6:00 PM Regular Meeting MINUTES PAYETTE PLANNING & ZONING COMMISSION Regular Meeting April 27, 2017 ROLL CALL: Members Present: Randy Choate Jim Franklin, Mike Kee, Jody Henderson, Peggy Childers & Nial Bradshaw Members Absent: Gary Youngberg Staff Present: Matea Gabiola COMMUNICATIONS None Heard. APPROVAL OF MINUTES A. 03-23-2017 Regular Meeting PUBLIC HEARINGS A motion was made by Henderson and seconded by Childers to approve the minutes of 03-23-2017 regular Meeting minutes as written. After unanimous voice vote, motion CARRIED A. An application by Verizon Wireless, for a Conditional Use Permit to construct a wireless communications facility consisting of a 100-foot monopole at the property located at 212 South 6 th Street Payette, ID. Lots 1 to 11 - Lot 12 & 13 & N 9' Lot 14 Less E 60' Payette, Lamme. The proposed site is zoned Industrial. Matea Gabiola stated that Verizon Wireless requested to be postponed to the May 18 th, 2017 Planning & Zoning Meeting, due to a prior engagement. A copy of this request was in the packet. B. An application by Michael Stowe, for a Variance build an eight-foot extension to the existing garage along the property line adjacent to alleyway for the property located at 225 So 9 th Street Payette. Rev Tax 9 in Lots 16 & 20, BLK 12 Masters Orig. The property is zoned B- Michael Stowe, 225 South 9 th Street Payette, Idaho addressed the Commission. Mr. Stowe stated he wants to build an eight-foot extension to his garage in the alleyway and an addition six feet in width. This addition pg. 1
will help him clean up his property and make it more appealing the public. Mr. Stowe stated that he would like to have more space inside for his equipment and cars. Mr. Choate stated by the map provided the existing garage sits right on the property line, correct? Mr. Stowe stated yes, it does. Mr. Franklin stated that is why there is a variance request correct. Mr. Choate stated yes. Mr. Franklin asked Mr. Stowe to explain the new additions that were drawn on the map provided. Mr. Stowe stated that this winter the roof collapsed, which set this whole thing in motion. The new additions would be over the property line into the alleyway and six feet towards the house, but there still will be a seven-foot distance from the garage and the home. Mr. Kee asked if the new roof will extend into the alley over the property line. Mr. Stowe stated no it will not. C. An application by Rhonda Cannon of Cannon Ministries, Inc for a Conditional Use Permit to have a Church for the property located at 827 Center Ave Payette. Gorrie Add Tax 3, BLK 1. The property is zoned C1- Commercial Downtown. Rhonda Cannon, 727 E Main Street Weiser, Idaho, addressed the Commission. Ms. Cannon stated that they have a Church in Weiser and this would be a second location for their Church/ worship services. This location will accommodate the elderly, due to having no stairs. The parking shouldn t be an issue, due to the times that we will be having services at nights and weekends. Ms. Cannon stated that the plan is have the partition up front with desks. There is a proposed site plan map included in the packet. Ms. Cannon stated that she had the Fire Chief come inspect the capacity and it was set at 51 occupants. Mr. Bradshaw asked about the parking and would there be an issue. Mr. Choate stated this was brought up in the last meeting. Ms. Gabiola stated that the print out in front of you references that portion of code on item C. Ms. Cannon stated that all the surrounding businesses will be closed during the times of our services. Ron Owen, 2141 Uehlin Drive Payette, Idaho, addressed the Commission. Mr. Owen stated that he owns the building next to this lot, 15 North 9 th Street and he is concerned about the parking and amount of people they are wanting to have. Mr. Owen stated that he goes in and out of his property daily with trucks and trailers, and he wants to make sure that the parking is adhered to that is marked on the City Streets. Which, around his property there is no marked parking. If that is adhered to then he has no objection, but if it is not then it will be a tow away zone. Mr. Choate stated having a tow away zone would be you as that property owner s prerogative if they park on your property. If its City marked parking then that are following code. Mr. Owens stated the City is to provide off street pg. 2
parking. Mr. Choate read PMC code 17.34.060 item C, which exempts anyone in the C-1 Commercial Downtown zone. Ron Carroll, 823 Center Avenue, Payette, Idaho addressed the Commission. Mr. Carroll stated that he owns the doctor s office next to this building and his concern is the parking as well. Mr. Carroll wanted to make a suggestion for City to make a few more marked parking spaces on along Mr. Owens property on Center, due to there being room. This won t block his entrance but will make a few additional parking spaces for those surrounding businesses to use. Mr. Carroll stated that he doesn t mind the Church being there, just wants to make sure the parking is there. Mr. Choate stated that this body doesn t have any jurisdiction on that issue, but will forward this suggestion to our Street Supervisor. Mr. Choate had Ms. Cannon come back up again. Mr. Choate wanted to explain to Ms. Cannon about what was discussed and the issues regarding parking. Mr. Choate stated in some Conditional Use Permits it is listed as to be revisited upon complaint. If there becomes an issue with the parking then this Permit can be revisited. Ms. Cannon stated that the Church doesn t intend to go beyond what the marked parking is, and again the hours of operation would be in the evenings and weekend when most business are closed. D. An application by Steven Corta for a Conditional Use Permit for a home occupation to sell/transfer firearms for the property located at 1005 Center Ave Payette. Lots 1 & 2, BLK 16 Gorrie Add. The property is zoned B- Matea Gabiola, stated that Chief Mark Clark gave her an email in regards to this application and his thoughts and comments. Mr. Corta has been given a copy as well. See attached. pg. 3
