BOARD OF COUNTY COMMISSIONERS TOWN COUNCIL JOINT INFORMATION MEETING AGENDA DOCUMENTATION PREPARATION DATE: April 28, 2016 MEETING DATE: May 2, 2016 SUBMITTING DEPARTMENT: Administration DEPARTMENT DIRECTOR: Bob McLaurin & Alyssa Watkins PRESENTER: Roxanne Robinson SUBJECT: Transfer of Jackson Entitlement AIP Grant funds to Cody and Rock Springs Airports STATEMENT/PURPOSE The FAA requires a resolution from the Town and County for grant requests addressing needs at the airport. Additionally, any transfer of grant entitlements must also be handled by resolution. BACKGROUND/ALTERNATIVES The Jackson Hole Airport is not in immediate need of these funds initially awarded and there are other airports in the State of Wyoming that are in need of the funds, specifically Cody and Rock Springs. The FAA is requesting that these funds be transferred to these other airports in need and the attached resolutions do just that. A portion of the Airport s FAA entitlement funds would be waived in favor of Yellowstone Regional Airport (COD) in the amount of $228,831, and in favor of Rock Springs Sweetwater County Airport (RKS) in the amount of $283,809. The Jackson Hole Airport Board is in favor of transferring these entitlements as well. The Jackson Hole Airport will receive equal amounts of entitlement funds back from the FAA when they have the need for such funds. ATTACHMENTS Teton County Resolution and Town of Jackson Resolution. FISCAL IMPACT None. STAFF IMPACT Very minimal. Signatures to be obtained and documents returned to Airport. STAKEHOLDER ANALYSIS Stakeholders include the communities of Cody and Rock Springs as these funds will benefit those communities and are not in immediate need at the Jackson Hole Airport.

LEGAL REVIEW Complete. RECOMMENDATION Staff recommends the Town Council and County Commission approve the resolutions as presented. SUGGESTED MOTION Town motion: I move to approve the resolution for Transfer of FAA Entitlements from the Jackson Hole Airport to Cody and Rock Springs as presented and authorize the Mayor to execute the resolution on behalf of the Town of Jackson. County motion: I move to approve the resolution for Transfer of FAA Entitlements from the Jackson Hole Airport to Cody and Rock Springs as presented and authorize the Chairman to execute the resolution on behalf of Teton County. WHEREAS, pursuant to Wyoming Statute 10-5-202, the Jackson Hole Airport Board ("Board") was created by Ordinance No. 109 of the Town of Jackson and Resolution of the Board of County Commissioners of Teton County, to own and operate the Jackson Hole Airport (the Airport ); WHEREAS, because the Board was created and may be dissolved by joint action of the County of Teton and Town of Jackson under Wyoming Statute 10-5-202, both are considered cosponsors with the Board under Federal Aviation Administration Grant Agreements; WHEREAS, FAA has presented the Board, the Town of Jackson and the County of Teton with two Requests for FAA Approval of Agreement for the Transfer of Entitlements, under which a portion of the Airport s FAA entitlement funds would be waived in favor of Yellowstone Regional Airport (COD) in the amount of $228,831, and in favor of Rock Springs Sweetwater County Airport (RKS) in the amount of $283,809; WHEREAS, the Airport is not in immediate need of such entitlement funds, and transfer of them will allow such other airports to begin projects immediately, while the Airport will receive an equal amounts in entitlement funds back from FAA when it has need for such funds; and WHEREAS, the Board of County Commissioners finds it to be in the best interest of the Airport to execute and return to FAA such Requests for FAA Approval of Agreement for Transfer of Entitlements. NOW, THEREFORE, it is resolved by the Board of County Commissioners of the County of Teton, in regular session duly assembled, that the Board Chairman is authorized to execute Requests for FAA Approval of Agreement for the Transfer of Entitlements, and such other documents and communications with FAA as may be reasonably necessary to waive portions of the Airport s entitlement funding, in favor of Yellowstone Regional Airport (COD) in the amount of $228,831, and Rock Springs Sweetwater County Airport (RKS) in the amount of $283,809. The undersigned duly qualified and acting Clerk to the Board of County Commissioners certifies that the foregoing is a true and correct copy of a Resolution adopted by the Board of County Commissioners of Teton County, Wyoming on the day of May 2016, the meeting 1
