Grand Port Maritime de La Martinique Harbour Dues n 004 Year 2017 articles 1-4, and 9 SECTION 1: SHIP S DUES ARTICLE 1 - Conditions for charging dues 1.1. Rates are applicable to all commercial vessels; dues vary according to the harbour area. Rates are in euros per metre cubed, calculated as indicated in article R.5321-20 of the Transport Code. Article R. 5321-20 of the Transport Code (1st of January 2015) The basis for calculating the fees for a vessel is the volume V established on the basis of its physical characteristics, using the following formula: V = L x b x d Where V is expressed in cubic metres, L, w, and d represent the overall length, beam (maximum width), and maximum draught (vertical distance from the bottom of the keel to the waterline of the vessel) respectively, expressed in meters and decimetres. The maximum draught of the vessel used to apply the formula above cannot, in any case, be less than a theoretical value equal to: 0,14 x (L x b ) 1/2 (L and b being the overall length and maximum width of the vessel, respectively) For hovercraft, the basis of the dues applicable to the vessel is the volume V, established on the basis of the formula in paragraph 1, considering a standard draught of one metre. Dues are determined in each harbour according to the volume of the vessel in cubic metres or in multiples of cubic metres. Dues may vary according to the type of vessel, as indicated by the decree mentioned in article R. 5321-10, their arrangement and it s intended purpose. A specific rate is applied when a vessel only carries out bunkering operations, loads stores or unloads operating waste or cargo residues. Rates may vary according to the harbour area in question. In application of the provisions of article R. 5321-21 of the Transport Code, in case of multiple uses the type of vessel is determined by considering the main landing and transhipment operations carried out by the vessel in the port. The deciding factor is the total number of tonnes of cargo landed, loaded or transhipped according to various uses.

The various port zones outlined in paragraph 1.1 of this article are defined as follows: Zone A: Pointe des Grives Zone B: Pointe Simon Zone C: Historic districts (Carénage, Tourelles, Hydrobase, Pte des Carrières) Zone D: The mouth of the River Monsieur Zone E: Cohé du Lamentin Zone F: Bellefontaine Wharf Zone Z: All other zones not mentioned above 1.3 - When a vessel lands or tranships passengers or cargo in more than one port zone successively, it is liable to pay ship's dues once, in the zone applying the highest fees. The type of vessel and any modifications or reductions applicable are determined by considering all of the landing and transhipment operations carried out by the vessel in the port. The same provisions are applicable when a vessel loads or tranships passengers or cargo in more than one port zone. These provisions do not apply to vessels landing cargo or passengers in one port zone and transhipping cargo or passengers in another port zone. 1.4. When a vessel does not land or tranship passengers or cargo, the ship's dues are only paid once. This provision does not apply to cruise ships in transit which disembark passengers during a stop over and who are liable to pay ship s dues upon arrival and departure. 1.5 - Ship's dues are only paid once, on departure: - When a vessel does not carry out any commercial operations, - When a vessel only carries out bunkering operations or loads stores, or unloads operating waste or cargo residues. In this case, the dues are charged as specified in the table in article 1, paragraph 1.1, with a maximum of 0,0395 /m3. Ship s dues must be paid or payment guaranteed before the ship s departure. 1.7 - In application of the provisions of article R. 5321-22 of the Transport Code, ship's dues are not applicable to the following vessels: - Vessels assigned to provide assistance to other vessels, particularly pilot, towing, mooring, and rescue vessels; - Vessels assigned to waste collection and pollution control; - Vessels assigned to dredging, marine aids to navigation, fire fighting, and administrative services; - Vessels forced to take refuge that do not carry out any commercial operations; - Vessels that cannot access a port facility and are obliged to carry out landing, loading, or transhipment operations outside the port; - Vessels assigned to cultural or humanitarian missions, or presenting a general interest for maritime heritage. 1.8 - In application of the provisions of article R. 5321-51 of the Transports Code: - Minimum payment for harbour dues is 16 - The threshold for payment of harbour dues is 9. That is to say that: Harbour dues are not payable if the amount calculated doesn t exceed 9, 16 is due if the amount calculated is between 9 and16 The amount due is equal to the amount calculated if the latter exceeds 16

