Information as to the application for the issue of the Certificate of Airworthiness and the registration on the German Aircraft Register AIssue Certificate of Airworthiness - import from EU memberstate (see CR (EC) No. 748/2012 Part 21H) Proof of airworthiness: a. For brand-new aircraft: - According to 21A.163(b) Declaration of Conformity EASA-form 52 or - According to 21A.130 Declaration of Conformity EASA-form 52, validated by the LBA b. For used aircraft: - Airworthiness Review Certificate EASA-form 15a or 15b (ARC) in the original If imported with ARC Attention: Certificate of Airworthiness in the original, currently valid The declarations submitted may not exceed 60 days! Further documents required: 1. Copy of the cover sheet of the flight manual und of the page including the approved endorsement of the competent authority of a EU Member State that issued the Certificate of Production Inspection. 2. Copy of the weight and balance report including loading plan 3. The proof of compliance with the marking according to Regulation (EC) No. 748/2012 Section Q para 21A.801 (photo of the registration mark, flag and identification plate, in case of balloons of the identification plate attached to the envelope) 4. Proof of ownership in the original (see application page 2 or Bill of Sale) 5. Certificate of Cancellation or of Non-Registration in the original 6. Application Certification of Noise Protection (If necessary, before aircraft registration, a Noise Certification according to ICAO Annex 16 volume I has to be filed directly with EASA!) 7. Completed form Mitteilung für Umsatzsteuerzwecke (only in case of import of aircraft from EU Member States, with a maximum take-off weight exceeding 1,550 kg the first operation of which occurred not more than 3 months ago or which, up to now, have not been used more than 40 hours of operation. (form can be downloaded) 13. Maintenance According to Regulation (EU) No. 1321/2014, Part M an approved maintenance program has to be presented. The approval has to be submitted. According to Regulation (EU) No. 1321/2014, Part M, M.A. 302 h) 4. a LBA-approved maintenance program is not needed if the operator declares responsibility taken by himself. 14. For aircraft that were type-certificated in an EASA member state before September 28, 2003 and for which an EASA Type Certificate Data Sheet does not exist, the following documentation is in addition to be submitted: A national TC/TCDS of a EU Member State including approvals with incorporated modifications (e.g. STCs) A current statement of the Certification Office that the TC is currently valid. Note: We would like to pay attention to the fact that after deletion from the aircraft register followed by a re-certification of the aircraft or a change of the operator, a new application for approval of the maintenance programme is required. Issue Certificate of Airworthiness - import from a Third Country (see CR (EC) No. 748/2012 Part 21H) Proof of airworthiness: a. For brand-new aircraft: Declaration of the competent authority of the exporting country that the aircraft corresponds to a design approved by EASA (e.g. CofA for Export) b. For used aircraft: Declaration of the competent authority of the exporting country on the airworthiness of the aircraft (e.g. the aircraft is airworthy yes/no or CofA for Export) and Airworthiness Review Certificate EASA-form 15a or 15b (ARC) in the original. Please contact a Continuing Airworthiness Management Organisation (CAMO) Attention: The declarations submitted may not exceed 60 days! (Exception CofA for Export U.S.A. and ARC => 1 year) Further documents required: 1. Copy of the cover sheet of the flight manual und of the page including the approved endorsement of the competent authority of an EU Member State that issued the Certificate of Production Inspection. 2. Used aircraft: former records according to Section H para 21A.174 (b)(3) to prove compliance with the production, modification and maintenance standards of the aircraft (Certificate of Production Inspection, ADs/STCs and latest proof of compliance of the annual airworthiness inspection); in connection with a restricted Certificate of Airworthiness: additionally all restrictions according to Section H para 21A.184 (c) 3. Copy of the weight and balance report including loading plan 4. The proof of compliance with the marking according to Regulation (EC) No. 748/2012 Section Q para 21A.801 (photo of registration mark, flag and identification plate, in case of balloons of the identification plate attached to the envelope) 5. Proof of ownership in the original (see application page 2 or Bill of Sale) 6. Certificate of Cancellation or of Non-Registration in the original 7. Firms, individually-owned firms, community ownerships including partnerships under the Civil Code Before filing an application it is absolutely necessary to check the existing Registration Certificates of all your aircraft regarding the actual address and, perhaps, apply for change to the right address! I. Firms In addition to the application the following documents are required: a) a copy of the extract from the commercial register (foreign extracts must be translated and certified in German or English language!) and b) a declaration signed by the organs authorized to represent the firm Example: Our firm is registered with the local court (name, details of registration, no.) with the following designation: (name, legal form, head office). It is confirmed that, for the firm, the conditions according to 3 para. 1 LuftVG (Air Navigation Act) are fulfilled. The limited partners (individually liable partners, authorized representatives etc.) of our firm are: (First name, family name, address, nationality, percentage shares, signatures). Firms being in the process of foundation cannot be registered on the aircraft register ( 11 GmbHG! /limited liability company in foundation) II. Individually-owned firms Individually-owned firms can only be registered upon presentation of an extract from the commercial register or a business licence (foreign extracts/licences must be translated and certified in German or English language!) Without these proofs an entry can only be carried out for an individual person. III. Associations An entry in the aircraft register can only be carried out upon presentation of a copy of the extract from the association register (foreign extracts must be translated and certified in German or English language!) Flight groups or subdivisions within an association without an own extract from the association register cannot be registered. IV. V. Ownership communities including partnerships under the Civil Code Ownership communities are co-ownership communities, partnerships under the Civil Code and associations having no legal personality. All owners have to be entered in a list (see page 3) starting with the leading one with their first name and their family name, their address and the correspondent shares in the ownership. This list and the proof of acquisition of ownership have to be signed by all co-owners. Authorized representative The power of attorney has to be presented in the original VI. Registration of pledge of rights Pledge of rights of aircraft are not entered in the aircraft register, but in the register of pledge of rights at the Local Court Braunschweig. To enter this register after the change of ownership referring to 82 LuftfzRG the previous owner has to give his written consent referring to 82 LuftfzRG.
