M. 1) CALL MEETING TO ORDER Board members present by roll call: Sue Last aye, Dan Schrader aye, Bart Rynish aye, Sharon Minta excused, Marl-, Heisel aye and Tom Michel aye. In the absence of Sharon Minta, Mark Heisel became a voting member. Staff present: Steve Dunks, Zoning Administrator; Melissa Hongisto, Deputy Clerk Chair Schrader appointed Tom Michel to the voting spot vacated by the resignation of Jack Robb. He also took a moment to mention the dedication of Jack Robb to the Board of Appeals. 2) APPROVE AGENDA Motion by Michel to approve the agenda as presented, second by Last, motion carried 5-0. 3) APPROVE MINUTES of the July 25, 2017 meeting Motion by Michel to approve the minutes as presented, second by Rynish, motion carried 5-0. 4) PUBLIC HEARING AND ACTION a) Variance request by Travis Veraghen, 2939 Moose Creek Tr, for a reduced rear yard set -back for a pool. Located on the southwest end of Moose Creek Trail. Zoned Residential Sewer. Parcel SU -2466 General Information Location: 2939 Moose Creek Trail, Southwest end of Moose Creek Trail Requested Action: Reduced rear yard set -back to allow the installation of an in - ground pool. Owner/Applicant: Travis Veraghen Parcel Number: SU -2466 Size:. 419 acres 2939 Moose Creek Trail Suamico, WI 54313 Existing Zoning & Land Use: Residential Sewer; single family home Surrounding Zoning & Land Use: North: RS; single family homes South: PL& I; vacant East: PL& I; vacant West: RS; single family homes Staff Report: The home was constructed in 2013. A sewer/water easement restricts construction on the west side of the property
A drainage easement also disrupts the east side of the property. Inspection & DPW staff met on site with the owner and Mau & Associates to confirm lot line & discuss drainage in the rear prior to the filing of this request. The property to the rear of this home is all Village owned and will remain an out - lot. A field review was done of 2939 Moose Creek Trl, SU -2466 on August 26, 2017 Travis Veraghen, 2939 Moose Creels Trl; was here to answer questions. They are asking for a variance to construct a pool. There is a drawing in the packet from Mau Associates as well as letters from some of the neighbors. We do have neighbors here tonight in support of the project. We built the home three and a half years ago. The lot adjoins neighbors on the side and has dedicated land behind it. The buildable area of the lot was smaller than some of the comparable lots in the area. In order to construct a pool, the safest way to do it is directly behind the house. There was an area in the southeast corner of the yard, but with visibility it presented a safety concern. This project does not impinge on any of the requirements. There is no infringement on a rear neighbor, each neighbor on the side has written a letter in support. A space like this will provide a gathering place for a number of children in the community. Our goal is to improve the condition of the property and the community in a way that it doesn' t impact negatively neighbors and friends. Steve Dunks reviewed the above background report. Schrader One of the things you mentioned was safety concerns. You are going to use a hard cover for the pool? Veraghen Yes. They provide more safety then a fence. They work when you are not home versus someone hopping over the fence. They have been approved in Suamico, they work on a keypad. It slides across and when you are done it slides back across. Last If a child wanders onto it it would support their weight? Veraghen Yes. Last And that would take the place of a fence? Veraghen Yes. I know two or three others in the village secure their pool that way. Dave Chrouser, 400 Security Blvd; is here for any questions you might have. Schrader Any other questions? Michel Is the keypad Wi-Fi capable that you could use it when you are not at home? Veraghen There are two options a punch keypad or a physical key turn. I think we are going to go ahead with a keypad with a code. It is not accessible remotely. Last There is a small drainage ditch that flows almost on your property line. Will this pool affect that drainage in any way, not just during construction, but once that pool is permanently constructed? Chrouser No it will not. Most of that is actually subsurface water. It runs pretty constant, but it' s confined to it. There is a small pipe that comes out to the street that is to the west there. He spoke to the neighbor to the west and her only concern. The
water is pretty limited. He talked to the engineer and has no concerns. There is plenty of relief in the woods. Veraghen The water is something that we wanted to address before we entered into this. We don' t want water to pool on our property. Chrouser The conservancy to the south is heavily vegetated, so those homes can' t even see through this. Schrader There were two letters in support of the pool from Dan and Sue Goran, 2940 Moose Creek Trl and Glen and Michelle Engels, 293 t Moose Creek Trl. Rynish Do you have a contractor yet? Veraghen We have it down to two contractors. It is the same project for both. A concrete pool. Both local contractors. Schrader There will be a deck? Veraghen There will be a deck on three sides, the southern side will not have a deck. It will be a twelve inch wall. It will be exposed. It will be twenty-four to thirtysix inches out of the ground; it will taper at the sides. For the exposed wall we have brick that is on our patio to face that wall so that it blends into the natural surroundings of the property as it sits. Rynish What is the normal setback for the rear yard? Dunks Fifteen feet. Rynish And we are at four? Last 3. 2 on one end and 3. 3 on the other end. Chrouser These ordinances are usually put in place to protect adjoining property owners. With what there is to the south, it has very little effect. Veraghen There is a significant amount of wooded area into the next adjoining subdivision. Dan Schrader Is there anyone here who would like to speak in favor or against this variance request? Sara Brown, 2939 Wallenfang Ln; spoke in favor of the pool. There are other pools in the neighborhood. Dan Schrader closed the public hearing. Last I don' t have an issue with the location of the pool as long as the drainage is maintained. Which the village has said they do not have a concern about that drainage. The engineers have said they do not have a concern about that drainage. The other concern is they have talked about putting a pool cover as compared to a fence. Is it wise to put that as a condition also? Dunks It is already a condition of the building code. They must either fence or protect with a cover. They are choosing the cover. Schrader Is that public land or owned by the village? Dunks It' s owned by the village. Schrader The village would have to maintain the ditch. Correct? Dunks It is our drainage easement to maintain, whether the portion is on private or public, we have the easement to maintain it.

