HIRE PERIOD The motorhome is leased for the period from _ through _. The period covers _ (_) days. The lease begins on Saturday after 1 pm and ends _ at 10 am. 2. SUBJECT OF RENTAL AGREEMENT The subject of this Agreement is the motorhome Chiipsy S/Chiipsy XL, Chiipsy M (hereon: motorhome), registration number KK_, with the equipment stated in the Takeover record for a period agreed upon in the first article of this Agreement. 3. HIRE PRICE 3.1. The motorhome hire price is stated in the pricelist. The price already includes VAT (22 %), compulsory and liability insurance with 1 % deductible and a Green Card. 3.2. The price includes: a) unlimited mileage b) 400 km mileage allowance for short-term rental, namely for a 3-day period (Weekend arrangement). If the hirer exceeds the defined mileage allowance, he is charged 0,30 EUR per every additional kilometre. 3.3. The price does not include the permission to drive a foreign vehicle outside Slovenia (when the country of destination is not an EU member). The price does not include toilet chemicals (1 l included), extra gas, biodegradable toilet paper and garbage bags. 3.4. The price does not include fuel, bed linen and towels. 3.5. Any motoring offences committed during the motorhome hire period are charged to the hirer s account. 4. PAYMENT 4.1. When signing this Agreement, the hirer pays a booking fee of 40 % of the value of hire sum. Booking is only confirmed when we receive payment of the booking fee. The balance of your hire sum and costs must be paid for at least 14 days before the hire commences. In the opposite case the booking is considered cancelled. 4.2. In the case of returning the motorhome before the expiration date of the Agreement, the price stated in the Agreement stays/remains valid. If the motorhome is not returned on time, you will be charged 50 EUR for the first hour and 110 EUR for every following hour.
5. BOOKING CONFIRMATION 5.1. A security deposit of 600 EUR for Chiipsy XL and 400 EUR for Chiipsy S is required and should be paid to the lessor upon delivery at the latest. The deposit covers the following charges: - 1 % deductible and loss of liability insurance bonus in case of car accident or vehicle damage. - minor outside and inside damages on the motorhome. - missing equipment. - damage which is not covered by the liability insurance. - travel expenses for taking the motorhome from the company s seat to the authorised service provider. 5.2. If at the redelivery the motorhome is not damaged, the deposit will be returned in full. Security deposit will be transferred to the hirer s transaction account within eight workdays following the day of the motorhome redelivery. 6. CANCELLATIONS 6.1. The hirer has the right to cancel the motorhome booking in writing. In this case the lessor has the right to be reimbursed for cancellation cost. The amount of expenses depends on the time when the hirer notifies the lessor of his cancellation. 6.2. Booking cancellation sum consists of lump-sum cancellation cost that depends on the day of cancellation and totals: - if the booking is cancelled over 28 days before the hire commences - 10% of the total rent sum. - if the booking is cancelled between 21 and 27 days before the hire commences - 20% of the total rent sum. - if the booking is cancelled between 14 and 20 days before the hire commences - 30% of the total rent sum. - if the booking is cancelled between 7 and 13 days before the hire commences - 60% of the total rent sum. - if the booking is cancelled between 2 and 6 days before the hire commences - 85% of the total rent sum. 6.3. If the hirer cancels the booking 1 day before the hire commences or on the day of collection or if he does not pick up the motorhome, the lessor reserves the right to keep the total rent sum of the motorhome. 6.4. If the hirer, at his own request, interrupts the travel before the day stated in the Agreement, the lessor, upon the return of the motorhome, is not obliged to refund the rent sum for the unutilised hire period. 7. VEHICLE COLLECTION, REDELIVERY AND CLEANING 7.1. The hire period usually lasts from Saturday to Saturday. 7.2. The motorhome is collected between 1 pm and 5 pm on the first day of the hire period. 7.3. The motorhome is redelivered on the last day of the hire period until 10 am. Only in this case the day of collection and the day of redelivery are regarded as one day of motorhome rental. 7.4. Prolongation of hire period is not possible unless by prior agreement. Collection and redelivery of the motorhome take place in Krško at the company s seat or by agreement. 7.5. When redelivered, the motorhome has to be clean, have full tank of fuel, empty drinking water tank, empty waste water tank and empty toilet cassette. 7.6. In the case when the fuel tank is not full, any reimbursement for missing fuel will be charged on the basis of the Petrol s daily price list, plus 40 EUR for fixed expenses. 7.7. Delivery costs/vehicle cleaning: In the offer, fixed delivery costs are charged, totalling 120 EUR for XL and 50 EUR for S, which also include cleaning of the vehicle. 7.8. Upon delivery the motorhome is fully inspected (equipment, mechanics, car body, the engine etc.), operation of all devices in the motorhome is checked and a Takeover record is
