Ardrossan/Saltcoats/Stevenston Local Plan Area 1.1 N/01/00369/PP: Saltcoats: 2A Winton Street Mr A Arcaro, 6A Academy Road, Irvine has applied for planning permission for a change of use from shop to form a hot food takeaway at 2A Winton Street, Saltcoats. The Sub Committee agreed to grant the application, subject to the following conditions:- 1. That within one month of the date of this approval the applicant shall submit for the approval of North Ayrshire Council as Planning Authority, detailed plans for the installation of activated carbon filters within the extraction system of the premises and which filters shall be fully installed within one month of receiving written approval of North Ayrshire Council as Planning Authority; 2. That the use hereby permitted shall not operate between the hours of 9.30 p.m. in any day and 8.00 a.m. the following day; and 3. That the planning permission hereby granted shall ensure not for the benefit of the land to which it relates but for the benefit of the applicant only. Page 1

Arran Local Plan Area 2.1 N/01/00607/PP: Whiting Bay: Hawthorn Quarry, Dyemill Forrest Hawthorn Quarry, Dyemill Forest, Whiting Bay have applied for planning permission for the winning and working of minerals including rock removal to reduce the level of the existing quarry floor for engineering purposes and processed products and in terms of the Environmental Impact Assessment (Scotland) Regulations 1999 have requested a screening opinion on the need for an Environmental Statement for the proposed development. The Sub Committee agreed that the planning application does not require to be accompanied by an Environmental Statement. 2.2 N/01/00667/PP: Shannochie: Craigdhu Farm Cottage Craigdhu Farm Cottage, Shannochie have applied for planning permission for the demolition of an existing prefabricated concrete cottage and erection of a bungalow at that address. The Sub Committee agreed to grant the application subject to the following conditions:- 1. That the driveway shall be a minimum of 6 metres long; 2. That the proposed dwellinghouse shall be provided with an adequate and wholesome water supply, details of which shall be submitted for the written approval of North Ayrshire Council as Planning Authority prior to the commencement of the development; and 3. That effluent disposal arrangements shall comply with the current Code of Practice BS6297:1983, with septic tank effluent discharged to the stream via an extensive partial soakaway arrangement and with surface water excluded from the septic tank to the satisfaction of North Ayrshire Council as Planning Authority. 3. Irvine/Kilwinning Local Plan Area 3.1 N/01/00425/PP: Irvine: Old Perceton: Lawthorn Timber Sheds Lawthorn Timber Sheds, Old Perceton, Irvine have applied for planning permission for a change of use of amenity open space and erection of a steel framed building for the manufacture of timber sheds at that address. An objection has been received from R. G. Punton, Lawthorn Bank, 8 Old Perceton, Irvine. The Sub Committee, having considered the terms of the objection, agreed to grant the application, subject to the following conditions:- Page 2

1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of the proposed external finishes; 2. That the premises shall be used for the purposes of the manufacture, display and sale of garden furniture and timber sheds and for no other purpose (including any other purpose in Class 5 of the Schedule to the Town and Country Planning (Use Classes) (Scotland) Order 1997 or in any provision equivalent to that Class in a statutory instrument revoking or re-enacting that Order); 3. That no machinery shall be operated on the premises between the hours of 5.00 p.m. in any one day or 9.00 a.m. the following day, Monday to Friday and not at all on Saturday or Sunday; 4. That all activities associated with the manufacture of garden furniture and timber sheds shall be carried out within the building; 5. That prior to the commencement of the use of the premises the ventilation system indicated on drawing 55-01-01a, which system shall be ducted and vented to the north side of the building; 6. That there shall be no external storage of waste unless within approved containers; 7. That prior to the commencement of the use two alternative parking spaces shall be provided within the site at a suitable location to be agreed in writing with North Ayrshire Council as Planning Authority; 8. That the treatment of the boundary enclosures shall be agreed in writing with North Ayrshire Council as Planning Authority prior to the commencement of any works; 9. That no surface water shall issue from the access onto the public road; The Principal Development Control Officer indicated that a recent site investigation on 4 December 2001 had discovered that the public sewer, referred to in the West of Scotland Water's response to the application, is in fact a major public sewer which requires a five metre protection zone. The building will therefore be moved by 3.45 metres nearer the boundary (previously 6.5 metres) with property No. 8 Old Perceton. The two parking spaces are to be relocated to the north west corner where the sewer is located. This is outwith the site operational area, in line with recommendations from the Council's Head of Roads. Whilst the new position will be closer to the property at No. 8 Old Perceton, it is acceptable as it is an improvement to the original building adjoining No. 8 Old Perceton. As Page 3