Grand Port Maritime de La Martinique Harbour Dues n 004 Year 2017 articles 1-4, and 9 ARTICLE 2 - Provisions concerning modifications in the ratio of the real load to the capacity of the ship in its main activity, by type and size of ship, in application of paragraphs 1-3 of article R. 5321-24 of the Transport Code. 2.1. For type 1 and 2 passenger vessels, the fee reductions are calculated according to the ratio of number of passengers landed, loaded, or transhipped over the vessel's total passenger capacity as follows: Ratio inferior or equal to 2 / 3.... deduction - 10 %, Ratio inferior or equal to 1 / 2.... deduction - 30 %, Ratio inferior or equal to 1 / 4.... deduction - 50 %, Ratio inferior or equal to 1 / 8.... deduction - 60 %, Ratio inferior or equal to 1 / 20... deduction - 70 %, Ratio inferior or equal to 1 / 50... deduction - 80 %, Ratio inferior or equal to 1 / 100... deduction - 95 %, For cruise ships, it is reiterated that a passenger on a one-day stopover is in transit and is therefore considered as disembarked once the ship enters the harbour and aboard once the ship has left the harbour. It must therefore be included amongst the number of passengers determining the above reductions on arrival as well as on departure. 2.2. For vessels carrying cargo, the fee reductions are calculated according to the ratio of number of tonnes of cargo landed, loaded or transhipped over the ship s volume (V), as indicated in article R. 5321-20 of the Transport Code. For type 3 and 12 vessels transporting cargo, when the number of tonnes of cargo landed, loaded or transhipped over the ship s volume (V) calculated as indicated in the aforementioned article R. 212-3, is equal or inferior to the ratios below, the fee on arrival and on departure varies as follows: Ratio inferior or equal to 2 / 15... deduction - 10 %, Ratio inferior or equal to 1 / 10... deduction - 30 %, Ratio inferior or equal to 1 / 20... deduction - 50 %, Ratio inferior or equal to 1 / 40... deduction - 60 %, Ratio inferior or equal to 1 / 100... deduction - 70 %, Ratio inferior or equal to 1 / 250... deduction - 80 %, Ratio inferior or equal to 1 / 500... deduction - 95 %, 2.3. The reductions mentioned in articles 2.1 and 2.2 above do not apply to vessels carrying out bunkering operations, loading stores, or unloading operating waste or cargo residues.

Grand Port Maritime de La Martinique Harbour Dues n 004 Year 2017 articles 1-4, and 9 ARTICLE 3 - Provisions for modulating fees depending on the frequency of calls, in application of article R. 5321-24, paragraph V, of the Transports Code 3.1 - Vessels on regular, public services, with routes and timetables published in advance, are entitled to the following deductions on the fees per type of vessel, depending on the number of departures per calendar year: From the 1st... to the 6th... departure included: no reduction From the 7 th... to the 15th... departure included: reduction of 20 % From the 16th.. to the 30th... departure included: reduction of 30 % From the 31st.. to the 60th... departure included: reduction of 40 % From the 61st.. to the 120th... departure included: reduction of 50 % As of... the 120th... departure... reduction of 60 % 3.2. Vessels that do not operate regular services but which use the port frequently, are entitled to the following deductions on the fees per type of vessel, depending on the number of departures per calendar year, without exceeding 30% of the fees indicated in the aforementioned part 1 of article 1. From the 1st... to the 6th... departure included: no reduction From the 7 th... to the 15th... departure included: reduction of 10 % From the 16th.. to the 30th... departure included: reduction of 15 % From the 31st.. to the 60th... departure included: reduction of 20 % From the 61st.. to the 120th... departure included: reduction of 25 % As of... the 120th... departure... reduction of 30 % 3.3. The reductions specified in this article may not be combined with those in article 2. When a vessel also meets the conditions in article 2, the most favourable terms are applied. The reductions specified in the preceding articles 2 and 3 are applied according to the base rate outlines in article 1 after all eventual reductions specified in article 4 have been applied.

