Civil Aviation (Aviation Security) (Application) Order 2017 Article 1 Statutory Document No. 2017/0230 Airports and Civil Aviation Act 1987 CIVIL AVIATION (AVIATION SECURITY) (APPLICATION) ORDER 2017 Approved by Tynwald: Coming into Operation: 1 November 2017 The Department of Economic Development makes the following Order under section 11A of the Airports and Civil Aviation Act 1987. 1 Title This Order is the Civil Aviation (Aviation Security) (Application) Order 2017. 2 Commencement If approved by Tynwald, this Order comes into operation on 1 November 2017. 3 Interpretation In this Order and the legislation applied by it "appropriate authority" means the Department of Economic Development. 4 Application of European legislation to the Island The following instruments shall apply to the Island as part of the law of the Island, subject to the exceptions, adaptations and modifications specified in Schedule 1: (a) (b) Commission Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on common rules in the field of aviation securityl. Civil Aviation (Aviation Security) (Application) Order 2017 SCHEDULE 1 SCHEDULE 1 MODIFICATIONS TO THE LEGISLATION APPLIED BY ARTICLE 4 [ARTICLE 4] PART 1 GENERAL MODIFICATIONS 1 References to a "Member State" shall be taken as including the Isle of Man and the Island shall be treated for this purpose as a Member State separate from the UK. PART 2 EXCEPTIONS, ADAPTATIONS AND MODIFICATIONS TO COMMISSION REGULATION (EC) NO 300/2008 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 11 MARCH 2008 ON COMMON RULES IN THE FIELD OF AVIATION SECURITY 1 Article 2 paragraph 2 is omitted. 2 In Article 4 paragraph 1, for m the Annex Ela substitute En Annex I al. 3 In Article 4 omit En Additional common basic standards not foreseen at the entry into force of this Regulation should be added to the Annex in accordance with the procedure referred to in Article 251 of the Treaty. EEI 4 In Article 4, for paragraph 4 substitute En Member States may derogate from the common basic standards referred to in Article 4(1) and adopt alternative security measures that provide an adequate level of protection on the basis of a local risk assessment at airports or demarcated areas of airports where traffic is limited to one or more of the following categories: (a) aircraft with a maximum take-off weight of less than 15 000 kg; (b) (c) (d) helicopters; law enforcement flights; fire suppression flights; SD No.2017/0230 Page 5

SCHEDULE 1 Civil Aviation (Aviation Security) (Application) Order 2017 (e) (f) (j) flights for medical services, emergency or rescue services; research and development flights; flights for aerial work; humanitarian aid flights; flights operated by air carriers, aircraft manufacturers or maintenance companies, transporting neither passengers and baggage, nor cargo and mail; flights with aircraft with a maximum take-off weight of less than 45 500 kg for the carriage of own staff and non farepaying passengers or goods as an aid to the conduct of company business. The Member States shall inform the Commission of such measures. Ela 5. Articles 8, 9, 16, 17, 18, 20, 22, 23, 24 are omitted. 6. Explanatory Note Civil Aviation (Aviation Security) (Application) Order 2017 EXPLANATORY NOTE (This note is not part of the Order) The Isle of Man is recognised by the EU as applying security standards equivalent to the EU common basic standards. Additionally, flights to and from the Island are afforded domestic status by the UK. In support of maintaining the Island's EU recognition and UK domestic status, the applicable legislation in the Isle of Man must reflect that in place in the EU and UK. This Order applies to the Isle of Man with modifications - (a) Commission Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on common rules in the field of aviation security and its amending regulations. (b) Commission Regulation (EC) No 272/2009 of 2 April 2009 supplementing the common basic standards on civil aviation security laid down in the Annex to Regulation (EC) No 300/2008 of the European Parliament and of the Council, and its amending regulations. (c) Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security and its amending regulations. It replaces Section 4 of the Civil Aviation (Application) Order 2013 (SD 232/13) which applied: (a) Commission Regulation (EC) No 300/2008 of 11 March 2008 on common rules in the field of aviation security; (b) Commission Regulation (EU) No 185/2010 of 4 March 2010 laying down detailed measures for the implementation of the common basic standards on aviation security; (c) Commission Regulation (EU) No 357/2010 of 23 April 2010 amending Regulation (EU) No 185/2010 of 4 March 2010 laying down detailed measures for the implementation of the common basic standards on aviation security. The Order ensures that current European Union legislation on aviation security with modifications apply to the Island as part of the law of the Island. As required by Section 11 of the Airports and Civil Aviation Act 1987, a text of the legislation applied by the Order has been prepared and is available on request from the Department of Economic Development.
