12.2.1 INTRODUCTION: 12.2.1.1 The purpose of this standard is to define responsibilities and accountability when non-kuc Rio Tinto Groups (and their contractors and subcontractors) access and / or do work in KUC operating facilities. 12.2.2 DEFINITIONS: 12.2.2.1 Rio Tinto Groups covered under this standard include: o Communications & External Relations (C&ER) o Information Systems and Technology (IST) o Kennecott Land Company (KLC) o Rio Tinto Exploration (RTX) o Rio Tinto Procurement (RTP) o Rio Tinto Shared Services (RTSS) 12.2.2.2 Rio Tinto employees - The following are the identified Rio Tinto Groups and their associated work elements: Group 1 Rio Tinto Visitors - Include Rio Tinto Employees and / or tours arranged / conducted by Rio Tinto employees in KUC operating facilities. Primarily this applies to the C&ER Group conducting tours and visits but also applies to any non-kuc group on a short term visit. Group 2 - Rio Tinto Managed Contractors Contractor groups managed by Rio Tinto employees include: a. RTSS Security services manage a direct service contract to KUC. b. IS&T - Site Communications manage contractors working in KUC operating facilities. Group 3 - Rio Tinto employees working in KUC Operating Facilities This group enters KUC operating facilities to perform work or a service and is not directly supervised by KUC: a. RTP Warehouse employees (work in warehouse facilities located in the Mine, Smelter and Concentrator) and RTP delivery drivers (deliver parts and materials to multiple drop points through out the facilities). b. IS&T Site Communications and Network support team (Offices and shops located at the KUC Lark gate and / or Regional Center - may work in all areas of KUC). 12.2.2.3 Qquirrh Mountain Non-Operational Areas HSE Access Protocol A Health and Safety access protocols developed by Kennecott Land Company (KLC) Page 1 of 5

for the Non-Operational areas of the Oquirrhs which cover groups such as Rio Tinto Exploration (RTX). 12.2.3 REQUIREMENTS / RESPONSIBILITIES: 12.2.3.1 The following requirements must be implemented and utilized by all Rio Tinto Groups entering a KUC facility. o Incident Management Requirements include: - Maintain records of personal and next of kin information for all Rio Tinto employees entering KUC facilities and in the event of an injury or incident make any and all required secondary notifications. - Have procedures in place to provide follow-up care (Hospital or Industrial Care Facilities) and follow-up communication to KUC management. o Rio Tinto Reporting Requirements include: - Complete all required Rio Tinto reporting and communication requirements as per the appropriate Rio Tinto Work Cycle including: - Following the Rio Tinto 24 hour reporting requirement for major and catastrophic incidents. - Completing all incident reports entered into the Business Solution to a closed status. - Completing all Rio Tinto communications (i.e. SEART and Knowledge Share). 12.2.3.2 Additional specific required safety controls must be implemented and utilized by each Rio Tinto Group as follows: Group 1 Rio Tinto Visitors o General Notification The Group shall obtain appropriate KUC management approval for a facility tour / visit and coordinate with a designated KUC escort. The KUC escort is responsible to ensure that all appropriate Hazard Training has been completed, PPE requirements are identified and checked, and to remain with the group at all times while in operating facilities. o Incident Management Requirements - Report all incidents to the appropriate KUC escort and to the Group management. Group 2a RTSS Security Services provide a direct service contract to KUC. This group is engaged under contract to provide specific services within the operation and must meet all requirements defined in the KUC Safety and Health Standard 14.1. Page 2 of 5

