AGREEMENT BETWEEN THE UNITED NATIONS EDUCATIONAL, SCIENTIFIC AND CULTURAL ORGANIZATION AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE REPUBLIC OF PARAGUAY Paris, UNESCO Headquarters
AGREEMENT Between THE UNITED NATIONS EDUCATIONAL, SCIENTIFIC AND CULTURAL ORGANIZATION And THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL And THE GOVERNMENT OF THE REPUBLIC OF PARAGUAY WHEREAS the Government of Brazil and the Government of Paraguay fully support the designation of the International Centre on Hydro-Informatics for Integrated Water Resources Management (CIH) as a Category 2 Centre under the auspices of UNESCO, HAVING REGARD to the resolution of the UNESCO General Conference (34 C/Resolution 30) seeking to promote international cooperation through the designation of CIH as a category 2 Centre under the auspices of UNESCO, CONSIDERING that the Director-General of UNESCO has been authorized by the Governing Bodies of UNESCO to conclude with the Governments of Brazil and Paraguay an agreement regarding the establishment of the International Centre on Hydro-Informatics for Integrated Water Resources Management (CIH) as a category 2 Centre under the auspices of UNESCO. DESIROUS of defining the terms and conditions governing the framework for cooperation between UNESCO, the Government of Brazil and the Government of Paraguay regarding CIH in this Agreement,
NOW THEREFORE, UNESCO, the Government of Brazil and the Government Paraguay (hereinafter referred to as the Parties ) have agreed as follows: Article 1 Definitions 1. In this Agreement, UNESCO refers to the United Nations Educational, Scientific and Cultural Organization. 2. The Government of Brazil means the Government of the Federative Republic of Brazil. 3. The Government of Paraguay means the Government of the Republic of Paraguay. 3. CIH means the International Centre on Hydro-Informatics for Integrated Water Resources Management, a Category 2 Centre under the auspices of UNESCO established within Itaipú Binacional. 4. ITAIPU means Itaipú Binacional, a binational entity created by a bilateral treaty signed by the Government of Brazil and the Government of Paraguay on 26 April 1973. Article 2 Purpose of the Agreement The purpose of this Agreement is to define the terms and conditions governing collaboration between UNESCO, the Government of Brazil and the Government of Paraguay regarding the designation of CIH as a category 2 Centre under the auspices of UNESCO and also the rights and obligations stemming therefrom for the Parties. Article 3 Establishment The Governments of Brazil and Paraguay shall assist, as appropriate, ITAIPU in taking measures to establish and operate CIH as a category 2 Centre under the auspices of UNESCO in accordance with the present Agreement. Article 4 Legal status 1. The Parties understand that CIH is not to be a legal entity of UNESCO and that ITAIPU is independent of UNESCO. 2. The Parties acknowledge that CIH, as part of ITAIPU, is an entity within the territories of Brazil and Paraguay, and as such, CIH s legal status and capacities are governed by both Brazil and Paraguay s laws, regulations, and policies. Article 5
Advisory Board The Government of Brazil and the Government of Paraguay shall assist ITAIPU in the establishment of the Advisory Board of CIH as foreseen in the agreement between UNESCO and ITAIPU. Article 6 UNESCO s contribution UNESCO may provide assistance, as needed, in the form of technical assistance for the programme activities of CIH, in accordance with the strategic goals and objectives of UNESCO, by: (a) providing the assistance of its experts in the specialized fields of CIH; (and/or) (b) engaging in temporary staff exchanges when appropriate, whereby the staff concerned will remain on the payroll of the dispatching organizations; (and/or) (c) seconding members of its staff temporarily, as may be decided by the Director-General on an exceptional basis if justified by the implementation of a joint activity/project within a strategic programme priority area. Article 7 Contribution by the Governments of BRAZIL AND PARAGUAY The Government of Brazil and the Government of Paraguay shall endeavour to monitor through ITAIPU the securement of the necessary resources, financial and in-kind, required for the administration and proper functioning of CIH. Article 8 Entry into force The present Agreement shall enter into force, after signature of the agreement between UNESCO and ITAIPIU, following its signature by the Parties and when they have informed each other, in writing, that all the formalities required to that effect by the domestic law of Brazil and Paraguay and by UNESCO s internal regulations have been completed. The date of the last notification shall be deemed to be the date of entry into force of this Agreement. Article 9 Duration
This Agreement is concluded for a period of six years as from its entry into force. The Agreement shall be renewed upon common agreement between Parties once the Executive Board of UNESCO made its comments based on the results of the renewal assessment provided by the Director-General of UNESCO. Article 10 Denunciation 1. Each of the Parties shall be entitled to denounce this Agreement unilaterally. 2. The denunciation shall take effect 90 days following receipt of the notification sent by one of the Parties to the others. 3. Should the agreement between UNESCO and ITAIPU be terminated, the present Agreement shall automatically terminate on the date of termination of the agreement between UNESCO and ITAIPU. Article 11 Revision The present Agreement may be revised by written consent between the Government of Brazil, the Government of Paraguay and UNESCO. Article 12 Settlement of disputes All disputes arising out of or in connection with the present Agreement shall be settled by mutual understanding.
