Adopted September 19, 1967 PREAMBLE The Town Board of the Town of Kirkwood, County of Broome, State of New York, pursuant to the provisions of the Vehicle and Traffic Law of the State of New York does hereby enact the following ordinance to regulate traffic upon the highways within the Town of Kirkwood, outside the corporate limits of any village. TITLE This ordinance shal be known and cited as Trafic Ordinance No. 1 of the Town of Kirkwood. ARTICLE I WORDS AND PHRASES DEFINED SECTION 1. Definition of Words and Phrases. a. The Words and phrases used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York. b. The following words and phrases which are not defined by Article 1 of the Vehicle and Traffic Law of the State of New York shall have the meanings respectively ascribed to them in this section for purposes of the traffic ordinances of this town. ARTICLE II TRAFFIC CONTROL DEVICES SECTION 20. Authority to Install Traffic Control Devices. The Town of Kirkwood Department of Public Works shall install and maintain traffic control devices when and as required under the provisions of this ordinance to make effective the provisions of said ordinance and may install and maintain such additional traffic control devices as it may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York subject to the provisions of Sections 1682 and 1684 of that law. No pedestrian shall cross Corporate Drive from Felchar Building #1 known as 196 Corporate Drive located on the easterly side of Corporate Drive to the Felchar parking lot on the westerly side of Corporate Drive except within a marked crosswalk. h. The intersection of Link Drive with Corporate Drive is hereby designated as a stop intersection and a stop sign shall be erected on Link Drive at its entrance to said intersection. The intersection of Brink Road with Cedarhurst Drive is hereby designated as a yield intersection and a yield sign shall be erected on Brink Road at its entrance with said intersection. b. The intersection of Sommers Street with Golden Street is hereby designated as a yield intersection and a yield sign shall be erected on Sommers Street at its entrance to said intersection. c. The parking of vehicles is hereby prohibited in any of the following locations: 1. On both sides of Francis Street from Crescent Drive to the bridge over Route 81. 2. On both sides of Roberts Street from Francis Street to Crescent Drive. 3. On both sides of William Street from Crescent Drive to the race track. 4. On the east side of Colesville Road from its intersection with Stratmill Road to the southwesterly corner of premises designated by Broome County Tax Map No. 5-9-S10 reputedly owned by Mary Quick. 5. On the west side of Colesville Road from its intersection with Stratmill Road to the southwesterly corner of premises designated by Broome County Tax Map No. 5-5 reputedly owned by William and Helena Bielecki. 6. On both sides of Industrial Park Road from its intersection with Colesville Road to the entrance to Kason Hardware building. 7. On both sides of Colesville Road from its intersection with Route 11 to the entrance to Barlow Road. 8. On the south side of Barlow Road from Colesville Road to Loughlin Road. ARTICLE XI PARKING METERS ARTICLE XII REMOVAL AND STORAGE OF VEHICLES SECTION 120. Authority to Impound Vehicles (Amended March 11, 1988 LL No. 1-88 & May 3, 2005 - LL No. 4-05) a. When any vehicle is parked or abandoned on any public highway, park, parking area of any municipal building, installation or facility within this Town during a snowstorm, flood, fire or other public emergency which affects the portion of the public highway, park, parking area of any municipal building, installation or facility upon which said vehicle is parked or abandoned, said vehicle may be removed by Town of Kirkwood Department of Public Works or independent contractor employed for that purpose by the Town. b. When any vehicle is found unattended on any highway within this Town where said vehicle constitutes an obstruction to traffic, said vehicle may be removed by Town of Kirkwood Department of Public Works or independent contractor employed for that purpose by the Town. c. When any vehicle is parked or abandoned on any highway within this Town where stopping, standing or parking is prohibited, said vehicle may be removed by Town of Kirkwood Department of Public Works or independent contractor employed for that purpose by the Town. SECTION 121. Storage and Charges After removal of any vehicle as provided in this article, the Town of Kirkwood Department of Public Works or independent contractor employed for that purpose by the Town may store such vehicle in a suitable place at the expense of the owner. Such owner, or person in charge of the vehicle, may redeem the same upon payment to the Town of Kirkwood of the amount of all expenses actually and necessarily incurred in effecting such removal, such charges not to exceed Fifty Dollars ($50.00) together with any charges for storage, such storage charges not to exceed Fifteen Dollars ($15.00) per day, or fraction thereof. The Commissioner of Public Works shall without delay report the removal and disposition of any vehicle removed as provided in this article to the Enforcement Officer and it shall be the duty of such Enforcement Officer to ascertain to the extent possible the owner of the vehicle or person having same in charge and to notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem same. (Amended May 4, 2004 by LL No. 21-2004) A. A violation of this ordinance is an offense, punishable as follows: 1. For conviction of a first offense: A fine not exceeding fifty dollars or imprisonment for not more than fifteen days, or both. 2. For conviction of a second offense: A fine not exceeding one hundred dollars or imprisonment for not more than fifteen days, or both. 3. For conviction of a third or subsequent offense: A fine not exceeding two hundred fifty dollars or imprisonment for not more than fifteen days, or both. ARTICLE XXI REPEAL OF PRIOR ORDINANCES SECTION 310. Ordinances Repealed; General. All prior ordinances or parts of ordinances of this town regulating traffic are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. 5511

ARTICLE XXII SECTION 320. Constitutionality. EFFECT OF ORDINANCE If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Effective Date: WHEREAS, the Kirkwood Town Board in regular session convened on September 5, 1967 duly adopted an ordinance entitled Trafic Ordinance No. 1 of the Town of Kirkwood, and RESOLVED, that the Superintendent of Highways of the Town be and he hereby is directed to install and maintain signs in conformance with the Manual of Uniform Traffic Control Devices of the State Traffic Commission to post the regulations established in said ordinance, with enforcement of the provisions thereof to become effective on said installation. 5512
