Specific Operating Regulations Regulations for States Instructions, Rules, Directives, sets of laws, policies, requirements and Orders,..); Laws and regulations of the State should be in conformity with Annexes to the Convention; The Annexes provisions provide the minimum requirements to be met by Contracting States; States are responsible for developing equivalent regulations/rules containing with sufficient details to ensure desired level of safety; Development of a process for the amendment of regulations, as necessary. 4 Kuwait _ January 2015
Specific Operating Regulations SARPs: to achieve uniformity and to facilitate incorporation into national regulations; Certification and Licensing of Civil Aviation organisations are governed by State s own laws and regulations; Laws and regulations framed in legal phraseology; Easy for use by licensing and certification staff; Easy for understanding by general public. 5 Kuwait _ January 2015
Adapting or Adopting regulations from other States States have the option of adopting another Contracting States regulations; The complexity of the other States system should be considered; The States should be careful not to place undue burden on their aviation community; Better alternative to adapt the regulations to meet the aviation environment while still maintaining harmony with other States. 6 Kuwait _ January 2015
Differences with ICAO SARPs Article 38 of the Convention: If States find it difficult/impracticable to comply with SARPs; they shall give immediate notification to ICAO of the differences between its own practice and that established by SARPs. 7 Kuwait _ January 2015
Aircraft Registration and Airworthiness State s registration regulations should comply with Annex 7 to the Convention (Aircraft Nationality and Registration Marks); To make aircraft international eligibility, the State of Registry must issue Certificate of airworthiness in compliance with the detailed/comprehensive Airworthiness Code applicable to the type of aircraft. 8 Kuwait _ January 2015
Aircraft Registration and Airworthiness Article 29_ Every aircraft engaged in international air navigation; shall carry a Certificate of Registration and a Certificate of Airworthiness. Aircraft Registration and Airworthiness Article 33 _ Shall recognize Certificate of Airworthiness delivered by an other contracting State provided that requirements under which the Certificate was issued are equal to minimum standards. State Civil Aviation System and Safety Oversight Functions Establishing a State Civil Aviation System: To fulfil its obligations as provided for in the Convention, a State must establish: an appropriately organised, funded and empowered civil aviation system on the basis of national legislation; Structured to effectively fulfil the tasks that it is expected to undertake. 16 Kuwait _ January 2015
State Civil Aviation System and Safety Oversight Functions The State has to keep in view the size and complexity of the aviation activity in the State; In States where size of aviation industry is small, the State may be able to fulfil its responsibilities in a cost-effective manner through cooperative inspection arrangements with neighbouring States or through Regional Arrangements. 17 Kuwait _ January 2015

Functions of a Flight Safety Standards Department The Flight Safety Standards Department bears the overall responsibility for the safety oversight related activities of the CAA; It is the top technical Department responsible for the implementation of technical policy related to Personnel Licensing, Aircraft Operation and Airworthiness of aircraft. 19 Kuwait _ January 2015
State Civil Aviation System and Safety Oversight Functions Establishment of an Aircraft Accident Investigation Authority: It is essential that the State s agency, board, commission or other body tasked to carry out the investigation of aircraft accidents and serious incidents report directly to a higher authority -Preferably at a Ministry level or government. To insure that he findings and safety recommendations of the investigation are not diluted when passed through regular administrative channels. 20 Kuwait _ January 2015

Licensing, Certification, Authorization and Approval Obligations Article 31 states that every aircraft engaged in international air navigation shall be provided with a Certificate of airworthiness issued or rendered valid by the State of the aircraft registry. Licensing, Certification, Authorization and Approval Obligations The essential functions of a State s personnel licensing office include: Drafting and amendment of rules relating to training and licensing of aviation personnel; Assessment and approval of applications for licences and ratings and the issue of licences and rates; Application of medical fitness assessments relating to licence requirements; Validation of licences and rates issued by other Contracting States; Approval, designation and supervision of individuals or organisations delegated to perform specific tasks on behalf of the personnel licensing office. 24 Kuwait _ January 2015

Licensing, Certification, Authorization and Approval Obligations Aircraft Operations organisation is a major component of a CAA s establishment and is the most common inspection component. The essential functions of a CAA remain fundamentally the same and should include: Drafting and amendment of rules relating to aircraft operations; Certification and approval of initial applications of air operators and the issuance of an AOC; Continued inspection and surveillance of certificated air operators; Approval, designation and supervision of individuals or organisations delegated to perform specific tasks on its behalf. 26 Kuwait _ January 2015
27 Kuwait _ January 2015 Licensing, Certification, Authorization and Approval Obligations The essential functions of the airworthiness inspection organisation include: Drafting and amendment of rules relating to aircraft airworthiness; Certification and approval of initial applications of air operators (airworthiness aspects); Continued inspection and surveillance of certificated air operators (airworthiness aspects); Issuance, renewal and continuing validation of the CofA; Approval of modifications and mandatory inspection; Approval and continuing inspection of approved maintenance organisation (AMOs); Approval & continuing inspection of the maintenance aspects of an AOC; Monitoring and control of mandatory continuing airworthiness information.
Surveillance Obligations Required surveillance and the related inspections should be planned and conducted by CAA technical personnel responsible for personnel licensing and civil aviation technical inspections and possessing the required credentials. 28 Kuwait _ January 2015
