STAFF RECOMMENDATIONS It is recommended: THAT, Report #LL-13-2011: Recommendation of Contract Award is received as information; AND THAT, Community Services Committee recommends to County Council that the Director of Lanark Lodge be authorize to award Laser Electric Ottawa Ltd., the contract to Retrofit Lighting for a value of $202,625.00 plus applicable taxes. AND THAT project is financed through capital budget, hydro grant and surplus revenue funds based upon a reduction in tax levy required due to additional unbudgeted provincial funding. 2. PURPOSE To provide Council with a report on the results of the Invitation to Tender (ITT) for a lighting retrofit for Lanark Lodge, that closed on August 24, 2011. 3. BACKGROUND Council passed a motion to allow Lanark Lodge to seek qualified vendor(s) to replace the current lighting system because the current system has reached its end-of-life and energy savings could be realized through the lighting retrofit. An outside consultant was hired to project budget estimates for the Lighting Retrofit. These budget estimates formed the basis for approval of funding. Initially a RFT (Request for Tender) was published under RFT LL#003-2011 for the lighting retrofit. A total of 2 bids were received, and both were significantly over budget and the RFT was closed with no award. An Invitation to Tender was issued to the original 4 vendors who attended the mandatory site visit under RFT LL#003-2011. The scope and document were completely re-written and published in July 26, 2011 with a closing of August 24, 2011. The following changes were made: a. removal of surety requirements b. included a condition in the event that bids exceeded original budget c. extended completion date of lighting retrofit d. removal of mandatory site visit 4. DISCUSSION The County received bids from four (4) vendors.. See Appendix A for a comparison of the coverage differences. 5. ANALYSIS AND OPTIONS During the tendering process, significant market changes occurred resulting in shortages of phosphorous to manufacture lamps. This resulted in market-wide shortages of availability of stock and industry-wide imposed increases of 15% effectively September 1, 2011. Refer to Appendix B for a copy of the letter announcing the cost increases. To counter this increase, Lanark Lodge secured stock at current market prices with a guarantee that all lamps for this project would be available at time of contract award. There are timeline considerations for awarding of this tender, initiation of work and completion of the outlined work to ensure that Lanark Lodge can access the approved grant monies from Ontario Hydro for $ 60 000. The lighting retro-fit project is required to be completed by April 30, 2012 to remain eligible to secure the grant monies. Appendix A shows that Laser Electric had the lowest overall bid. Reference checks conducted for Laser Electric were satisfactory. The cost of the bid exceeded the original budget estimate by $68,966.25. The ITT stated the following could occur in the event that bids exceeded the original budget: a. negotiating an extended deadline based on availability of funds in 2012 capital expenses for Lanark Lodge, approved by County Council; or b. negotiate a contract based on availability of surplus funds in 2011 budget, and approved by County Council; or c. any combination of (a) and (b) above; or d. cancel the tender. It was expected that the basement portion of the lighting retrofit to be postponed based on option c above, but with the recent availability of additional revenue, all lots could have the lighting retrofit completed in 2011. 6. FINANCIAL IMPLICATIONS The original budget set for this project was estimated at $160,000, including HST. From the $160 000 budget for this project: $100 000 of the budget is approved 2011 Capital funds and $ 60 000 is from the Ontario Hydro grant. Lanark Lodge is in receipt of additional operating revenue in the year 2011 as outlined in Report LL-11-2011; the new Revenue amongst all three funded envelopes that has not be earmarked equates to $ 178 647 which provides an opportunity for surplus for the Accommodation envelope that can be spent on building repairs, maintenance and upgrades. 7. LOCAL MUNICIPAL IMPACT None. 8. CONCLUSIONS Given that the Laser Electric bid provided all the requested coverage in the ITT and their price was the lowest the recommendation is to award the Lighting Retrofit to Laser Electric. June 6, 2011 Over the last few weeks we have worked to understand the impact of new environmental initiatives recently enacted in China. Specifically, TCP and all other lighting manufacturers are realizing unprecedented increases in the cost of rare earth materials, which include the phosphors used in fluorescent lamps. This year the cost of phosphor has gone up nearly 900% and continues to rise. These increases are dramatically impacting the cost to manufacture fluorescent tubes, LEDs, and other electric goods, as rare earth elements are essential to the manufacture of these products. Effective July 5, 2011, prices for TCP products will increase an average of 15% to cover the cost increases we have experienced. Specific increases will vary by product line according to the amount of phosphor contained in an item. In anticipation of these phosphor-related increases, TCP has bolstered its current inventory position on many top items to ease your transition to new price levels.