Parcel SU -46-1 General Information Location: 2059 Susie Ct, southwest end of Susie Ct Requested Action: Variance for a fiont yard garage Owner/Applicant: Dean Harvey 2059 Susie Ct Parcel Number: SU -46-1 Size: 5. 845 acres Suamico, WI 54173 Existing Zoning & Land Use: RR; single family home Surrounding Zoning & Land Use: North: RR; single family homes South: RR; single family homes East: RR; single family homes West: PL& I; vacant Staff Report: The home was constructed in 1983. Wetlands restrict any complying location to the south or east of the home. The septic system is on the north side eliminating any complying location on that side. The lot to the east has a front yard garage which received a variance a few years back. 2010ish The proposed building is 28ft x 56ft Sidewall height was not given. Some finishes similar to the home, not really sure what parts on that either.
The building will be somewhat shielded by the existing trees. A field review was done of 2059 Susie Ct, SU -46-1 on August 26, 2017 Dean Harvey, 2059 Susie Ct; was here to answer questions. Submitted the permit because there is no available space behind his house. The best location for it would be in the front yard, which is the highest ground. Most of the ground around his house is wetlands. The best place for this would be the section he had market out. Schrader What kind of structure is this? Harvey It is a garage structure. Just a basic garage. 28 x 56. 10 foot walls. 4/ 12 pitch. Is going to try to reflect the house so that it is similar to what the house looks like. Same kind of siding, probably asphalt shingle roof, two garage doors, service door, and two windows. Schrader The overhead doors are on the ends of the building. Harvey Yes. One is going to be 9 x 16 and the other one is going to be smaller, 9 x 9 or something like that. Schrader 16 x 8 and 9 x 8? Harvey Yeah. Last What are you going to use the building for? Harvey I am retired and I have to do something. I have a full size tractor, I need to repair it. I need some place to tear it apart. I have a pickup truck that has been sitting out for years. I need to get that some place also. Pretty much for use of vehicles. I do woodworking and metal working, I have to have someplace other than the small garage I have. Last Was that the small building in the rear? Harvey That' s just a storage shed. Schrader Will this be heated? Harvey Probably later. The full thing is not going to be heated. I don' t need the whole thing heated. Schrader Concrete floor? Harvey Yes. Schrader It' s a good size building, 28 x 56. Last It is. Last Is there any reason that this building cannot be put in the rear of the yard. There was a driveway that was put in a number of years ago. That driveway leads to the back portion to where the extra storage building is. Harvey There is not enough buildable area unless I fill in. And that is all wetlands; I don' t want to get involved in filling in anything. And I would have to have a driveway put in. It is a grass driveway. That was for when I had to have trucks come in for my well in the backyard. Schrader Are those designated wetlands. Dunks Yes. Everything back there is pretty much mapped wetlands. He hasn' t had an official delineation done, but if it shows up on the GIS map are wetlands we do not issue a building permit without a delineation. Which in all likelihood is going to come back wetlands.
Steve Dunks reviewed the above background report. Dan Schrader Is there anyone here who would.like to speak in favor or against this variance request? Scott Schomaker, 4881 Michelle Dr; I have a corner lot. I support Dean' s variance. It is a cul-de- sac. His neighbors, one has a garage in the front and the other has a pole building. Dan Schrader closed the public hearing. Rynish It is hard to say much, when you have to big buildings on lots next to him. Last But this one is a little different, the one right next to him, this will be perpendicular in front of the house and a good portion of the trees will be gone. Schrader It is 48 ft on the closest corner to the road. Michel 39 on one side 48 on the other. Schrader That is on the side. It is 39 ft from the property line. It is 48. 77 ft on the other corner. It is quite a way from the road. There are a lot of trees in there. Michel I don' t think he has a lot of choice. He needs a building and where his house is at, the septic and the wetlands. His hands are kind of tied. Rynish The size of the building with 10 ft sidewalls, and 4/ 12 pitch. It is not going to look like a monstrosity. Michel It is not a metal pole building, which is key. I am not in favor of a front garage, sometimes the way the land is laid out, unfortunately that is what it takes. Heisel I agree with Tom. He doesn' t have much choice, and with it matching the house, I don' t see it being a problem. Motion by Rynish to approve a variance request by Dean Harvey, 2059 Susie Ct, for a front yard garage, parcel SU -46-1, with the following conditions 1. Maximum size of 28ft x 56ft 2. Sidewall height of IOft 3. Exterior finish same as home 4. Existing trees will be preserved as much as possible. 5. Substantial completion within 2 years 6.
