TARIFF OF PORT CHARGES AND OTHER SERVICES

1. This Tariff shall apply to calculation of services and charges provided to domestic and foreign ship companies and other foreign and domestic users of port services in international transport. The prices listed in this Tariff shall be subject to amendments in the course of the year. Any amendments to the terms of use of the services and the prices listed in the Tariff during the business year shall be notified to domestic and foreign customers via their agents 15 days before these take effect. 2. In case of any works and operations that are not covered by this Tariff, they shall be charged under a special Agreement. 3. Items in this Tariff are expressed in (Euros). 4. The Port s fixed assets may not be used without special approval from the Port of Kotor JSC. 5. The Port shall accept work orders solely within the limits of their technical and port capacities. Normal working hours of the Port are Monday to Friday 8:00 a.m. 6:00 p.m. 6. In case of overtime work, certain items (pilotage, mooring, unmooring) of this Tariff shall be increased. 7. The debtor shall check whether the invoice is correct within five days and indicate any irregularity in the calculation to the creditor. The creditor shall rectify the complaint disputed invoice amount within 15 days and deliver its position to the debtor in writing. If the creditor rejects the complaint, it shall notify the debtor within 15 days. 8. The customers shall settle the invoices issued for all services rendered within the legally prescribed deadline. 9. For any work and services carried out over a longer period of time, the Port shall charge its services on monthly basis. Upon receiving instructions, the Port may request that the services are paid in advance in part or in full. 10. General tariff provisions shall be an integral part of the Tariff and shall apply to the entire Tariff, unless specified otherwise in the tariff provisions attached to a specific table. 11. Any amendments to and commercial discounts for this Tariff shall be passed by the competent authority Port of Kotor JSC.

NOTE: a) The listed amounts of port pilotage charges are calculated in both directions. b) The scope of port pilotage includes: a) External pilot station (position I): 42⁰ 23' north latitude 18⁰ 33.4' east longitude b) Internal pilot station (position II): 42⁰ 26.4' north latitude 18⁰ 32.8' east longitude c) If the pilot embarks on position I, upon request of the shipmaster, in that case the port pilotage charge shall be increased by additional 100.00. d) Work outside normal working hours shall be charged according to item 6 (Table 1) General Tariff Terms and Table 1.1. e) Pilot service for the port pilotage area shall be organized 24 hours a day. f) Shipmaster shall announce their arrival 24 hours in advance, and shall confirm the exact time of arrival 6 hours in advance during the working hours from 8:00 a.m. to 6:00 p.m., and for arrivals from 6:00 p.m. to 8:00 a.m. the exact time of arrival shall be confirmed at least 12 hours in advance with 1 hour tolerated error. g) Priority in pilotage shall be provided to: 1) Passenger ships operating regular lines 2) Other passenger ships. h) Port pilot shall guide ships from the pilot station to the anchorage, i.e. the mooring point set in the port and vice versa and during any relocations. i) For passenger ships on a cruise through the Boka Bay, pilotage shall be deemed as provided in both directions, i.e. during arrival and departure. j) Ship stay at anchorage for own supply purposes during pilotage for more than 2 hours shall be calculated as new ship pilotage. k) If the ship has two GRT tonnages as per calibration mark, the higher GRT tonnage shall be used in calculation. l) Pilotage order form shall be given in two copies, one of which is to be returned after the pilotage is completed. m) Shipmaster shall fill in and sign the confirmation of completed pilotage and certify it with the ship s stamp. n) Submitted pilotage order form may be cancelled or altered not later than 1 (one) hour prior to the ordered start of pilotage. nj) In case of relocation of a ship and/or pilotage of a ship without own propulsion, pilotage tariff items shall be increased by 100%. o) Mandatory pilotage shall not include the ships of the Army of Montenegro, ships used for administrative purposes, ships of the navigation safety service and ships used for maintenance of waterways.

The decision on such discount shall be passed by the Chief Executive Officer. b) In case the ship company fails to meet the requirements referred to in point (a) hereof, the charge shall be calculated based on Table 2. c) The Port reserves the right to enter into a special Business Cooperation Agreement for the category of ships that have particular relevance for the company and for the town of Kotor, to specify the amount of the charges referred to in Table 2. The decision on such agreement shall be passed by the managing authority. d) The ship company, or its representative, may make amendments to the mooring reservations until the start of the season (March). Any cancellation of reservations after that deadline shall be subject to collection of a charge depending on the time of cancellation as specified in Table 2.2. The agreement holder shall be a physical or legal person and not a vessel. e) In case of early cancellation of the Agreement, no refund of the amount paid shall be applicable. The remaining amount shall be recognized in the following Agreement. f) The price shall be calculated for the overall length of the vessel (length overall L.O.A), including bow extensions, anchors, swim platforms, tender holders, etc. (A tender may be a vessel of up to 4 m).

g) If the vessel is wider than the maximum width for the category, the price shall be calculated as per the category corresponding to the vessel s width. h) The Port reserves the right to measure all vessels. i) The vessels that stay moored for over three days shall be granted discount in the amount of 20% of the daily mooring price. j) The mooring position in the sea is not fixed and may be altered in line with the needs of the Port s business organization. k) Carrying out any works on a vessel may be done solely upon consent of the Port. l) Use of daily mooring means that the vessel shall depart from the mooring by 2 p.m. on the last day paid, otherwise another day shall be charged. m) The Port reserves the right to relocate the mooring users during certain events of interest for the town of Kotor, i.e. to select the users that may be provided certain services. n) For all lengths of yacht mooring in the sea, value added tax (VAT) shall be charged in the amount of 7%.
