1 Terms of Reference Purpose 1.1 The Police and Public Encounters Board (PPEB) exists to provide a national forum where all issues relating to the interface between the police service and members of the public can be considered and debated. promote best practice. It provides an opportunity to identify and 1.2 The Board sits under the remit of the stop and search portfolio which is part of the Uniform Business Operations Business Area. The Association of Chief Police Officers (ACPO) lead for stop and search is Deputy Chief Constable Adrian Hanstock (BTP), who chairs the meetings. Meetings 1.3 The meetings are held quarterly and to reflect the national remit of the meeting, the venue is moved around England and Wales to ensure all forces have an opportunity to attend. 1.4 The latest meeting was held on Wednesday 05 November 2014, from 1pm to 4pm at West Mercia Police, The Allsop Room, West Mercia Police Headquarters, Hindlip Hall, Worcester, WR3 8SP. The next meeting will be held on Thursday 05 February 2015, at 1pm at Police Training Centre, (Tally Ho), Edgbaston. West Midlands Police will be hosting. Current membership 1.5 Membership is open to all Home Office forces and Police and Crime Commissioners (PCCs), community representatives and interested parties are encouraged to attend. Powers and publications 1.6 The Board is convened under the Uniform Business Operations Business Area of ACPO. ACPO is an independent, professionally led strategic body. In the public interest and in equal and active partnership with Government and partner agencies, ACPO leads and coordinates the direction and development of the police service in the United Kingdom. 1.7 A record of meeting is produced and it is envisaged these will be eventually published on ACPO web site at www.acpo.police.uk. Records of previous meetings can be obtained from the Board Secretariat. Contacts and Board Secretariat 1.8 This meeting is administered on behalf of the ACPO Lead by the MPS Stop and Search Team. All correspondence should be directed to Ms Pat Bastin. 2 Introduction 2.1 Stop and search is a powerful police power that is subject to intense political and public scrutiny. In July 2013, HMIC published its report into the nationwide use of stop and search. This critical report made 10 recommendations for forces, PCCs and College of Policing (CoP) to implement. In April 2014, the Home Secretary published the findings from a national consultation process, making a number of recommendations and edicts. The Home Secretary also unveiled the Best use of Stop and Search scheme, (BuSSs) which is a voluntary code of practice that forces are encouraged to sign up to. Key facts 2.2 The purpose of stop and search is to assist police officers in the prevention and detection of crime, and to avoid unnecessary arrests in circumstances where a search might eliminate an officer s suspicions. Between April 2012 and March 2013, 1,006,187 stop and searches were conducted in England and Wales, 10% resulted in an arrest. 2.3 There are 20 separate main statutory powers to stop and search but the vast majority of searches are conducted under Section 1 of Police and Criminal Evidence Act (PACE) 1984 and S23 Misuse of Drugs Act 1973. These powers require an officer to have, reasonable grounds to suspect, that in individual has the prohibited item in their possession. 2.4 The term S60 refers to Section 60 of the Criminal Justice and Public Order Act 1994, this is a distinct power that allows officers to conduct searches without reasonable suspicion. If a senior officer believes serious violence may occur, an order for a specified locality and time may be put in place.

2.5 PPEB has representation from all forces in England and Wales. There is also interest from Police Scotland. 3 Topics discussed Chief Constable David Shaw opened the meeting and thanked everyone present for their continued work and felt there was some powerful work emerging. In the absence of DCC Hanstock, Supt Mark Travis, West Mercia Police chaired the meeting. 3.1 West Mercia Use of Stop and Search The aim was to update the Board on the West Mercia approach to stop and search. Updates were also given on the recent HO/HMIC recommendations. 3.1.1 The following HO/HMIC recommendations updates were given: Quality Assurance - when an email is sent to a member of staff, a text box is available for additional search information. The original stop and search record cannot be changed. Public Scrutiny - Independent Advisory Groups (IAGs) are bought into police buildings. The system is fully automated. The IAG member or a member of the public can look at the system and can comment on what has been seen. Around 5% of stop and search is audited by a chief inspector or above. 3.2 HMIC - Future Inspection Process The aim was to update the Board on the future inspection process. 3.3 Stop and Search Mapping - Police UK The aim was to update the Board on Stop and Search Mapping that will be published on the police.uk website on Thursday 01 January 2015. 3.3.1 The following points were included in a verbal update given by Jayne Pascoe - Home Office. By the end of November 2014, the mapping pilot will be at West Mercia Police and Nottinghamshire Police. The pilots will be part of the public consultation. User groups will be in Nottinghamshire and Suffolk. West Mercia will have their own. Forces will be invited to provide what data is available.

