Legal Agreements South Lanarkshire Council Claire Canning and Karen Moore delivered a presentation on the method used for legal agreements by South Lanarkshire Council. It was questioned whether the conditions were challengeable, which may need to be tested further using external lawyers. Planning staff may also require additional training. 2. District Heat Network Study Visit Michael Westwater presented on the recent study tour by delegates from Perth and Kinross, Fife, Falkirk and Highland Councils of District Heat Networks around Copenhagen. 1

Workshops on district heating have been set up in Inverness and Edinburgh on 9/6/15 and 11/6/15 respectively with Resource Effective Scotland, Scottish Enterprise and the Scottish Government this is aimed at a CEO level and a follow up will be scheduled in October. MW will lead on the production of online planning advice; volunteers from the HoPS E&R subcommittee will act as a sounding board. 3. Minutes of last meeting The minutes of the last meeting were agreed upon. Document on Wind Turbine Non-Material Variation to be completed by AM will be carried forward to the next meeting. DM is now representing HoPS at the IGOR meetings Action: RG to forward Aberdeenshire Wind Farm mapping Action: TM to contact MOD regarding Policy on Wind Turbine Effect on Radar. 4. Scottish Natural Heritage Update Consultation on Spatial Planning is now closed. Responses from 18 Local Authorities were received and these were mainly positive. The redraft of the document will be published on 23/6/15 and workshops for groups of planners or councillors can be arranged. The event on the visual representation of wind farms was attended by over 60 people (20+ from local authorities). There are plans to run a second event. SNH plan to carry out research on small scale wind farms later in the year. Bruce Luftman presented to SNH on Enforcement Monitoring on 22/5/15. Action: BT to circulate his paper when available 5. Wind Farm Landscape and Visual Impact Assessment BT presented the SNH paper to the sub-committee. Action: The E&R sub-committee will be invited to take place in a scoping study to help draft guidance. 6. Ministerial Short Life Working Group on Onshore Consents The final meeting of this group has now taken place. The work on this is ongoing and the ECDU are continuing their review of published materials. A paper will be published shortly. ECDU applications are now online and can be found here on the Scottish Government website 2

7. Section 36 Model Conditions Scottish Government ECDU badging is still underway. The DPEA will be approached again to see if they wish to badge the document. 8. Bonds The Bonds document will shortly be circulated to all local authorities and made available on the HoPS Website. Elements of the method used by South Lanarkshire will also be presented in the document. Action: IA to amend page 3 of the document to take into account the appropriateness of conditions. 9. Unconventional Oil and Gas The sub-committee noted that they would like to produce an information document for unconventional oil and gas applications. Falkirk Council noted that they are likely to be dealing gasification applications shortly for the Firth of Forth. Action: RG and TM will approach authorities who are likely to receive applications to join the E&R sub-committee and possibly take lead on the production of the information document. The HoPS Development Planning sub-committee discussed the issue of how the memorandum affects Main Issues Reports. There was no conclusion on how to address this but it was noted that the Scottish Government Development Planning team can provide feedback on MIR if contacted. This will remain a standing item on the agenda. 10. Scottish Government Wind Energy Funding Simon Bonsall and Lorna Aird arranged a teleconference with TM and DS to discuss the 2011/12 SG funding provided to several local authorities to support wind energy applications. SG are looking to provide a half day event for participating authorities to provide feedback. Action: TM will contact SG to arrange dates and venues 11. Improvement Service Planning Skills Report TM presented the review of the planning skills programme in 2014/15. There will be an event on Hazardous Substances arranged with the aid of Falkirk Council later in 2015. Action: LA training requirements or ideas should be forward to TM 3

12. Scottish Water Claire Hamill of Scottish Water presented to the HoPS Development Management Sub-committee on 4/6/15. They are looking to improve their consultation process. Local authorities have been encouraged to provide feedback. 13. Scottish Government Update Coal Task force meets on 15/6/15 Energy Minister keen to secure enhanced oversight in view of national/international risk Paper on surface coal mine restoration towards effective regulation to be presented. Buy-in to paper at risk of COSLA disquiet over LA autonomy this will be discussed with officials on 10/6/15 Carbon Tax measures with UK government on restoration related to coal to be discussed SG to discuss 40k grant to HoPS in 2014/15 with Improvement Service on 24/6/15. Better scoping for the EIA already being discussed with SEPA and SNH Wind Energy 14 month study into review of visual noise and shadow flicker effects. Steering group meeting held on 20/5/15 and next is on 15/6/15 Further guidance on wild land descriptions has been undertaken by SNH Wind farm monitoring (post-consent) to be discussed with ministers 11/6/15. Idea of developer funded PMOs is top suggestion rather than any centralised method Community shared ownership to be discussed with minister 1/9/15 Wind Farm Repowering RIAG sub-group to meet again in the summer technical paper on planning and consents and repowering has been prepared by Frances Pacitti in ECDU. Ken McCorquodale represents HOPS Minerals Scottish Aggregates Survey (2012 data) close to publication. Discussions to be held about industry appetite for continued surveys and how to finance (either at SG level or UK (AMRI) level) from available resources. Would be helpful if HOPS E&R could gather information from planning authorities about how they conduct data gathering on production and distribution for planning purposes with the industry. SG s grant of 20k to HoPS in 2013/14 could be used by IS to do a quick survey. 4

14. AOB Peter Strachan of Robert Gordon University and Advisor to the Scottish Government on Renewables has confirmed his attendance at the next meeting. An item on wind farm repowering will be included on the next agenda. Next meeting - 11 th September Pullar House, Perth 5