Grand Port Maritime de La Martinique Harbour Dues n 004 Year 2017 articles 1-4, and 9 ARTICLE 4 - Provisions concerning the additional reduction stipulated in article R. 5321-25 of the Transports Code The reductions specified in articles 2 and 3 may be combined with an additional reduction to promote new traffic, or new intercommunity routes for passengers, fret cargo (Ro-Ro) or containers, it must not however exceed 50 % of the basic fees to which it is applied nor a period of two years. Type 1 vessels may benefit from a reduction in the ship s dues outlined in article 1 of the present tariffs: - 50% reduction for vessels which stay in the harbour - 41% reduction for cruise ships known as home porting this name is given to cruise ships when the total number of passengers who board or disembark - at each call in the port of Fort-de-France - reaches at least one third (1/3) of the ships capacity (not including passengers said to be on layover or day visitors ) - 15% reduction for cruise ships known as inter porting which board and disembark a smaller percentage of their passengers, of which the total is below the aforementioned limit but remains above 1/20 th of the ship s capacity. The reductions mentioned above may not be cumulated with one another. Each cruise line may also benefit from the reductions outlined in article 3-2 (reductions depend on the number of calls and are for vessels which don t operate on regular services) by accumulating, over the period of a calendar year, the calls of its different ships carried out in compliance with the established programme. They will benefit from a further reduction of 10%, as of the second year, if calls are programmesd for two or more consecutive years. Furthermore, vessels making tourist excursions by day in the bay of Fort-de-France or along the coast of Martinique, and which dock in the harbour of Fort-de-France to embark and disembark passengers, are exempt from ship s dues. In application of article R 5321-27 of the Transport Code, a further reduction of 30% is granted to cruise ships making a stopover in low season (from the 1 st to the 30 th of September).

Grand Port Maritime de La Martinique Harbour Dues n 004 Year 2017 articles 1-4, and 9 SECTION 3: PASSENGER FEES ARTICLE 9: Conditions for applying passenger fees as stipulated in articles R. 5321-34 to R. 5321-36 of the Transport Code 9.1. Each passenger boarded, landed, transhipped or in transit within the Fort-de-France harbour is subject to passenger fees. The harbour may recover such fees, which are to be borne by the ship owner. They are payable at the same time as the ship s dues. Passengers landed, boarded or transhipped are subject to a fee of 1,631 per passenger. 9.2. The following passengers are not subject to fees: - Children under four years old; - Military personnel travelling with their unit; - Ships crews; - Ship owners' representatives holding free transport passes and travelling on official business; - Government agents in the course of their duties on board. - Passengers coming from or heading to another port in Martinique. 9.3 The rules concerning rebates of up to 50% are as follows: - 50% for day-trippers in possession of a return ticket used within a 72-hour period - 50% for transhipped passengers - 50% for passengers who only disembark temporarily during the call of the ship

Commercial Services Pricing Guide Chapters VI and VII CHAPTER VI USER FEES FOR PASSENGER TERMINALS Fees for the use of the inter-island ferry terminal on the west quay only applies to passengers embarking in Fort-de-France: price number 6310. Since 2014 a security fee has been implemented for inter-island and cruise ship passengers: price number 6210 to 6320, since 2016 this fee has been extended to cover cruise passenger s luggage (as of the second item of luggage handled): price number 6250. As of 2017 this price will be applicable as of the first item of luggage handled (concerning only cruise passenger). Security fees are standardized at 0,70 regardless of passenger status (cruise in transit or not, inter-island) Fees for the use of the inter-island ferry terminal (price number 6310) have been brought back down from 10,39 to 9,90. The fee modifications in this chapter (VI) are applicable as of the 1 st of October 2017. CHAPTER VII - OTHER SERVICES 1 WATER SUPPLY: 1. PROVISIONING OF SHIPS: Price number: 7110 includes distribution fees The minimum purchase corresponds to a supply of 10 M³ 2. SUPPLYING of TENANTS (of premises, sheds, offices ) Is carried out at a rate of price number 7130 depending on the part of the harbour. 2 ELECTRICITY SUPPLY: Is calculated based on EDF s low voltage rate, with a 20% surcharge. The surcharge does not apply to pre-trip installations. Price number: 7200 3 - TELEPHONE, INTERNET, WI-FI: The port may, by means of its Information System connect clients to the telephone and Internet network as well as provide technical support for it s client s network. Regular telephone, Internet and Wi-Fi services are provided as well as rental equipment.