Group 2b - IS&T Rio Tinto Communications managing contractors in operating facilities. o General Notification This Group shall coordinate all work through a designated KUC facility contract coordinator from start-up notification to closeout of project. The KUC facility contract coordinator is responsible for Permit to Work and communication with the KUC operations. o Incident Management Requirements include: - Reporting all incidents (except near misses) to the appropriate KUC facility Control Center (CC) and to the Group management. - Maintaining the appropriate First Aid supplies as required by risk assessment and Rio Tinto and KUC standards / requirements. - Completing incident investigations and taking the appropriate action to prevent recurrence. o Regulatory Requirements include: - Injuries The contractor company is responsible for all regulatory required reporting and recording of any injury on their project. - Regulatory Compliance the contractor company is responsible for all regulatory compliance issues and would be cited directly as an independent contractor. - All contractor companies working in MSHA jurisdiction facilities are required to have a MSHA Contractor ID numbers. Group 3 (a and b) - Rio Tinto employees working in the KUC Operating Facility 3a - RTP Warehouse employees and RTP delivery drivers 3b - IS&T Site communications and Network support team o General Notification Requirements include: - Group 3a Is required to notify KUC of any changes in scope of work. The KUC Facility Safety Advisor is responsible for communicating any changes in facility HS requirements, procedure or policies. - Group 3b Shall notify KUC area supervisor when entering operating facility. The KUC area supervisor is responsible for the Permit to Work, if applicable. o Group 3 Incident Management Requirements include: - Reporting all incidents (except near misses) to the appropriate KUC facility Control Center (CC) and to report all incidents to the Group management. - Completing an incident investigation and taking the appropriate action to prevent recurrence, filing all the required workers Page 3 of 5

compensation and regulatory reports, and managing all workers compensation claims. o Group 3 Regulatory Reporting requirements include: - In the event a Rio Tinto Employee working at KUC sustains a reportable injury, the Rio Tinto group is responsible for completing, filing, and maintaining all required regulatory reports. - MSHA Jurisdiction facilities - Group 3 could be considered a Miner depending on where they were working. Currently there is not a requirement for this group to obtain a MSHA Contractor ID number; any potential MSHA issue will be handled on a case by case basis. o Group 3 Regulatory Actions - resulting from inspections, investigations, and / or employee complaints could result in citations, orders, civil and / or criminal action. Controlling company duel citation action is possible if there is a KUC employee exposure. - OSHA Jurisdiction facilities the Rio Tinto Group is responsible for compliance issues; however KUC would likely be accountable for potential citations. - MSHA Jurisdiction facilities - KUC would likely be responsible. Currently there is not a requirement for this group to obtain a MSHA Contractor ID number; any potential MSHA issue will be handled on a case by case basis. o Group 3 Regulatory Training Requirements - Groups are responsible for knowing and complying with all regulatory training requirements. o Group 3 Occupational Health & Industrial Hygiene Groups are responsible for conducting a risk assessment to ensure all potential health and safety hazards are adequately address; the assessment must be reviewed and approved by the Rio Tinto BU and KUC Safety prior to commencing work. The assessment must address all regulatory compliance monitoring i.e. exposure monitoring, respirator fit testing, hearing conservation monitoring and audiometric testing etc. and the Rio Tinto Health Standards to determine compliance with the Workplace Monitoring and Fit for Work. 12.2.3.7 KUC responsibilities include: o Incident Management - In the event an incident is reported, the KUC facility CC operator is responsible for initiating appropriate primary emergency response as per the facility Emergency Response Plan. (Includes MSHA notification, if required) and entering initial report into the Business Solution. The CC operator will also make secondary notifications to the appropriate KUC personnel. - KUC will provide onsite emergency first aid coverage (EMT / ERT), as needed. Page 4 of 5

- KUC will conduct an investigation (where there is plant interface or involvement i.e. equipment, personnel) and take appropriate action to prevent recurrence. o Rio Tinto Reporting Requirements - For injury reporting, a person must be assigned to a single business, facility or location, regardless of whether they work at more than one location. Any injury resulting to that person would be reported by the assigned business to Rio Tinto HSE regardless of where (the location of the incident) occurred. - If a Rio Tinto employee is working at another Rio Tinto business (other than on secondment) and is injured or taken ill, the injury or illness statistics must be reported by the employees own business to Rio Tinto HSE. (See Rio Tinto Work Cycle WCMS1401) - KUC requirements include following the Rio Tinto reporting requirements for Group 2a employees. Also, the KUC facility Safety Advisor is responsible for completing all incidents to a closed status and for reporting and classifying all Group 2a injuries. o Regulatory Reporting - Currently there is not a requirement for Group 3 to obtain a MSHA Contractor ID number; any potential MSHA issue will be handled on a case by case basis. o Regulatory Training Requirements - KUC is responsible for providing site specific Hazard Training for all personnel entering company property.
