REPORT FOR ACTION Construction Staging Area 19 Western Battery Road Date: December 6, 2017 To: Toronto and East York Community Council From: Acting Director, Transportation Services, Toronto and East York District Wards: Ward 19, Trinity-Spadina SUMMARY This staff report is about a matter that Community Council has delegated authority to make a final decision, provided that it is not amended so that it varies with City policy or by-laws. Liberty Residences Inc. is constructing a 28-storey residential condominium (ZEN King West Condos) at 19 Western Battery Road located in the north-east quadrant of East Liberty Street and Western Battery Road. Transportation Services is requesting approval to close the east sidewalk on Western Battery Road fronting the site for a period of 35 months. Pedestrians will be directed to use the west sidewalk on Western Battery Road. RECOMMENDATIONS The Acting Director, Transportation Services, Toronto and East York District recommends that: 1. Toronto and East York Community Council approve closure of the east sidewalk on Western Battery Road, between East Liberty Street and a point 68.1 metres north, from January 24, 2018 to December 31, 2020. 2. Toronto and East York Community Council rescind the existing permit parking regulation on the east side of Western Battery Road, between East Liberty Street and a point 68.1 metres north. 3. Toronto and East York Community Council rescind the existing standing prohibition in effect at all times on the east and north sides of Western Battery Road, between a point 65 metres north of East Liberty Street and a point 68.1 metres north of East Liberty Street. 4. Toronto and East York Community Council rescind the existing parking prohibition in effect at all times on the west, south and east sides of Western Battery Road, between East Liberty Street and a point 68.1 metres to the north. 5. Toronto and East York Community Council prohibit stopping at all times on the east and west sides of Western Battery Street, between East Liberty Street and a point 68.1 metres north. 6. Toronto and East York Community Council direct the applicant to post a 24-hour monitored construction hotline number on the hoarding board, which must be prominently placed and legible from 20 metres and on all elevations from the construction site. 7. Toronto and East York Community Council direct the applicant to provide and install public art, including mural artwork, onto every elevation of the hoarding board with adequate spotlighting for night-time illumination, at their sole cost, to the satisfaction of the Ward Councillor. 8. Toronto and East York Community Council direct that Western Battery Road be returned to its pre-construction conditions when the project is completed. FINANCIAL IMPACT There is no financial impact on the City. Liberty Residences Inc. is responsible for all costs, including payment of fees to the City for the occupancy of the right-of-way. Based on the area enclosed and projected term of the closure, these fees will be approximately $57,000.00. DECISION HISTORY City Council at its meeting on June 8, 2010 adopted Item TE34.5 and amended Zoning By-law 566-2000 for 19 Western Battery Road, 39-51 East Liberty Road and 14 Strachan Avenue. COMMENTS A mixed-use development (ZEN King West Condos) consisting of an 18-storey residential building will be constructed by Liberty Residences Inc. at 19 Western Battery Road. The site is surrounded by existing Bill Johnson Park to the north, Strachan Avenue to the east, East Liberty Street to the south and Western Battery Road to the west. The development, in its completed form, will consist of 481 dwelling units along with a ground floor retail and 7 levels of underground parking garage. Permanent access to the development will be from Western Battery Road. Major construction activities and associated timeline for the development are described below: Excavation and shoring: December 2017 to November 2018; Concrete phase: December 2018 to June 2020; Construction Staging Area - 19 Western Battery Road Page 2 of 6

Building envelope phase: July 2020 to December 2020; and Interior finishes phase: April 2020 to April 2021. Based on the information provided by the developer, the entire site will be excavated to a depth of 20 metres from the street level. The excavation will extend from property line to property line on all four sides of the site. The developer has advised that due to limited availability of space, all construction activities including delivery of construction material cannot be accommodated within the site. Therefore, occupation of road rightof-way on Western Battery Road will be essential to set up construction staging operations for the development. Construction staging area for the development will be set up within the existing boulevard allowance on the east side of Western Battery Road abutting the site. The construction staging operations for the development will also be set up within the boulevard space on Strachan Avenue and East Liberty Street abutting the site. With the construction staging areas in place, existing pedestrian and vehicular traffic operations on Strachan Avenue and East Liberty Street will remain unchanged. Western Battery Road, in the vicinity of the site is a local roadway and consists of a twolane (northbound and southbound) cross-section. The roadway follows a north-south and east-west orientation between East Liberty Street and Lynn Williams Street. Sidewalks exist on both sides of the roadway. There is no TTC service on this roadway. The following regulations are in effect on the subject section of Western Battery Road: East, North and West Sides: "No Standing, Anytime" on the east and north sides of Western Battery Road between a point 65 metres north of East Liberty Street (east intersection) and a point 31 metres further north and west. "Permit parking, 12:01 a.m. to 7:00 a.m." between East Liberty Street and east/west leg of Western Battery Road. West, South and East Sides: "No Parking, Anytime" on the west, south and east sides of Western Battery Road between East Liberty Street and a point 75.4 metres north of Lynn Williams Street; "Permit parking, 12:01 a.m. to 7:00 a.m." between north/south leg of Western Battery Road to Pirandello Street. "Permit parking, 12:01 a.m. to 7:00 a.m." between Pirandello Street to Lynn Williams Street. Construction staging operations for the development will be set up within the existing boulevard allowance on the east side of Western Battery Road, between East Liberty Street and a point 68.1 metres north. With the proposed construction staging area in place, the east sidewalk on Western Battery Road, between East Liberty Street and a point 68.1 metres north, will be closed Construction Staging Area - 19 Western Battery Road Page 3 of 6

for pedestrian operations. Pedestrians will be directed to the west sidewalk on Western Battery Road at the nearest intersection of Western Battery Road and East Liberty Street. It should be noted that the site abuts existing Bill Johnson Park to the north and there are no pedestrian generators located to the north of the site. Appropriate advanced signage will be positioned at strategic locations to clearly inform pedestrians in the area. Existing traffic operations on Western Battery Road will be maintained. Stopping will be prohibited at all times on the east and west sides of Western Battery Road, between East Liberty Street and a point 68.1 metres north. The proposed construction staging area will result in displacement of eight on-street permit parking spaces on the east side of Western Battery Road. Based on the information provided by the developer, alternative parking spaces will be provided to accommodate all eight displaced permit parking spaces on Western Battery Road. Finally, a review of the City's five-year major capital works program indicates that there are no capital works projects planned in the vicinity of the site. Therefore, the proposed construction staging area on Western Battery Road is not expected to conflict with the City's capital works projects. Through ongoing dialogue with the developer, Transportation Services is satisfied that Liberty Residences Inc. has looked at all options to minimize the duration and impact of the construction staging area on all road users.