there is however a fire escape door on this side, a condition is necessary requiring the door to be closed at all times, other than in emergency situations, to ensure any noise is contained within the building. The Sub Committee agreed to grant two additional planning conditions Nos. 10 and 11) to ensure that the public sewer within the site is protected from development and to maintain control over the development in the interest of the amenity of the area, as undernoted:- 10. That the building shall be sited so as to be a minimum of 5 metres from the public sewer which traverses the north west corner and prior to the commencement of any works a 1:200 Block Plan shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority; and 11. That the fire escape door in the south elevation shall be kept closed at all times other than in emergency situations. 3.2 N/01/00586/LUE; Irvine: 9 Burns Street Ms T Weidegar, 9 Burns Street, Irvine has applied for a Certificate of Lawfulness for the replacement of existing windows and installation of a new patio door at the address. The Sub Committee agreed that a Certificate of Lawfulness for an existing operation be issued for the replacement of nine windows (five to rear and four to front elevations) and installation of patio doors to the rear of 9 Burns Street, Irvine, as shown on drawings 1L and 2L on the basis that the operations were carried out more than four years ago and as such are immune from enforcement action. 3.3 N/01/00599/PP: Kilwinning: 96 Main Street Global Gaming Corporation, c/o Atlantis, 1 the Promenade, Largs have applied for planning permission for a change of use and alterations to vacant shop unit to form an amusement centre at 96 Main Street, Kilwinning. Objections have been received from E. McDowall (First Quench Retailing Ltd), Nurseryland, Alan's Cafe, G. Peppen (R.S. McColl) and J. Porter (No 0 Social Club), Palmer Brothers Ltd, all of Main Street, A. Paterson, Intrigue, 6 Abbeygate, Buzzworks Group, Byres Road and J. Jamieson, Chairman, Kilwinning Development Association, 130 Main Street, The Session Clerk, Abbey Church, M. Hearne, 4 Rosemount, E. Guthrie, 33 Killermont Place, A. Craig, 25 Corsehill and K. Clements, 30 Winton Avenue, all of Kilwinning. The Sub Committee, having considered the views of the local member agreed to continue consideration of the application to the full Council meeting. 3.4 N/01/00795/PP: Kilwinning: Pathfoot: Site to the South of 6 Page 4

Mr C Dynes, 3A Stevenston Road, Kilwinning has applied for planning permission for the erection of a one and a half storey dwelling house at the site to the south of 6 Pathfoot, Kilwinning. The Sub Committee agreed, subject to no material planning objections being received by 14 December 2001, to grant the application, subject to the following conditions:- 1. That prior to work recommencing on site, the developer shall afford access at all reasonable times to any archaeological organisation acceptable to the planning authority, and shall allow them to observe work in progress and record items of interest and finds. Notification of the commencement date, information as to whom the West of Scotland Archaeology Service should contact on site and the name of the archaeological organisation retained by the developer shall be given to the planning authority in writing not less than 14 days before development recommences; 2. That the existing stone wall on the site frontage adjacent to the A737 shall be made good where necessary and thereafter retained all to the satisfaction of North Ayrshire Council as Planning Authority; and 3. That within one month of the date of this permission, a specification of the material to be used externally on the roof of the dwellinghouse hereby approved shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. 4. North Coast and Cumbraes Local Plan Area 4.1 N/01/00264/PP and N/01/00267/LBC: Largs: Fairlie: 33 Main Road Mr S Adam, 33 Main Road, Fairlie has applied for planning permission for an extension to a dwelling house to form 3 bedrooms, a nursery and a bathroom at that address. Objections have been received from Mrs S W Mercer, 6 The Causeway, R McTear, 5/7 The Causeway and R. Heanon, 1 Ferry Row, all of Fairlie. The Sub Committee, having considered the terms of the objections, agreed (a) to grant application N/01/00264/PP, subject to the following conditions:- 1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority (i) exact details or samples of the proposed wall, door and window finishes; (ii) exact details of the proposed wall/fence boundary enclosure along the south and west boundaries of the site; and (iii) alternative proposals for the colour finish to the blanked out openings on the north wall of the existing building; Page 5

2. That the roofing material shall be natural slate; 3. That the existing wall along the east boundary of the site shall not be altered, lowered or removed without the prior written approval of North Ayrshire Council as Planning Authority; and Page 6

4. That all pedestrian and vehicle access to the site shall be solely from The Causeway and prior to the occupation of the house the proposed wall/fence approved under condition (1)(ii) above, shall be erected and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority; and (b) to grant application N/01/00267/LBC, subject to the following conditions:- 1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority (i) exact details or samples of the proposed wall, door and window finishes; (ii) exact details of the proposed wall/fence boundary enclosure along the south and west boundaries of the site; and (iii) alternative proposal for the colour finish to the blanked out openings on the north wall of the existing building; and 2. That the roofing material shall be natural slate. 4.2 N/01/00571/PP: West Kilbride: 55 Main Street Mr A Morrison, 151 Chapelhill Mount, Ardrossan has applied for retrospective planning permission for a change of use of shop to form a taxi office at 55 Main Street, West Kilbride. The Sub Committee agreed to grant the application, subject to the condition that the public waiting area shall not be open for use between the hours of 8.00 p.m. in any day and 8.00 a.m. the following day. 4.3 N/01/00618/PP: Skelmorlie: Paddockdyke: 20 and 21 Mr D Evans, 115 Greenock Road, Bishopton, Renfrewshire has applied for planning permission for the erection of 2 dwelling houses at 20 and 21 Paddockdyke, Skelmorlie. Representations have been received from W A Moodie, 23 Annetyard Drive and J C Purves, 21 Annetyard Drive, both of Skelmorlie. The Sub Committee, having considered the terms of the representations, agreed to grant the application, subject to the following conditions:- 1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of (i) the proposed facing brick and roof tile finishes to the houses; and (ii) the parking layout and parking area surface finish; 2. That prior to the commencement of the development the applicant shall (i) submit for the written approval of North Ayrshire Council as Page 7

Planning Authority full details of proposals for the disposal of excess lying water within the site; and (ii) construct the approved surface water drainage system to the satisfaction of North Ayrshire Council as Planning Authority; and 3. That no trees or hedges on the site shall be felled or lopped without the prior written approval of North Ayrshire Council as Planning Authority. 5. Argyll and Bute Structure Plan - Finalised Plan - "Developing Our Future" Submitted report by the Assistant Chief Executive (Development and Promotion) on the Council's proposed response as neighbouring Planning Authority on the Argyll and Bute Structure Plan. The Sub Committee agreed to make no objection or representation to the Scottish Executive and to advise Argyll and Bute Council of this position by 7 January 2002.
