NORTHLAKE PHILOSOPHY The stunning landscape of Northlake is deserving of protection, as is your investment in your Northlake property. Therefore, you need confidence that your neighbours in Northlake share the vision of a high quality residential development, while also protecting Northlake s natural environment and views. Northlake Homes (types A J) are to be built according to the Approved Building Plans applicable to the relevant Northlake Home Lot (as specified in Appendix). A key objective of these Guidelines is to ensure a high quality built environment and to limit development to an appropriate and coordinated palette of materials in keeping with the Northlake setting. In these Guidelines, buildings means any dwelling (including carports and garages), structure or accessory unit erected on the Northlake Home Lot. These Design Controls shall be administered by Northlake Developments Limited ( NDL ) or such person appointed by NDL. BUILDING CONSTRUCTION An Owner must select one of the Northlake Homes that has been allocated to their Lot (see Appendix) and then build as per the approved building plans for that house (the Approved Building Plans ). The Approved Building Plans for each of the Northlake Homes are available at www.northlake.co.nz An Owner may amend or vary the internal layout of the Approved Building Plans but cannot vary the position of the windows, external doors, garage/carport of the home or change the external materials or external appearance of the Northlake Home in any way. All Northlake Homes must be built strictly in accordance with the orientation, road / access lot boundary and side boundary setbacks as specified from time to time in the applicable Approved Building Plans. BUILDING CONSTRUCTION CONTROLS SETBACKS Buildings on lots located in Activity Area B4 and C2 are not be constructed within the following setback areas: o Road and access lot boundary - 4.5 metres. o Internal boundaries one setback of 4.5 metres and all remaining setbacks to be 2 metres. Buildings on lots located in Activity Area D1 are not be constructed within the following setback areas: o Road and access lot boundary 3.0 metres. o Internal boundaries - 1.5 metres. Downlighting Fencing Road Boundary hedges - Laurel / Viburnum FENCING & PLANT SPECIES For consistency, solid fencing in vertical palings or battens to a finished height of 1.8 metres is permitted on all side and rear boundaries only. Fencing to 1.8 metres is not permitted within 4.5 metres of any road or reserve boundary in Activity Area B4 and within 3.0 metres within Activity Area D1. All paling or battens shall be stained or painted in dark brown or black and shall be maintained in that finish as weathering affects colour strength over time. There shall be no fencing on street frontages or access lot frontages or frontages adjoining reserves, open spaces, walkways or any other spaces that are not residential houses. Lightweight permeable fencing (in grey, black or dark green) for the purpose of containing young children and domestic pets is allowed on boundaries where fencing is not permitted. This fencing may not exceed 1 metre in height and must be planted with one of the permitted hedging species. Trees that will be higher than 1.8 metres shall be selected from the following tree species only: Native Beech trees, Oak, Elm, Birch, Maple, Plane, English Beech, Walnut, Ash and Alder species. Any hedges on road, reserve or access lot frontages shall be undertaken in either Viburnum or Laurel hedging, planted at 800mm centres and maintained in a neat and tidy clipped manner at maturity, to a height of 1.8 metres. LANDSCAPE CONTROLS Landscaping (both hard and soft) and fencing is to be completed as per the materials and planting legend and Approved Building Plans. All landscaping is to be maintained to a neat and tidy standard free of noxious weeds and overgrowth. An Owner cannot amend or vary the landscaping or fencing in the Approved Building Plans in any way. Exterior Lighting: All exterior landscape lighting shall be downlighting only. The light source shall not be more than 1.2 metres above ground level. No satellite dish or rubbish bins shall be visible from the road, any access lot or reserve. All services and utilities shall be located below ground. Driveways: Owners are responsible for constructing the driveway to connect with the relevant road / access lot. All driveways shall have a concrete, asphalt or similar hard surface finish. OTHER STRUCTURES Any non-approved building is not permitted on a Northlake Home Lot outside of the permitted construction period. This includes containers. www.northlake.co.nz 3

APPROVAL PROCESS Owners shall not erect any building or fence on any Northlake Home Lot unless NDL has issued a set of Approved Building Plans for that Lot and such building must comply with the Approved Building Plans as issued by NDL. Owners or their agent shall submit the Approved Building Plan Request Form (available from www.northlake.co.nz) and the relevant fees (see below) to NDL. Owners will need to produce a site plan which must comply with the setbacks as specified in the Approved Building Plans and their Northlake Home Lot. Owners are then responsible for the application to QLDC for a building consent based on the Approved Building Plans and their site plan. The Owner shall contact NDL when they have obtained the necessary QLDC code of compliance certificates for the Northlake Home in order for NDL to assess compliance with the Approved Building Plans. The relevant Owner shall allow NDL reasonable access for the purposes of carrying out an inspection. Note: the construction of a dwelling that does not fully comply with the Approved Building Plans will need to be rectified at the Owner(s) expense. FEE The fee for submitting an Approved Building Plan Request Form to NDL shall be $500 + GST. This fee covers the issuance of a single Approved Building Plan. Where further submission(s) of Building Plans are requested, then NDL reserves the right to charge further fees in order to cover its costs. TIMING OF CONSTRUCTION Once construction has commenced, the exterior of all buildings must be completed within 12 months of the date of commencement. Completion is deemed to include affixing all exterior cladding and completing exterior painting. Landscaping and fencing must be completed within six months of the date of completion of the exterior of the dwelling. www.northlake.co.nz 4

GENERAL INFORMATION NDL AND ITS APPOINTED PROFESSIONALS When Northlake Investments Limited or its assignees no longer own any Lots within Northlake, then NDL shall use reasonable endeavours to assign responsibility of the Guidelines to a residents association or similar (if one exists) or to a committee of Owners on a basis to be agreed. In any event, NDL s responsibility shall cease on the date 15 years after the first title in Northlake is issued. WAIVER NDL may, if it sees fit and whilst having regard to the unique circumstances of each Northlake Home Lot: o Alter or waive any of the processes set out in these Guidelines; and/or o Waive or vary any of these Guidelines (provided it is satisfied that the end result is consistent with the overall vision for its development at Northlake in its sole discretion). NDL shall not be liable to any Owner or any other person for any loss, damage, claim or expenses (including where such loss, damage, claim or expense arises from the approval or non-approval of an application under these Guidelines, any failure to meet the timeframes stated in these Guidelines or performing any function under or in relation to these Guidelines). NDL shall be entitled to amend or add to these Guidelines from time to time without notice. Fees may be amended by NDL at any time without notice, but in any event shall represent the reasonable cost to NDL in connection with the Design Control Approval process. FEE & CONSTRUCTION BOND DETAILS Processing Fee of $500 + GST To review and process the plan set with reference to the Northlake Design Control Guidelines. This fee covers the issuance of a single Design Control Approval Construction Bond of $1000 To provide for remedial or reinstatement works that may be needed as a result of the owner s construction activities on site (including the builder and any subcontractor working at the site or any adjacent area). The bond is payable to Northlake Developments Limited (NDL). The bond will be held by NDL and will become repayable when: o the building work is fully complete as approved by NDL; o NDL has confirmed in writing that the owner has fully complied with the with the Design Control Approval; and o any damage to surrounding areas (public or private) that have occurred through building activities have been fully repaired or reinstated to the satisfaction of NDL. In the event that the owner has not complied with the Design Control Approval and/or there has been damage caused to surrounding areas, NDL may utilise the bond in remedying such non-compliance or damage and any additional costs may also be recovered from the owner.
