2014 Annual Report Covered Device Recycling Act Overview Electronic products constitute one of the fastest growing streams of today s consumer and commercial waste. The Covered Device Recycling Act (CDRA), the act of November 23, 2010 (P.L. 1083, No. 108), established a number of requirements for manufacturers, retailers and other entities to facilitate the recycling of electronic devices covered under the CDRA. Covered devices include: desktop computers, laptop computers, computer monitors, tablets, computer peripherals, televisions and e-readers that contain a browser and have Internet connectivity. Reporting Requirements Section 502 of the CDRA requires the Department of Environmental Protection (DEP) to provide an annual report to the General Assembly that includes: The total weight of covered devices collected in the Commonwealth during the previous calendar year. A complete listing of all manufacturers collection, transportation and recycling programs and collection sites operating in the Commonwealth during the prior calendar year, the parties that operated them and the amount of material by weight collected at each site. An evaluation of the effectiveness of the education and outreach program. An evaluation of the existing collection and processing infrastructure. Recommendations for expanding the program to include additional electronic devices. 2014 Report Information The following information is provided to meet the reporting requirements of Section 502. The total weight of covered devices collected in the Commonwealth during the previous calendar year. In 2014, 75 registered manufacturers recycled 62.4 million pounds of covered devices. A complete listing of all manufacturers collection, transportation and recycling programs and collection sites operating in the Commonwealth during the prior calendar year, the parties that operated them and the amount of material by weight collected at each site. A complete listing of collection, transportation and recycling programs and sites operating in the Commonwealth are provided in Appendices A through C. Because collection sites are not required by law or regulation to operate and maintain scales, the amount of material collected at each site is unavailable. - 2 -
An evaluation of the effectiveness of the education and outreach programs. In general, local governments have done an excellent job of publicizing electronics collection programs. DEP recommends that manufacturers and retailers continue to expand their education programs to emphasize where covered devices can be recycled and ensure collection sites are reasonably available to citizens throughout the year. Evaluation of the existing collection and processing infrastructure. As mentioned in the previous report, issues remain with the collection and processing infrastructure needed to make the CDRA successful. DEP continues to work with the operators and managers of recycling collection programs to evaluate the existing collection and processing infrastructure. The same themes DEP has heard previously are more prevalent due to the absence of reliable funding, low market values for materials, and the uncertainty of having the collected material covered by a manufacturer s plan. After almost four years of implementation, the CDRA has not stimulated a dependable statewide infrastructure to ensure local governments, collectors, and recyclers are able to operate and provide recycling services on a continuing basis. Collection infrastructure is especially challenging because recyclers are hesitant to contract with counties as some collected electronics are not covered by manufacturer s goals. Televisions and computer monitors that contain cathode ray tubes (CRTs) are especially problematic for recycling due to the leaded glass in the CRTs, absence of low-cost recycling technology, and limited number of CRT processors. Currently only 10 CRT glass recycling operations exist worldwide. The high cost of transporting CRTs to those processors and actual processing cost is greater than the value of the material recovered, which makes those devices a negative value commodity. In response, some entities have started to reduce, limit, or eliminate CRTs from collection programs. Nevertheless, the demand for opportunities to recycle old televisions continues to be high. Reports indicate that, by weight, 70 to 80 percent of the materials available for recycling are CRT-containing electronics. As of August 2015, 43% of all calls received by the statewide recycling hotline pertained to access issues for recycling of televisions. As a negative value commodity, the cost of processing and recycling CRTs have increased for all parties. For instance, the five southeast counties of Bucks, Chester, Delaware, Montgomery and Philadelphia continue to operate the Household Hazardous Waste (HHW) program but have eliminated the e-waste portion of the program because a vendor for electronic materials could not be secured. In 2015, no recyclers were willing to contract with the counties given the anticipated volume, especially televisions, in relation to the expected processing charges paid by the manufacturers. These southeast programs have provided services to citizens for over a decade and in 2014 served four million people and collected three million pounds of e-waste material. Approximately 149 manufacturer collection points exist in the five southeast counties. However, of these, only 21 accept non-working televisions without some restriction. For instance, Best Buy will only accept televisions that are smaller in size than 32 inches, and the Salvation Army only accepts televisions that are in working condition. Construction Junction, a non-profit reuse recycling store in Pittsburgh, has stopped accepting televisions altogether. - 3 -
Similarly, Chester County has televisions accumulating at its solid waste facility without a contractor to process them. Coatesville, located in Chester County, is also unable to find a place to take its collected televisions. Bucks County receives four to five calls a day, and Delaware County officials have stated that the majority of their calls regarding recycling involve televisions. Callers are frustrated by the absence of convenient recycling programs. Philadelphia is currently paying a vendor not associated with a CDRA program for the recycling of televisions because no recyclers are willing to work in a CDRA program. More rural parts of the state are also experiencing the same issues. Adams County ceased collecting televisions in May 2015, after its recycler stopped servicing the site due to receipt of large numbers of televisions. Cumberland County was unable to secure a bid from a recycler for its planned recycling program. No recyclers were willing to contract with the County due to the anticipated volume of material. Pike, Wyoming and Sullivan Counties in the northeast have no manufacturer-sponsored collection programs that accept televisions. In Armstrong County no opportunities exist for the recycling of non-working televisions. Current efforts to explore new technologies for processing CRT glass are ongoing; however, none have yet to be successfully deployed. New technologies will need to be developed and incentivized in order to successfully manage this material. Separately, the CDRA requires manufacturer programs to provide recycling access to 85 percent of the population; however, the landfill ban prohibiting the landfilling of covered devices applies to 100 percent of the population. These provisions in the CDRA result in a confounding situation for citizens that may have limited or no opportunities for recycling but are faced with a landfill ban on the material they wish to discard.
