Andrews Avenue, Room 417 Fort Lauderdale, FL. 33301 Subject: Broward MPO Resolution Endorsing Transportation Surtax Dear Mayor Kiar: At the March 10th Broward MPO Board Meeting, the MPO Board of Directors passed a resolution in support of a referendum for a penny sales tax increase on the November 2016 ballot. A copy of that resolution is attached to this email. The resolution endorses the Transportation Surtax, with a proposed distribution of 65% of proceeds directly allocated to the County, and 35% of proceeds directly allocated to the municipalities in Broward, based on population. Based on assumed revenues of $300 million in the first year of implementation, Broward County would receive approximately $195 million in the first year, while the municipalities would receive approximately $105 million, with the municipalities revenue to be distributed based on population. The resolution also calls for the creation of an independent oversight committee to oversee management of the funds, pursuant to an interlocal agreement between Broward County and the local municipalities. If the Broward County Commission fails to take action on the penny sales tax by April 5, 2016, this resolution shall be considered null and void. Moving forward, the municipalities have indicated that they will pursue a one cent Infrastructure Surtax if negotiations with Broward County to establish an equitable revenue-sharing model are unsuccessful. WHEREAS, the Broward Metropolitan Planning Organization (the BMPO ) serves as the designated transportation planning agency for Broward County, Florida; and WHEREAS, the BMPO strongly believes that Broward County s economic future depends on having the best available transportation network that will allow Southeast Florida and the United States to compete for business both nationally and globally while preserving our unique quality of life; and WHEREAS, the BMPO, in accordance with its adopted Long Range Transportation Plan (Commitment 2040) and its mission to move people, create jobs, and strengthen communities, encourages multimodal transportation options that have the potential to increase levels of economic development and enhance the competitiveness of the region; and WHEREAS, Broward County and the municipalities of Broward County are presently without sufficient revenues to adequately fund the transportation needs within the County and are without sufficient fiscal resources to adequately fund infrastructure and equipment to address transportation and safety needs to benefit the local economy and the citizens of Broward County and the municipalities within Broward County; and WHEREAS, the provision of adequate and efficient transportation facilities upon which the public depends on a day to day basis is a matter of great public concern to the citizens of Broward County and the municipalities within Broward County; and WHEREAS, Section 212.055(1), Florida Statutes, entitled Charter County and Regional Transportation System Surtax, (the Transportation Surtax Law ) authorizes the imposition of a 1.0 percent local government transportation surtax upon transactions occurring within Broward County that are taxable pursuant to Chapter 212, Florida Statutes, subject to referendum approval; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BROWARD METROPOLITAN PLANNING ORGANIZATION, IN AND FOR THE BROWARD COUNTY URBANIZED AREA: Section 1. That the above recitals are true and correct and are specifically incorporated herein. Section 2. That the Board of Directors of the Broward Metropolitan Planning Organization supports the imposition of a Broward County wide, transportation surtax, as authorized pursuant to Section 212.055(1), Florida Statutes, with the following components: A. Imposition of a Regional Transportation System Surtax. If approved in a referendum election to be held on November 8, 2016, the Broward County surtax shall be a one cent per dollar regional transportation system surtax imposed upon all authorized taxable transactions occurring within Broward County from January 1, 2017 until the surtax is repealed. B. Use of Surtax Revenues. The surtax revenues shall be utilized by Broward County and the municipalities, in accordance with Section 212.055(1), Florida Statutes. C. Distribution of Surtax Revenues. The proceeds of the surtax revenues shall be distributed 65% to Broward County, 35% to the municipalities within Broward County. The surtax allocation to the municipalities shall be population based. Details to be further outlined pursuant to interlocal agreement between Broward County and each of the municipalities within Broward County. D. Municipal Pool of Unused Surtax Revenues. Each municipality shall have five (5) years from receipt of surtax revenues to construct appropriate project(s). Upon the failure of a municipality to timely utilize these revenues, or at the discretion of a municipality, any unused municipal surtax revenues will be transferred to the BMPO to be reallocated to advance municipal projects in the BMPO s Transportation Improvement Program (TIP) or to fund projects through the BMPO s Complete Streets and Other Localized Initiatives Program. Details to be further outlined pursuant to interlocal agreement between Broward County and each of the municipalities within Broward County. E. Oversight Committee. An independent oversight committee shall be established for the purpose of confirming statutory and interlocal agreement compliance by any party receiving surtax revenues and all parties to the interlocal agreement. Details to be further outlined pursuant to interlocal agreement between Broward County and each of the municipalities within Broward County. Section 3. EFFECTIVE DATE / TERMINATION DATE.
