DEL MAR, CA. 92014 JULY 26, 2016 Matt Bator Senior Planner for the City of Del Mar (858) 755-9313, Ext. 1158 mbator@delmar.ca.us Dear Mr. Bator, I am writing you to summarize the history of the ongoing chimney issues relating to my neighbor, Mr. Tom Blakely. On March 4, 2014, Mr. Blakely voiced objections that our original chimney design on the south side of the second story roof infringed on his PRIMARY view corridor. He asked Jim Sneed to relocate the chimney to the North side so it would fall in the shadow of the distant tree. At this time, Mr. Blakely also requested that we make the west roof a hip instead of a gable so that it slopes away and out of his view. Both of his requests were accommodated so as not to disturb view corridors. On April 21, 2014, Mr. Blakely gave Jim Sneed along with Bob Scott his verbal support of these changes. On April 22, 2014, the Blakely s initialed the revised plans showing the chimney now sitting in the shadow of the tree and the roof line shorter than the previous house. On Aug, 1, 2015, Mr. Blakely came down to my property to complain to the building superintendent, Bud Huntzinger, about the proposed fireplace before the second story was even framed. He continued complaining about the fireplace prior to its framing for the next few months according to the contractors on the jobsite, showing his intent to fight the fireplace even after signing his approval.

We met with Mr. Blakely again on Feb. 18, 2016 and Mar 2, 2016 about the upstairs fireplace. We explained to him at that time that we changed the original field stone shown on the plans to a rounder river rock, which would be more bulbous and wider, but will not disturb his view as it will still be within the shadow of the tree. Mr. Blakely gave my contractor, Bob Dana, a pat on the back saying that everything looked good. At that time, we agreed with Mr. Blakely that we would keep the stone at a certain height to allow for a copper shroud to be placed on top. (This is the exact thing Blakely agreed and approved in his July 5, 2016 email to you). The current story pole that is sitting atop the fireplace is showing our desire to increase the flue height, so as not to go through the added expense of a blower assembly. Finish with a copper wrap as proposed by Dana to complete the chimney. Chimney on lower roof would have a flat approx 5 spark arrestor placed on existing structure and also wrapped in copper as agreed. This will bring the structure closer to the original drawing approved by us and the town. I appreciate your assistance. When this was brought to the attention of the builder and owner numerous times during the various stages of construction they were dismissed until Matt Bator, Sr. Planner got involved. The 2 nd Story chimney which is 60% wider and 50% taller than the permitted one is in the primary view of the neighbor at 1109 Luneta Dr. significantly adding Bulk and Mass. The owner can still have a gas only fireplace using the permitted chimneys that were agreed to by all concerned parties before and during the permit process. The following Neighbors are not in favor of allowing the significant modifications to the original permit that was approved for the chimney(s). We want the DRB to deny the applicant request, and protect the integrity of the permit process. Rewarding someone for deliberately ignoring the process begs the question do we really have one.

However, so far as I can see past the bushes which he refuses to cut, the project still encroaches on the view from my Living Room. The bushes I suppose are intended to hide the flags and poles. One can only see what is intended by walking up the driveway to see from an angle the flags and poles that are behind the bushes. The project is still very large (6,000 sq ft). I am writing in response to a letter received from the Herricks regarding the proposed house at 2004 Ocean Front. The Herricks were concerned about the affect of the house on their views to the west from their master bedroom and roof deck. I spoke to Mr. Herrick regarding the house and explained that the location of the house on the lot is extremely limited due to the lot's substandard size and setbacks. I also explained that lowering the house would not improve their views, since it is the location of the house that is affecting them. Perhaps most importantly, the views discussed are not from their primary living area/primary view, and as such are not protected under the DRO. While our preference would be to accommodate everyone's concerns, in this case, we really don't have a viable alternative to the location of the second floor. I will be stopping by the Herrick's house on Monday to discuss the matter in person and see the views from their master bedroom and roof deck. Based on my understanding of the configuration of their house, I do not think any adjustments to the proposed design would be particularly helpful to them or necessary based on the DRO regarding primary scenic views. Based on input from the Planning Commission, and the neighbors, we have tried very hard to minimize the second floor area, and have made specific adjustments to improve the views from the Duckett's house to the east (where the proposed house can see the house from a primary scenic view). We have also taken great care to carve away the corners of the second floor to maximize diagonal views across the site. Unfortunately, we do not have any options that can solve all the issues while still allowing the owners to create a home of appropriate scale and equal quality to the other houses in the neighborhood. I will follow up again next week, should we discover any other solutions upon visiting the Herricks house next Tuesday. Thank you, Brian Church AIA

I live two homes down the beach on the north side from subject property and wanted to express to you my support for Tony Varano's variance to allow construction of his new two story home to five feet (5') from his property line. All of our homes on the beach have our homes built five feet (5') from our property lines. Also, I have walked the area and many homes have their building structures 5' from their property lines that are next to the beach access. Our beach home lots are very small and we need to maximize the available space to create a functional, livable and neighborhood friendly home. I believe that Tony Varano should be afforded the same courtesy as the rest of the community. If he has overwhelming support from our neighborhood, why would the planning commission exert their preference onto his building prospects? The home that exists in the lot today is an eye sore and has building structures that are built less than five feet (5') from the property line. I want to see a new quality home built that improves the community and improves my personal quality of life. Tony Varano should be granted the right to build a new quality two story home that has living space on both floors which is twenty five (25') side to side on his lot. Board suggested that efforts be made to minimize soil removal consistent with the DRO. There was general support for the proposed geological monitoring. There was some disagreement regarding whether an effort should be made to preserve more of the trees on the property. There was also some disagreement as to whether or not the mass of the project poses a DRO violation. Members suggested that dropping the height in the basement may sufficiently reduce the mass.
