RECOMMENDATION: Renew, subject to all previous conditions and with a review by the County Board in three (3) years (December 2006). ISSUE: SUMMARY: None. The site plan amendment review is for the operation of a weekly family-oriented live comedy show in store #3104 on the third floor in the Ballston Common Mall. The applicant is in compliance with all site plan amendment conditions and other County and state codes. Staff supports the continuance of the use. BACKGROUND: This site plan amendment for a live comedy show in the Ballston Common Mall was approved in 2002. ComedySportz, the applicant, provides a unique venue in which families can go out and enjoy a live comedy show together. It is part of an association of 20 teams that perform in various cities across the country. The business has gone through a major renovation recently. DISCUSSION: The comedy club has been operated in compliance with the site plan amendment conditions and all State and County codes without incident. Since the last review (December 7, 2002): Site Plan Amendment Conditions: The applicant is in compliance with all site plan amendment conditions. STAFF: Wei H. Smith, DCPHD, Planning Division County Board Meeting December 6, 2003

SP #193-2- Community Code Enforcement: There have been no complaints or concerns reported. The Site Plan inspector has no objection to the continuance of this site plan amendment. Police Department: There are no issues or concerns. The Police Department has no objection to the continuance of this site plan amendment. Fire Marshal s Office: There are no issues or concerns. The Fire Marshal s Office has no objection to the continuance of this site plan amendment. Civic Associations: The Ballston-Virginia Square Civic Association and the Ballston-Virginia Square Partnership were notified of this site plan amendment review. The Partnership responded with no issues or concerns of this site plan amendment. The Civic Association has not responded at the time of this report. CONCLUSION: Currently the business is in compliance with all County and state regulations. The business has introduced more foot traffic to the Ballston Common Mall and its businesses, such as restaurants and candy stores in the Mall. Therefore, it is recommended that the site plan amendment be renewed, subject to all previous conditions, with a review in three (3) years (December 2006).
