Introduction Campeche Playa Golf Marina and Spa Resort is located in the south of Mexico, in the Yucatan Peninsula, only 45 minutes south of the historic city of Campeche. Taxation Trusts for Foreigners to Purchase Residential Property Legal Background: The ownership of real estate in Mexico by foreigners within 100km of the frontiers and in a strip of 50km along the coasts must be by way of a contract of trust in compliance with the law on foreign investments. By way of this contract, owners acquire rights of use and enjoyment over real estate located in the said areas. Characteristics of the trust: Only banks authorized by the Federal Government may carry out trust operations. In this type of contract the seller or developer, acting as settler, transfers the ownership of the real estate to a bank (trustee), receiving from the foreign acquirer the value which has been agreed. The foreign acquirer will enjoy all the uses of the property in a freehold agreement, but the bank will become the trustee in terms of complying with the provisions of article 27 in the Mexican constitution. The foreign owner retains all the rights of a traditional owner and may use it, alter it, renovate, lease/ rent or sell it as they so please. If the owner sells to another foreigner they will assign all rights to the new acquirer. A Mexican notary will be involved in this process. Regular expenses and taxes Land Tax; paid annually in the municipality at 0.12% of the rating value. Maintenance fees paid via the rental pool company or the owners association. Public services (water, electricity, etc). Trustee fees for the annual handling of the trust, (for opening, acceptance of post and signing of contract as trustee the approximate sum of US$600.00 paid as a one-off fee.) Further details on the drawing up of the trust Notary expenses approximately 1% of the value Filing fees of the Public Land Registry approximately 1% of the value of the operation Ownership transfer tax normally 2% of the value, Campeche Playa get special buyers rights of just 0.5% One-off payment amounting to US$1,500.00 for entry of the trust in the National Land Registry If a person residing abroad, either an individual or a corporation, transfers the trust rights he or it has over a property located in Mexico, income tax is payable at the rate of 28% of the capital gain, provided the foreigner appoints a representative in Mexico and the sale operation is carried out in a public deed. While the rust remains in existence the trustee is deemed to be the representative. However if the foreigner does not opt for the capital gains tax explained above and therefore does not appoint a representative in Mexico, the tax will be 25% of the value of the transfer which will be directly retained by the notary who draws up the deed. Mexico has signed conventions for the avoidance of double taxation with the UK, USA, Ireland and Canada to name but a few. This means that once they pay the tax on the said capital gained in Mexico they will not have to pay tax again in their own country. 11
