager chosen by the Département, will meet the successful competitors for a presentation day of their creation site and will make the technical recommendations to them. He will provide them with a statement on the technical characteristics of the site. Assembly dates: Dismantling dates: from the 25 th till 29 th March 2019 included. from the 29 th till 30 th April 2019 included. All equipment and supplies will be supported by the competitor as well as carriage on site, unloading and storage. According to their availability, the municipalities will be able to make available free and temporarily specific equipment. The competitors will preserve existing roads, edges, masonry and coverings. An accurate assembly / dismantling intervention schedule will be validated with the Festival's Technical Manager. The competitor agrees to comply with the safety rules for public places. During the 5 assembly days, the Technical Manager will monitor the installation of the gardens to ensure the successful completion of the construction and can intervene if necessary in case of problems. He will supervise competitors technical issues related to sites and equipment. Once the realisations are completed, the Technical Manager will check the installation sites before the launch of the event. He will control the quality of the creative work done in connection with the competitors projects. At the end of the Festival, the Technical Manager will intervene during the two days of the gardens dismantling to ensure successful process completion. During the entire assembly and dismantling, the competitor must comply with the technical guidelines and potential requests for changes from the Technical Manager or the Head of the Service des Espaces Verts et jardins (Green Spaces and Gardens Department) of the hosting municipality. 8.5 - Garden maintenance The competitor must attend the first Festival weekend on the 30 th and 31 st of March 2019 and will be in charge of maintaining his creation. For the remaining period, the maintenance of the gardens is provided by the municipal teams according to the specifications produced by the competitor. These creation maintenance specifications will be agreed with the hosting municipality before the opening of the Festival. Except with prior agreement between the parties, specific equipment maintenance, particularly computer, scenographic, electrical, lighting, audiovisual, audio, etc., will be excluded. Automatic watering, whatever the project, will be adjusted to the garden need. The device will be easy to be used and to monitor by the communal teams. Section 9 - Juries 9.1 - Composition The official jury will be chaired by a media personality, Festival Godmother or Godfather and composed of departmental representatives, and representatives of the Mediterranean dreams theme. The press jury will be composed of journalists from the general and specialised press, national and international. The professional jury will be composed of landscape sector representatives (UNEP- Union nationale des enterprises du paysage, FFP Féderation française du paysage, VALHOR). The composition of the Juries as well as the name of the godmother or godfather will be announced during the press conference with the Comité Régional du Tourisme Côte d'azur France (Regional Tourism Committee) scheduled for November 2018. During the Festival opening weekend, on the 30 th and 31 st of March 2019, juries will walk around all the gardens and will meet in private to choose the winner. The name of the official jury award winner will be known after deliberation of the Jury on the 31 st of March 2019. The Department reserves the right to change the announcement date of the winner. 9.2 - Selection The official jury does not assign marks; he chooses his award winner according to his feelings and after deliberation classifies the creations. He takes into account the following elements: - General atmosphere, aesthetics, creativity, originality; - Relevance with the Mediterranean dreams theme; - Educational contribution of the project towards the visitors and technicality. The Jury assumes the part of subjectivity of his choice. No deliberations will be reported, competitors will agree with the deliberate, as it is. 9.3 - Awards Within this contest three prizes will be awarded: - the official jury award; - the press award; - the landscape professionals award. The Jury award winner will be offered 10,000 by the Département des Alpes-Maritimes and will be part of a specific public announcement at the award ceremony. Gifts will also be offered by Festival partners. All the teams also compete for the professionals and press awards. A public award may also be considered. There is no financial endowment for these honorary awards. However, gifts provided by the Festival partners can be given (stays, perfume boxes, etc.). Section 10 - Communication The Département and its partners, at the forefront of which the Comité Régional du Tourisme Côte d Azur France, will make every effort to ensure the Festival promotion: press contacts, digital campaign, social networks, posters, press conferences, press releases, national and international media plan, and information on the Festival website: 10.1 - Festival logo and visuals https://festivaldesjardins.departement06.fr The Festival logo and visuals will be sent to the selected competitors. They are the property of the Département and must be used without modification and with prior authorisation, as long as the competitor makes mention of the Festival regardless of the communication network. 