337 EC2010-574 AN ACT TO AMEND THE CIVIL SERVICE SUPERANNUATION ACT DECLARATION RE Under authority of subsection 5(1) of An Act Amend the Civil Service Superannuation Act Stats. P.E.I. 2008, c. 37 Council ordered that a Proclamation do issue proclaiming sections 3 and 4 and subsection 5(1) of the said "An Act Amend the Civil Service Superannuation Act" come in force effective 13 November 2010. EC2010-575 HERITAGE PLACES PROTECTION ACT HERITAGE PLACES ADVISORY BOARD APPOINTMENT Pursuant subsection 3(1) of the Heritage Places Protection Act R.S.P.E.I. 1988, Cap. H-3.1 and subsection 2(1) of the Heritage Places Protection Act Regulations (EC414/00), Council made the following appointment: NAME TERM OF APPOINTMENT Arnold G. Smith 20 November 2010 Pleasant Valley (reappointed) 20 November 2013 Further, Council noted with approval the reappointment by the Minister, in accordance with subsection 2(2) of the said Regulations, of Arnold Smith as Chair of the Board for the duration of his term as a member. L-5 Council determined that, upon transfer of administration and control Her Majesty the Queen in Right of Canada, land covered by water located in Lot 21, Queens County, Prince Edward Island, talling approximately four decimal eight one (4.81) acres and currently owned by the Government of Prince Edward Island, as represented by the Minister of Transportation and Infrastructure Renewal, NOT be identified for nondevelopment use under the Land Identification Program established by the Prince Edward Island Lands Protection Act Land Identification Regulations (EC606/95). A copy of the legal description of the said land covered by water is attached the file copy of this Order in the Office of the Clerk of the Executive Council.

338 EC2010-577 MARK BROOME AND MAY SHORT-BROOME (TO RESCIND) Council, having under consideration Order-in-Council EC2010-213 of 6 April 2010, rescinded the said Order forthwith, thus rescinding permission for Mark Broome and May Short-Broome, both of Oshawa, Ontario acquire fifty-three decimal three two acres (53.32) of land in Lot 11, Prince County, Province of Prince Edward Island, from Nina Howell of Freeland, Prince Edward Island. EC2010-578 KIM CONRAD Pursuant section 4 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission Kim Conrad of Dartmouth, Nova Scotia acquire an interest in a land holding of approximately one hundred and forty-five decimal nine (145.9) acres of land in Lot 15, Prince County, Province of Prince Edward Island, being acquired from Albert McDonald and Stephen Gallant, both of Dartmouth, Nova Scotia. Further, Council noted that the said land holding, being Provincial Property Nos. 264960, 264978 and 670893, was previously subject a condition preventing subdivision in accordance with section 9 of the said Act. This subdivision restriction continues apply. EC2010-579 JAMES BERNARD HIGGINS Pursuant section 4 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission James Bernard Higgins of Calgary, Alberta acquire a land holding of approximately forty-two decimal one three (42.13) acres of land in Lot 63, Kings County, Province of Prince Edward Island, being acquired from Yvonne Gellatly of Saint John, New Brunswick PROVIDED THAT the said real property is identified for non-development use pursuant the Land Identification Regulations (EC606/95) made under the said Act.
