SAGAMORE HILLS TOWNSHIP ZONING COMMISSION MEETING Monday, August 24, 2015 media notified The meeting was called to order by Chair, Dr. David Koncal at 7:30 pm. R/C: Woodruff-present; Chasar-present; Lachina-present; Dr. Koncal-present; Witkiewicz-present. Attorney Jeffrey Snell was in attendance. Dr.Woodruff made a motion to approve the July 27, 2015 Regular meeting minutes as submitted. Seconded by Mr. Witkiewicz. R/C Vote: all in favor Dr. Koncal stated the first order of business was Brentwood Health Care Center. The board received the easements that were requested, and Dr. Koncal said he did not see any changes to the final plans. Dr.Koncal asked whether anyone had any comments about the Brentwood Health Care Center. Mr. Chasar thanked Mr. Classen for doing everything that was asked of him. Dr. Koncal asked whether there were any comments from the floor on the Brentwood Health Care Center and their addition. Mr. Chasar made a motion to accept the addition that Brentwood would like to make. Seconded by Dr. Woodruff. R/C Vote: all in favor Mr. Classen asked whether there was any discussion on the next step with the Board of Zoning Appeals. Mr. Saunders said the Board of Zoning Appeals meeting was scheduled for Wednesday, September 9, 2015 at 7:00 p.m. Mr. Chasar stated he would be attending the meeting. Dr. Koncal stated the next item on the agenda was Sagamore Land Properties, Hidden Ridge Subdivision. Mr. Weber said they are proposing a 20 lot cluster development, and feel that they have met all the requirements of the cluster development zoning and residential plots. There are storm water retention basin easements in the southeast corner with a single entrance on Dunham Road at the north end of the site. There is one area identified as wetlands, also within a storm water management easement. The development meets the 40% open space requirement, and provides sufficient separation between Eaton Estates and the proposed lots on the east side of the development. Mr. Weber asked whether there were any questions. Dr. Koncal said when he first saw the plans he was concerned that the retention basin might be in the open space. After checking the math, it is not in the open space. The township engineer also reviewed the plans, and agreed that everything was fine.

Monday, August 24, 2015 Page 2 Dr. Koncal suggested a week before they start on the retention basin to contact Mr. Don Saunders to take some pictures because they will have to go across some open space with heavy equipment to get to the retention basis. He would like to see it restored to the same open space after they are through as it was before the retention basin was put in. Both the board members and Don Saunders agreed. Mr. Chasar referenced some comments made by Euthenics, the township engineer, regarding Course 1, 2, 3 and so forth, but had a question on Course 6 that is at the entry to Dunham Road. Mr. Chasar said he did not understand the written description of the course and what is written on the plat because he is not a surveyor. Mr. Chaser asked Mr. Weber to please check this information. Mr. Weber responded the legal descriptions that are on the front page of the drawings may have been on the original deeds, and sometimes there are some discrepancies when a surveyor overlaps what another surveyor has already done. Mr. Weber said they will make sure it is consistent. Mr. Chasar also asked Mr. Weber to check Course 7. Mr. Snell reviewed the process if this initial concept is approved. Dr. Koncal asked whether there were any comments from the floor. Dan Greathouse, 11673 Dunham Road, asked what the time table was for the project. Mr. Karnow responded their goal was to start moving dirt in late fall of this year, and have lots available for sale in the spring of 2016. Dale Krupa, 664 Continental Drive, shared his concerns with water runoff and sewer. There were several basements on the backside of Continental Drive that were flooded in 2006. Dr. Koncal said this development has to go through the Summit County Engineer s office. There are also a number of different people that are involved in storm water management. The retention basin planned for this development should improve the water situation, not make it deteriorate. Doug Piper, 608 Continental Drive, asked what the estimated time was for completion of this project. Mr. Karnow said it will take about three years to complete. Dr. Koncal said Eaton Estates took half the time it was projected to take. Dale Krupa, 664 Continental Drive, asked whether this was a planned development or association where there may be some models that customers can pick from and then purchase. Mr. Krupa asked whether lots were already presold, and because of the size of the project, whether financial statements would be provided to make sure the money was available for the project. Mr. Karnow said there would be no problems from a financial standpoint with this project. Mr. Karnow has about a half dozen clients that are already looking at this project moving forward. Mr. Schweikert said he had a question from a lady on the phone about the distance of the space between the backyards of Continental and the backyards of the new proposed development. Mr. Weber said the distance from the common property line for the open space is roughly 145 feet, plus a 10 ft. setback. The nearest home was about 125 feet. Roughly there is about 275-300 feet between back of house to back of house.

