T-MSS/.11.4.1 MSC.4/Cir.76 6 Otober 005 REPORTS ON ACTS OF PIRACY AND ARMED ROBBERY AGAINST SHIPS Third quarterly report (July to, and inluding, September 005) 1 The Maritime Safety Committee, at its sixty-fifth session in May 1995, instruted the Seretariat to issue, as from 31 July 1995, monthly reports of all inidents of piray 1 and armed robbery against ships reported to the Organization and, in addition and on a quarterly basis, omposite reports aompanied by an analysis, on a regional basis, of the situation and an indiation whether the frequeny of inidents was inreasing or dereasing and advising on any new feature or pattern of signifiane. Further and as instruted by the Committee (MSC 75/4, paragraph 18.41), the Seretariat has, sine July 00, started lassifying separately any reported inidents of piray and armed robbery at sea (international or territorial waters) vis-à-vis ats of armed robbery allegedly ommitted in port areas, as well as attempted ats of armed robbery. Annexed hereto is a omposite report overing all reported inidents of piray and armed robbery against ships whih ourred between 1 July and the end of September 005, and a regional analysis thereof, inluding a distintion between ats of piray, ats of armed robbery against ships and attempted attaks. 1 Piray is defined in the 198 United Nations Convention on the Law of the Sea (UNCLOS) (artile 101) as follows: Piray onsists of any of the following ats: (a) any illegal ats of violene or detention, or any at of depredation, ommitted for private ends by the rew or the passengers of a private ship or a private airraft, and direted: (i) on the high seas, against another ship or airraft, or against persons or property on board suh ship or airraft; (ii) against a ship, airraft, persons or property in a plae outside the jurisdition of any State; (b) any at of voluntary partiipation in the operation of a ship or of an airraft with knowledge of fats making it a pirate ship or airraft; () any at initing or of intentionally failitating an at desribed in subparagraph (a) or (b). Armed robbery against ships is defined in the draft Code of Pratie for the Investigation of the Crimes of Piray and Armed Robbery Against Ships (resolution A.9(), Annex, paragraph.) as follows: Armed robbery against ships means any unlawful at of violene or detention or any at of depredation, or threat thereof, other than an at of piray, direted against a ship or against persons or property on board suh ship, within a State s jurisdition over suh offenes. MSC.4/Cir.76 - - 3 The areas most affeted over the period under review were, one again, South China Sea (5 inidents, up from 3 ompared with the last quarterly report), East Afria (17 inidents, up from 8 reported last quarter), in the Indian Oean there has been an inrease in the number of inidents (13 inidents, up from 7), West Afria (10 inidents, up from 6 reported last quarter), South Ameria (10 inidents in total, 6 inidents in the Caribbean Sea area, 3 inidents in the Paifi and 1 inident in the Atlanti Oean areas, 4 up from the total reported last quarter) and the Malaa Strait (3 inidents, down from 7). Most of the attaks were reported in port areas while the ships were at anhor or on berth. 4 During the period under review, the fate of eleven rew members is unknown, 7 rew members were held hostage/kidnapped, 15 rew members were assaulted, 7 rew members were injured, and 1 ship and tugs/barges were hijaked/missing. In several of the inidents reported, the rew were violently assaulted/attaked by individuals or groups of two to ten persons arrying guns or knives. 5 The total number of ats of piray and armed robbery against ships so far reported to the Organization is 3,9 out of whih 78 ourred during the third quarter of 005.