Steven Corta, 1005 Center Avenue Payette, ID addressed the Commission. Mr. Corta stated he plans on opening up a small selling/ transfer of firearms business at his home. He has also applied through the FFL to conduct gunsmithing as well, it is not his initial intention, but a potential possibly. Mr. Corta stated that he has already had a four-hour meeting with ATF in regards to obtaining this license as well as the listed requirements. According to ATF, he is good to go if the Conditional Use Permit is approved through the City. As far as the email/ comments from Chief Clark, Mr. Corta stated that he as met and exceeded the requirements listed from ATF and what Chief Clark has listed as well. The security requires double locks and 24-hour surveillance. Where the actual transfers will take place is his own shop, not where the guns will be stored. The Police can contact or come look over anything if they have any concerns. Mr. Franklin asked Mr. Corta if he can give them any more detail on what the ATF requires as far as security goes. Mr. Corta stated that ATF requires the safe to be double locked, surveillance, every buyer that leaves has to leave with a lock. Mr. Choate asked if he would be carrying and selling ammunition. Mr. Corta stated no he will not be selling wholesale ammunition. Mr. Franklin asked if he could address the number of people he would expect on a daily basis, customer wise. Mr. Corta explained the hours of operation. At first, he said he believes it will only be family and friends and customers who know about his business, word of mouth will I m sure grow in size, but he as more than enough parking to accommodate. Mr. Franklin asked Mr. Corta is he had any thoughts about signs. Mr. Corta stated yes, if there is one then it would be a 2 x 2 sign above the door. Ms. Childers asked if there will be bars on the windows. Mr. Corta stated where the transfers will take place there is no windows. Mr. Corta stated in the State of Idaho a person is legal to conduct this type of business without the FFL, but with this way he has to fill out a form 473, with background checks so everything will be by the strict ATF standards. The property is zoned B- A motion was made by Bradshaw and seconded by Franklin to send a favorable recommendation to the City Council to approve the variance application submitted by Michael Stowe to build an eight-foot extension to the existing garage along the property line adjacent to the alleyway for the property located at 225 South 9 th Street Payette, Idaho. After unanimous voice vote, motion CARRIED. C. An application by Rhonda Cannon of Cannon Ministries, Inc for a Conditional Use Permit to have a Church for the property located at 827 Center Ave Payette. Gorrie Add Tax 3, BLK 1. A motion was made by Henderson and seconded by Kee to approve the Conditional Use Permit by Rhonda Cannon of Cannon Ministries to have a Church at the property located at 827 Center Avenue that can be revisited upon complaint. After unanimous voice vote, motion CARRIED. D. An application by Steven Corta for a Conditional Use Permit for a home occupation to sell/transfer firearms for the property located at 1005 Center Ave Payette. Lots 1 & 2, BLK 16 Gorrie Add. The property is zoned B- Mr. Choate stated to have that Mr. Corta follow and comply with all federal licensing to maintain this permit as condition. Mr. Franklin stated that in the staff recommendation is that he complies and maintains all Federal, State, County and City license and requirements, so that covers it. A motion was made by Franklin and seconded by Henderson to approve the Conditional Use Permit by Steven Corta to have a home occupation to sell/ transfer guns for the property located at 1005 Center Avenue, contingent with complying with all Federal, State, County, and City licenses and requirements and the permit can be revisited upon complaint. pg. 5
After unanimous voice vote, motion CARRIED. E. Ordinance #1423 Discussion- Ms. Gabiola stated that after the passing of #1423, the City has several members from the Treasure Valley Radio Association attend a City Council Meeting stating this ordinance affected them. They reviewed our current ordinance and submitted some possible changes to be made. As the code stands right now, anything over 35 feet they would have to come get a Conditional Use Permit. They have suggested some changes in regards to height and when an application should and shouldn t have to get a permit, also where placements of these amateur radios are allowed. Ms. Gabiola stated that these are in residential areas and that needs to be considered as well. This will be brought forward at the next public hearing.