Monday, August 24, 2015 Page 3 Mr. Snell mentioned on the preliminary plan there is a swale that takes the water on the backside of lots 7 through 17 and pulls it into the retention area. Mr. Snell asked Mr. Weber to explain how this would work. Mr. Weber gave an explanation of the stormwater management plan. Ryan McNutt, 576 Continental Drive, asked what the selection process was for the retention basin. Mr. Weber said it is the lowest point on the site and stormwater always wants to go to the lowest point. The county also requires that they do their best to put stormwater into an existing channel or existing storm sewer. There is an existing storm sewer and existing channel near the planned retention basin. Mr. McNutt expressed his concern that the storm sewer Mr. Weber mentioned floods often, and the wetlands there also hold water. Mr. Weber said the county has regulations on stormwater and will review everything. Gary Spriggs, 8588 Eaton Drive, President of the Association of Eaton Estates, said we do not own the storm system of water control, the county does. Dale Krupa, 664 Continental Drive, said there were areas on the preliminary plan where homes were flooded on Continental Drive. Patti Robertson, 503 Alliance Drive, asked Mr. Weber whether anything was going to be done about offsetting the flooding issues, and whether the county required them to have another entrance to this development. Ms. Robertson asked whether they anticipated a lot of traffic on Alliance Drive to get to the back way. Ms. Robertson said she knew the entrance was on Dunham Road, but didn t want people coming through yards like they did on the school property on Dunham Road. Gary Spriggs, 8588 Eaton Drive, said in relation to the easement on the Eaton Estates property, there would be no access through it. Mr. Snell asked anyone who experienced flooding to contact Joanne Taylor by email. There was a discussion on the retention basin and storm water issues. A resident expressed concerns about what lighting poles would be used in this development, whether there would be a traffic study conducted, and whether there was a tree protection plan. Mr. Weber said all of those items will be available when the final engineering is provided and approved by the county. Doug Piper, 608 Continental, asked whether there would be a Phase I, II, III, etc. Mr. Karnow replied it would be one single phase development. Dale Krupa, 664 Continental Drive, said most of the heavy trees will be gone because most of them are in the middle of where the lots will be started. Zachary Hebebrand, 632 Continental Drive, asked what the approximate cost and size of the homes. Mr. Karnow said the ranch home will be about 2,000 sq. ft. and the colonial about 2,800 sq. ft. The starting price will be $340,000 and up.

Monday, August 24, 2015 Page 4 Mr. Hebebrand asked for confirmation of the definition of open space, and also said he is not convinced that adding 20 homes and putting the stormwater into a retention basin will work. Dr. Koncal closed the floor for comments. Dr. Koncal asked the board whether they had any more comments. Mr. Lachina made a motion to accept the preliminary plans for the Hidden Ridge Subdivision. Seconded by Mr. Witkiewicz. R/C Vote: all in favor Dr. Koncal announced a 5 minute recess at 8:30 p.m. Dr. Koncal asked Jeffrey Snell and Don Saunders to present the pole barn issue. Per Mr. Saunders, Pam Oliver, owner of the apartments at 400 W. Aurora Road, has applied for an accessory building rebuild. Last winter the existing building collapsed, and more than 50% of the building was destroyed. Ms. Oliver (daughter of Jim Hunt, former owner) wants to rebuild this building, which she uses as storage. There is nothing in the zoning code that would allow Mr. Saunders to issue them a permit to rebuild the building. There was a short discussion about the property and the building. Mr. Chasar mentioned he was on the board when Jim Hunt came and applied for the original permit for this accessory building. Mr. Chasar said Pam Oliver is his neighbor and that he would abstain if a vote were taken. Dr. Koncal stated his opinion was to let Ms. Oliver rebuild the building. Dr. Koncal asked Jeff Snell what his opinion was. Attorney Jeffery Snell said he was conflicted on this because he represented Jim Hunt (former owner of the property) over the years before he became a trustee. He did not represent him on the original building permit process of this accessory building. Mr. Snell said this is a building on a commercial piece of property, and it was destroyed due to last year s harsh winter. Mr. Saunders said you are allowed one building on a commercial lot. The discussion continued on the building. Dr. Woodruff made a motion to approve the replacement of this building on its current footprint with the understanding that under current zoning this would be the only building allowed on this commercially zoned lot. Seconded by Mr. Witkiewicz. R/C Vote: Dr. Woodruff-aye; Chasar-abstain; Lachina-aye; Witkiewicz-aye. Motion passed. Jeffery Snell led a discussion on the fence issue with two residents living on McNeil. Jeff Snell wanted to keep the board informed. Mr. Snell said there are two homes with some serious problems; one at 708 ReWinkle and the other at 587 McNeil. There was a short discussion on these two homes. Mr. Saunders said the owner of 708 ReWinkle received a letter informing him he had 30 days to fix the deteriorating condition of the home.

Dr. Koncal asked Jeff whether he had an opportunity to work on a paragraph from Chapter 14 that was discussed at the July meeting. Jeff responded that he dictated something on this and will get it to them. There was no further business. Dr. Woodruff moved to adjourn at 9:16 p.m. Seconded by Mr. Witkiewicz. R/C Vote: all in favor
