The property surrounds a small cemetery located at the corner of the intersection. The owner of the plaza has obtained a permit for and installed a multi-tenant ground sign on Hurontario Street. In addition to this sign, the Sign By-law allows one additional ground sign for the sole use of the gas bar. A site specific amendment to the Sign By-law has been requested to allow signage for the anchor tenant, Tim Hortons, to be displayed as part of the proposed gas bar ground sign. As the proposed sign conforms to all size restrictions within the Sign By-law and a second multi-tenant ground sign would be permitted if the property frontage was not interrupted by the existing cemetery, it is recommended that the applicant's request for a site specific amendment to the Sign By-law be approved. Public notice has been provided pursuant to the Procedure By-law. Recommendations: 1. THAT the report from Marco Taraborrelli, Sign Co-Ordinator, Planning & Infrastructure Services Department, dated July 25, 2014, to the Planning, Design & Development Committee Meeting of September 8, 2014 re: Recommendation Report - Site Specific Amendment to the Sign By-law 399-2002, as amended - Ward 6 -, 230 and 240 Wanless Drive, be received;

2. THAT the attached amendment to the Sign By-law be enacted; and 3. THAT the applicant be responsible for the cost of the public notification. Background: Construction of a new commercial plaza on the northwest quadrant of Hurontario Street and Wanless Drive has recently been completed. The development consists of a stand alone Tim Hortons building, a multi-tenant building and a gas bar. The subject property has street frontage on both Hurontario Street and Wanless Drive and surrounds an existing cemetery located at the corner of the intersection which effectively reduces the street frontage for the commercial plaza. A building permit has recently been issued for one multi-tenant ground sign located adjacent to the east entrance of the property on Hurontario Street. Current Situation: Due to the reduced street frontage, the Sign By-law only allows one multi-tenant ground sign on the property and one additional ground sign for the sole use of the gas bar. An application for a site specific amendment to the Sign By-law was submitted by to include advertising for the anchor tenant, Tim Hortons, as part of the gas bar ground sign. The proposed sign will be located adjacent to the driveway entrance at the west end of the property along Wanless Drive and will provide greater visibility in identifying both the anchor tenant and access to the property. It is noted that this amendment would not be necessary if the property street frontage was not interrupted by the existing cemetery and that the proposed sign conforms to all other requirements and restrictions of the Sign By-law. Corporate Implications: Financial Implications: None Other Implications: Staff of the Urban Design Section have no concerns with the proposed amendment.

Ta~3 Strategic Plan: The proposed site specific amendment to the Sign By-law supports Economic Development by supporting business attraction, retention and expansion. Conclusion: A site specific amendment to the Sign By-law sign has been requested by Wanless Lands Inc. to allow signage for Tim Hortons to be displayed as part of a proposed ground sign permitted for the sole use of the gas bar. Given that the proposed sign would be allowed if the existing cemetery did not reduce the street frontage of the plaza, it is recommended that the proposed site specific amendment to the Sign By-law be approved. NOW THEREFORE the Council of The Corporation of the City of Brampton ENACTS as follows: 1. THAT By-law 399-2002 as amended, is hereby further amended by adding the following sentence to Schedule XIII SITE SPECIFIC PROVISIONS: 44. Notwithstanding Schedule VIII GROUND SIGNS, the following signage on the lands described as PLAN 43M-1588 Block 339 (230 and 240 Wanless Drive) is permitted: a) Display of one additional anchor tenant on the gas bar ground sign is permitted provided: i. The sign shall be located a minimum distance of 1.5 m (5 ft) from all property lines; ii. iii. The sign shall not exceed 6.1 m(20 ft) in height and 12 m2 (130 fr) in sign area; and That no further ground signs be permitted on the property.
