Tour de Bretagne (Jersey) Order 2010 Article 1 TOUR DE BRETAGNE (JERSEY) ORDER 2010 Made 8th April 2010 Coming into force 8th April 2010 THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Article 2 of the Entertainments on Public Roads (Jersey) Law 1985 1, and after consultation with the Connétables of Grouville, Saint Brelade, Saint Martin, Saint Ouen and Saint Peter, orders as follows 1 Interpretation In this Order entertainments means the entertainments in the form of a road race and a time trial that are part of the bicycle event known as the Tour de Bretagne, including any related practice runs on, or checks of, each part of a public road closed under Article 3, any runs by accompanying vehicles and any related motor bicycle parade or other parade; Law means the Entertainments on Public Roads (Jersey) Law 1985 2. 2 Use of roads for entertainments (1) If the requirements as to insurance and public notice set out in Articles 7 and 8 are complied with, a specified part of a public road may be used during a specified period for any of the following purposes (b) (c) the holding of the entertainments; the viewing of those entertainments; the making of arrangements preparatory to the holding and viewing of the entertainments. (2) For the purposes of paragraph (1), a specified part of a public road is a part of a public road, being a public road named in column 1 of Schedule 1 or 2, and being a part that runs from a location or public road specified opposite in column 2 of the same Schedule to a location or public road specified opposite in column 3 of the same Schedule. Article 3 Tour de Bretagne (Jersey) Order 2010 (3) For the purposes of paragraph (1), a specified period for a specified part of a public road is the period specified in column 4 of a Schedule opposite the indication of the part in columns 2 and 3 of the same Schedule. 3 Closure of roads so used During the period when part of a public road may be used for any of the purposes specified in Article 2, the Minister for Economic Development may cause it to be closed to pedestrian and vehicular traffic. 4 Material required for entertainments (1) Between 9 a.m. on Saturday 24th April 2010 and 9 p.m. on Monday 26th April 2010, the Minister for Economic Development may cause to be placed and maintained on (b) the footpaths and sides of the carriageways of any part of a public road (being a part specified in either Schedule 1 or Schedule 2); or the median lines of any part of a public road (being a part so specified), material required for the purposes of or in connection with the entertainments. (2) However, material shall not be placed in pursuance of this Article unless adequately illuminated from half an hour after sunset to half an hour before sunrise so as to give reasonable warning to pedestrian and vehicular traffic. 5 Other arrangements for safety of public, or purposes incidental to entertainments: road race (1) The arrangements set out in paragraphs (2), (3) and (4) shall also apply for the purposes of the entertainments. (2) Notwithstanding Article 3 of the Road Traffic (Grouville) (Jersey) Order 2002 3 or Schedule 1 to that Order, any vehicle may, between 9.00 a.m. and 6.00 p.m. on 25th April 2010, be driven in either direction along any of the following public roads, or parts of public roads, for the purpose of ingress to or egress from any property in that road (b) (c) Beach Road; Union Road; Gorey Village Road between the bottom of La Chèvre Rue (Daisy Hill) and Beach Road. (3) Notwithstanding the Road Traffic (Grouville) (Jersey) Order 2002 and Road Traffic (St. Martin) (Jersey) Order 1989 4, a motor vehicle shall not remain on any part of a public road, being a part specified in Schedule 1, between 5 a.m. on Sunday 25th April 2010 and 6 p.m. on Sunday 25th April 2010. Tour de Bretagne (Jersey) Order 2010 Article 6 (4) Notwithstanding the Road Traffic (Public Parking Places) (Jersey) Order 2006 5, a motor vehicle shall not remain in any part of the Gorey Common car park in Gorey, or the Beach Road car park in Gorey, between 5 p.m. on Saturday 24th April 2010 and 8 p.m. on Sunday 25th April 2010. (5) Nothing in paragraph (3) prevents a motor vehicle from remaining in any off-road car park during a period of closure under Article 3 of the part of the public road that provides access to the car park if the motor vehicle remains there during the entire duration of that closure. 6 Other arrangements for safety of public, or purposes incidental to entertainments: time trial (1) The arrangements set out in paragraphs (2) and (3) shall also apply for the purposes of the entertainments. (2) Notwithstanding the Road Traffic (St. Brelade) (Jersey) Order 1990 6, the Road Traffic (St. Ouen) (Jersey) Order 1979 7 and the Road Traffic (St. Peter) (Jersey) Order 1992 8, a motor vehicle shall not remain on any part of a public road, being a part specified in Schedule 2, between 7 a.m. and 1 p.m. on Monday 26th April 2010. (3) Notwithstanding the Road Traffic (Public Parking Places) (Jersey) Order 2006, a motor vehicle shall not remain in any part of the La Braye car park in St. Brelade between 5 p.m. on Sunday 25th April 2010 and 2 p.m. on Monday 26th April 2010. (4) Nothing in paragraph (2) prevents a motor vehicle from remaining in any off-road car park during a period of closure under Article 3 of the part of the public road that provides access to the car park if the motor vehicle remains there during the entire duration of that closure. 7 Insurance cover The requirements of this Article to which Article 2 refers are that the Minister for Transport and Technical Services shall be satisfied that there is insurance against any liability that may be incurred by (b) (c) (d) any person organizing, supervising, or concerned in the conduct of, the entertainments; the Minister for Economic Development; any official, agent, or servant, of the Minister for Economic Development; or any person taking part in the entertainments, in respect of damage to property, or in respect of the death of any person or bodily injury to any person, resulting from the holding or viewing of the entertainments or from arrangements preparatory to the holding and viewing of the entertainments. Article 8 Tour de Bretagne (Jersey) Order 2010 8 Public notice of restrictions (1) The requirements of this Article to which Article 2 refers are as set out in paragraphs (2) and (3). (2) On 2 occasions during the 7 days immediately preceding Sunday 25th April 2010, the Minister for Economic Development shall cause to be published in the Jersey Gazette notice of each proposed closure, under Article 3, of part of a public road; and (b) each arrangement that will apply under Article 5 or 6, specifying the parts of the public roads and the periods concerned. (3) Each notice shall be certified by the Greffier of the States as a notice that is being published in pursuance of this Order. 9 Limited access (1) A police officer, or a person appointed by the Minister for Economic Development as an event marshal for the purposes of this Order, may prohibit, restrict, regulate or allow the access of persons (whether with motor vehicles or otherwise) to any part of a public road when the part is closed to traffic under Article 3, or when it is subject to arrangements under Article 5 or 6, if he or she considers it necessary to do so in the interests of the safety or convenience of the public. (2) Members of the fire service, ambulance service, coast guard or Royal National Lifeboat Institute, or police officers, may (whether with motor vehicles or otherwise) enter and use any part of a public road when it is closed to traffic under Article 3, or when it is subject to arrangements under Article 5 or 6, to the extent that it is reasonably necessary for them to do so in order to perform their duties. 10 Citation This Order may be cited as the Tour de Bretagne (Jersey) Order 2010.