made. All defects, missing equipment, motorhome damage etc. are written in the Takeover record. All ascertainable damage is photographed and documented. At the redelivery, the condition of the motorhome and operation of all devices are checked on the basis of the Takeover record. The hirer is responsible for all defects and damage that were not ascertained at the collection. 7.9. Lost equipment is charged on the basis of the price list the hirer may find on the list of the received equipment. 7.10. All damage, defects and extra cleaning are charged according to the repair and cleaning price list. 7.11. In case of delay at the motorhome redelivery caused by vis major, the hirer is obliged to notify the lessor by phone, state the reason for the delay and approximate time of the motorhome redelivery. 8. THE DRIVER 8.1. On the day of hire, the driver (or drivers) of the motorhome has to be at least 21 years old. All drivers must have held a valid driving licence for minimum of three years. 8.2. The driver (or drives) commits himself not to consume alcoholic beverages before and while driving and not to drive under the influence of substances that decrease psycho motoric abilities (medicines, drugs, etc.). In the opposite case the insurance company will not cover the cost and the insurance policy will not cover the damage. 8.3. By signing the Agreement, the driver confirms the accuracy of his personal identification data. 9. PROHIBITED USE OF THE MOTORHOME 9.1. The hirer obliges himself to use the motorhome exclusively for tourist purposes and by no means for any illegal purposes. 9.2. The hirer must not use the motorhome in the following cases: - participating in biker s meetings with the motorhome or using the motorhome as a test vehicle. - transporting dangerous substances, explosive, combustible, poisonous or materials dangerous in any other way. - transporting weapon, drugs and alike. - to lease the motorhome to a third person. - driving through war-affected and other dangerous areas. 9.3. The hirer and the passengers are not allowed to smoke in any part of the motorhome, enter with shoes with rough soles, jump from the bed on the floor, keep domestic animals inside the vehicle and use the vehicle carelessly or negligently. In case of infringement of this article, the lessor is entitled to reimbursement for all costs arising in connection with this article. 9.4. In case of smoking inside the motorhome, the hirer is charged 150 EUR for the covers washing and deep cleaning. 10. TRAVELLING ABROAD 10.1. The motorhome can be used for travelling to all European countries except for those that are war-affected or travelling there is undesired for other reasons. Travelling to those countries is permissible only with the lessor s prior agreement and adequate motorhome insurance. 10.2. In the case of travelling to a country where higher risk of theft, break-in or other damage that might be caused to the motorhome exist, the hirer has to provide for adequate security and protection of the motorhome. 10.3. On May 1, 2009 a new act on changes in Hospitality and Catering Andustry Act (Zakon o izmjenama Zakona o ugostiteljskoj djelatnosti) came into force in Croatia. According to this Act, camping, parking or lodging for the night outside camps or places intended for parking are offences that are punished with fine. Illicit camping on private properties may lead to sealing the motorhome for 60 days. Unsealing it is a law offence. The hirer strictly binds
himself not to infringe this act. In case of infringement the hirer himself bears responsibility and covers all costs arising from the infringement, covers all expenses of the lessor s income loss and all damage to the motorhome caused in the time of sealing. 11. VEHICLE REPAIRS If the motorhome breaks down during the hire period (during travel) the hirer tries to do away with the defect at the nearest authorized service provider, but only with previous consent of the lessor. If the hirer is not responsible for the breakdown, he should, at the motorhome redelivery, present the original invoice with the name of the motorhome owner written on it. Only and exclusively then the lessor provides a refund for the hirer s expenses. 12. WHAT TO DO IN CASE OF AN ACCIDENT? 12.1. The hirer obliges himself that he will, in the event of an accident (road accident, theft, break-in, parking damage etc.), report the eventual damage on the motorhome to the police (competent for the country where the accident has happened) and immediately call the lessor. 12.2. The hirer has to hand over the adequate documentation, a European Accident Statement, a motorhome damage sketch. The Accident report has to include the names and personal identification data of all accident participants. 12.3. In the case of drinking and driving the hirer bears all costs. 13. CAR INSURANCE The motorhome has liability insurance with 1 % deductible. 14. HIRER RESPONSIBILITIES 14.1. The motorhome may be used exclusively by the hirer stated in the Agreement. 14.2. The hirer has to observe traffic regulations. 14.3. The hirer shall be liable for the value of the liability insurance deductible in respect of any damage as a result of his guilt and, in this respect, the lessor s cost on account of loss of bonus. 14.4. The hirer bears unlimited responsibility in case the damage is caused by the unauthorised driver, excessive load and by any other prohibited ways of usage. 14.5. In case the insurance company for any reason refuses the payment, the hirer is obliged to cover the damage. 14.6. For damages not originating from the road accident, the hirer himself bears responsibility. 14.7. The hirer obliges himself to have the documents and motorhome keys always on him when leaving the motorhome. In the opposite case the insurance company will not cover the costs arising from motorhome theft, which means the hirer has to cover all costs himself. 14.8. The hirer has to use the motorhome as a careful and conscientious holder. 15. LESSOR RESPONSIBILITIES 15.1. The lessor provides the motorhome in perfect technical condition, without defects that might cause an accident. 15.2. The lessor is not responsible for the hirer s personal property left behind or forgotten in the motorhome. In the cases of vis major, damaged or not roadworthy motorhome on the first day of the hire period, the parties either re-arrange the hire for another day or the lessor provides a full refund of amount the hirer has paid. 15.3. Chiipsy will bear no responsibility in any other case. 16. GOVERNING LAW Failure to comply with the articles of this Agreement or any dispute may be settled in the District Court in Krško. List of equipment and Takeover record are also part of this Agreement.