Have flexibility to map by either location, post code level, street level. Need to publish data at a local level. Public can use police.uk to download information and engage in conversation. Young people will be aware of their rights, who to contact etc. The aim is by January 2015 to have a basic product. Age and gender not always used by some forces. There won t be an annual data return for 2014. Next Steps - stop and search leads will be contacted on any issues raised. Don t want to compare data between forces. Trying to be as flexible as possible. Need to be consistent. Want to hear from members of the public. Stop and search data should be intelligence lead and include S60. Some forces can map S163. 3.4 Home Office Recommendations Update The aim was for the forces identified to lead on developing a response to the Home Office/HMIC recommendations that were announced by the Home Secretary on Wednesday 30 April 2014. Lead forces were identified and tasked at the PPEB meeting held on Wednesday 16 July 2014. Supt Mark Travis added that all documents circulated would be compiled by the MPS Stop and Search Team and forwarded to DCC Adrian Hanstock. 3.4.1 Satisfaction (HMIC8 and HO8) and Section 60 (HO9 and HO10) - GMP GMP - PS Denise Jacobs referred to the update submitted to the MPS Stop and Search Team on 04 November 2014. MPS - Mr Ted Henderson added that the MPS produce complaints data which has been published on the MPS internet site. Dorset Police - Ch/Insp Ashley Adams said Dorset use dip sampling and write to BMEs re their experiences. Humberside - Mr Eddie McGee spoke on National Form - added when the public complete a form, if they are a nominal, they cannot come. Sometimes found more information on an application form than on the nominal computer base. Does the app form get used for intelligence purposes?

3.4.2 Lay Observation (HO7) - Avon and Somerset Constabulary Supt Mike Prior made reference to the update that had been circulated from the ROM from the last PPEB meeting. 3.4.3 A total of 15 forces have either replicated or adjusted the scheme. It is used as a comms/recruitment/police complaint tool. Workshops are used which are open to anyone, including the media. When a member of the public is on the Ride Along scheme, they can ask questions about the use of stop and search. Youths are also involved. Supt Prior extended an invitation to visit Avon and Somerset to look at what they do. 3.4.4 Following a discussion, it was felt that the use of nominals in the Ride Along scheme was down to local forces/areas. It was suggested the Home Office guidance on this would be useful. 3.4.5 Supt Paul Burrows added that Ride Along members must be vetted if they want to be in a patrol car, but they not vetted when they go out on street patrol. 3.4.6 Supt Mark Travis felt that clear guidance must be in place and added that evaluation will take place soon. 3.4.7 Public Scrutiny (HMIC7 and HO11) - MPS Ted Henderson referred to the update that had been circulated on Monday 03 November 2014. 3.4.8 All forces are working with communities to share data. In London, data has been produced for communities since 2006. Different community groups operate in different ways. One size does not fit all. The MPS produce data on most stopped individuals, overall volume is currently 13,000-14,000 per month. Data used in different degrees. Youth engagement has been problematic and Youth Councils have been used in London. Have a menu of options for boroughs to use which include: Working with City YMCA Find most active officers and share experiences. The most active officers doesn t mean the most effective. Now starting to see change in officer s perception. Second wave group - Lewisham TSG - concerns raised over TSG stop and search. Working with Gangs Against Violence - a new project - trying to improve quality of encounter. 3.4.9 Recording (HMIC9 and HMIC10) - MPS This falls into two categories: Introduction of National Form and use of IT Reference made to PPEB briefing note dated 24 September 2014.

3.4.10 Data (HO5 and HO12) - West Midlands Police T/Insp David Whordley referred to the update that had been circulated on Wednesday 29 October 2014. 3.4.11 Supervision (HMIC2 and HMIC3) - COP Insp Nick Glynn said he had been working jointly with Supt Paul Burrows at Nottinghamshire. The consultation on Code A had recently closed was assured that all forces had responded. All forces are to comply by Sunday 30 November 2014. All updates will be published soon on the COP website. If any further information needed, contact Insp Glynn direct. 3.5 COP Update The aim was to update the Board on current COP work. The update was given by Insp Nick Glynn. 3.5.1 Community Trigger Interested in any training used over the last five years - anything that covers any police contact. COP is linking with HMIC to see what is being done internally. There is pressure to deliver quickly - some background work needs to be done. 3.5.2 POLKA Mapping and Supt Mike Prior s work on Lay Observation is already published on the website. This can be shared by everyone. 3.5.3 BuSSS guidance Version 1 is on the website and it is hoped version 2 will be published soon. There is a contact list on the POLKA site. Social media is used by using #stopsearch - easy to use. Insp Glynn reminded the Board to contact him if there are any issues or concerns. 4 Conclusion and Recommendations 4.1.1 DCC Hanstock has requested that forces should consider what has changed in the last year and are encouraged to think at what stop and search looks like in the future. This will be discussed at the next meeting. 4.1.2 Creation of a PPEB Executive Group It was recommended that a PPEB Executive Group be established to assist with the HO/HMIC recommendations. The initial meeting will be aimed at a targeted audience.

The date of the first meeting will be Friday 19 December 2014 at New Scotland Yard (NSY). An update of this meeting will be given at the next meeting. 4.1.3 National Form All forces are to research if the app form is used for intelligence purposes. All replies are to be sent to Ms Pat Bastin - MPS Stop and Search Team. 4.1.3 Use of social media It was agreed that this will be an agenda item at the next PPEB meeting. 4.1.4 Data Following the update given at this meeting, West Midlands Police have asked for this to be carried over to the PPEB on Thursday 05 February 2015 as an agenda item. This was agreed. 4.1.6 Ride Along It was agreed that Ride Along - directing people to a particular model will be an agenda item at the next PPEB meeting.