10.2 - Competitors partners The competitors partners (suppliers of the sector or others) will not be able to claim a visibility of their mark on the Festival communication tools for the realisation of the gardens. 10.3 - Signage No advertising signage will be allowed in the gardens. Any competitor wishing to promote his company and partners during the Festival period may do so exclusively during: - the presentation of his creation on the information panel located near the plot; - the presentation of his creation on the Festival website which will be dedicated to him; - the presentation of his creation in the Festival press release and in the booklet dedicated to the Côte d'azur Gardens Festival which will be distributed among the tourist offices of the département and all partners. Section 11 - Competitor s compensation Each selected competitor will receive a compensation by the Département up to a maximum of 16,000 upon presenting a proof of the amounts actually paid (staff costs, running costs, equipment costs, supplies, travel expenses, etc.). More than 60% of the expenses will have to be devoted to the garden (plants, materials...). Only competitors selected at the end of the 2nd selection phase will be eligible for this compensation. Compensation will be subject to an agreement with each competitor (project leader) approved by the Département's Standing Committee (Commission Permanente) during the last quarter of 2018. The payment of this compensation will be made as follows: - a fixed advance of 10,000 including the design phase of the garden, will be paid upon written request and once the agreement binding the Département and the competitor is notified; - the balance, maximum of 6,000 TTC (Toute Taxe Comprise - including VAT), on presentation of an expenses summary table in Euros certified and signed by the competitor, accompanied of the corresponding invoices; - The conditions will be specified in the relevant agreement. The compensation may cover different types of expenses however accommodation, catering and transport costs as well as labour costs will be capped at 40% of the entire compensation. The Département may request the advance repayment in case of incompetence of the competitor and any amount collected under false declarations. Section 12 - Competitor s Accomodation The Département will not be able to provide competitors with accommodation during the contest. However, the creations hosting municipalities will provide, through the tourist offices, a list of accommodation (hotels, lodges, campsites, tourist residences, holiday resorts, etc.) at competitive prices to accommodate the competing teams during their stay on the site (landscape creations assembly and dismantling and Festival launch weekend). Section 13 - Competitor s incompetence The Department may exclude from the contest, without any compensation, the competitor: - who does not turn up on the first assembly day, on the 25 th of March 2019; - whose creation is not completed at the Festival opening date, on the 30 th of March 2019; - whose creation does not comply with the Technical Selection Committee approved project. For all of these cases, the competitor will be declared to be in default and will have to repay the compensation advance if it has been received. Section 14 - Intellectual property All competitors and all members of their team assign, for free and without duration, their entire image rights, on any media, to the Département and to the partners of the event within the Festival promotion framework, in France and abroad. The project remains the competitor s intellectual property as defined by Article L.111-1 of the French Intellectual Property Code. The competitor s name will therefore automatically be mentioned by the Département for any operating form of the landscaping created and developed by the competitor within the Festival course. Nevertheless, for the present and future Festival promotion requirements, the competitor grants to the Département and the CRT Côte d'azur France, as well as to any person designated by the Département, the right of representation of his creation at national and international level. Section 15 - Cancelling of the Côte d Azur Gardens Festival The Département reserves the right to cancel the Festival at any time, in case of force majeure, risk of unusual weather conditions, and any economic, political or social situation making safety of equipment and people impossible to ensure during the event. In this case, the competitor will not be able to claim from the Département due amounts. For any claim, the dispute will be brought before the Administrative Court of Nice (06). Section 16 - Data protection It is reminded that to participate in this contest, participants must necessarily provide some personal information about them (first name, last name, email address, phone number...). This information is recorded and saved in a computer file and is necessary to take into account their participation and the selection of winners for the prize award. This information is intended for the Organiser, in this case the Direction de l Attractivité Territoriale - Service Europe et Tourisme and the Direction de la Communication of the Conseil Départemental des Alpes-Maritimes. In application of the law n 78-17 of January 6th, 1978 relating to data processing, files and freedom, the participants have the right of access, rectification and suppression of the data concerning them.
