Next week the team will be meeting on site to discuss retaining wall options. Additionally, boring will take place on the site in the upcoming months to make determinations about the foundation needed. Easements: The Assessor has identified an independent appraiser who will be able to assist the City with the needed appraisals. We hope to have a proposal for this work next week. Website Development Representatives from several City departments and Alive met with the two vendor finalists this week. Both presentations were impressive and illustrated that both vendors could meet our needs. The team is now experimenting with both vendors sandboxes (dummy sites that allow us to explore the site and understand how easy it is to use). The team will meet on Monday to make a final recommendation of a vendor. This recommendation will be presented to the Council on April 8 th.

CITY MANAGER S WEEKLY REPORT March 27, 2015 Page 2 Bike Path Extension The Act 250 Hearing for the Bike Path Extension Project has been scheduled for Thursday, April 2, 2015 at 6:30 P.M. in the City Council Chambers. There will be a site visit starting at 4:00 P.M. the same day. The Central Vermont Regional Planning Commission s Project Review Committee received a presentation from the Director of Public Works about the Bike Path Extension Project this week. By unanimous vote, the committee agreed to support the project because it is well conceived and has regional significance. Goals As discussed this week, staff will prepare a draft goals statement which will include action steps, target completion dates, financial realities and recommended priority order. Mountaineers Lease The Lease between the Vermont Mountaineers baseball team and the School Board for use of Recreation Field needs to be renewed next year. The Superintendent of Schools has invited me to sit in on the lease discussions along with the Mountaineers General Manager, the Recreation Director and him. Our first meeting was this past week. Legal Hallsmith vs. City, Fraser, Baker Appealed to Supreme Court. Represented by Bernie Lambek. Oral arguments were held on December 18, 2014. Awaiting decision VCFA vs. City, Tax Appeal. Status conference held on Wednesday. Deadlines have been set for filings so that case is ready for hearing by June 15. Represented by Robert Fletcher. A male suspect entered the store, pointed a handgun at the store owner who had been working behind the counter and then demanded money. The suspect subsequently fled the store on foot heading in the direction of the Hunger Mountain Co-Op on Stone Cutters Way. As the suspect was fleeing the store, the store owner was able to observe the suspect remove a mask he had been wearing at the time of the robbery. The owner described the suspect as a white male, 20-25 years of age, approximately 5 7 tall with a light beard and wearing a black, puffy, winter jacket, black pants and a black ski mask with eye and mouth openings. Facos Chief of Police PRESS RELEASE For more information, contact: Captain Neil Martel or Corporal David Kachajian (802) 223-3445 FOR IMMEDIATE RELEASE Sunday, March 22, 2015 Burglary Investigation On Sunday, March 22, 2015 at approximately 10:10 p.m. the Police Department responded to an alarm activation at Simon s Market/377 reet in, VT. Upon arrival on scene officers found an open door and upon checking the premises, determined that a burglary occurred. Money and store merchandise were taken during the burglary. Video surveillance from inside the store showed the suspect to be a white female wearing a gray hoodie, black jacket, black pants, black mask and gloves. The suspect fled on foot and may have left the area in a vehicle of unknown make and model parked nearby. The City is taking a number of precautions to minimize damage in downtown. Public Work and the Fire Department have extended the effluent discharge (the warm and treated water produced by the Waste Treatment Plant) along the Winooski to a point near the High School football field in an attempt to further weaken the ice and allow open channels to improve the ice flow. The City has an excavator on site and an operator on standby if it is necessary to manually break up an ice jam. The City is in contact with our neighboring communities and the State to coordinate efforts. And Police and Fire are monitoring River levels hourly to keep all informed. In the event it is needed, the City will open the Emergency Operations Center to coordinate efforts. At this time, the City advises residents and businesses with flood-prone basements in to prepare for flooding in low lying areas. Specifically, those properties on Elm, Langdon, and Main Streets should check their basements, remove items from the floor of the basements, and consider potential electrical and heating system issues associated with basement flooding. City of Department of Public Works Memorandum To: From: William Fraser, City Manager Thomas McArdle, Director Date: March 27, 2015 Subject: Dual Utility Poles Status Update This memorandum is provided to report the findings of my investigation into the outstanding matter of dual utility poles located within City Limits. From this investigation, I am also able to provide a general overview of how this issue became such a problem and to provide an approximate status update. Definition & Explanation of the phrase dual utility poles / dual poles : In this context, dual poles refer to a pair of utility poles in proximity to one another and typically less than 10 apart. Utility poles frequently are used to support multiple wires and cables owned by local area service and communication providers. In this manner, a single pole is shared by the various companies. Either the telephone or power company is responsible for and is the owner of a pole, although some are shared, and these jurisdictional responsibilities are equitably distributed across the state by agreement and identified as set areas. In, it is the telephone company s set area. There is an order of attachment to utility poles assigned to the various companies as established by the National Electrical Code and cooperative agreements. The power lines occupy the topmost section of the pole, followed by 3rd party communication companies such as Sovernet, VTel, 1 st Light, and Comcast. Fair Point (telephone land line) is the lower-most attachment. When the telephone company replaces a pole in its set area for whatever reason, be it age, condition, size or height, or a new service request by one of the respective companies, a new pole is set next to the existing pole which results in the dual utility pole condition. Following the set of the new pole, the respective utility companies must then transfer their facilities beginning with the power company at the top. In most cases, the lines and cables can simply be swung over to the new pole by cutting off the pole as they move downward, but in some cases, where insufficient slack exists, new cable may be required. Finally, when all transfers have been completed including pole anchors, the telephone company removes the pole or cuts it off at ground level depending on the circumstances. A dual pole condition may persist for several months due to the complex coordination issues between several various companies. No transfer can occur until the line above has been moved. Background: The information below emanates from correspondence with Jeff Smith, Senior Network Engineer, Fair Point Communications. I sincerely appreciate his assistance with this review and his commitment to the ultimate resolution of the matter. I also spoke with representatives of GMP and Comcast in the development of this report and they were also very helpful and supportive. As Jeff stated, Fair Point is aware that the City Council and the residents would like to avoid a repeat of 5 years ago, when reet, Elm Street and Liberty Street were littered with dual poles in addition to various others throughout the city. The situation arose due to various factors: 1. Prior to Fair Point s purchase of the land lines, Verizon was not spending money on infrastructure. It is speculated that this may have been due to their planned exit from the market. Fair Point discovered evidence of a lack of routine maintenance and a large backlog of incomplete or inactive work orders 2. From 2010-2014, in a collaborative effort between Fair Point and GMP, a significant amount of 'make ready' work had to be performed to allow other carriers, who had received millions in federal stimulus funding, to attach to their lines to the existing pole

This work led to the installation of a significant number of new replacement poles (dual poles) and was a drain on available resources on both companies. 3. A company that specializes in utility pole condition assessments hired by Fair Point and other pole owners conducts inspections on a ten year cycle. The company identifies poles requiring replacement with a red tag and notifies the respective companies. This review was conducted several years ago in and was one of the primary reasons for numerous pole replacements. Moving Forward: Over the last couple of years, Fair Point and the other pole users have made considerable progress cleaning up dual pole locations on Liberty, Barre and Elm Streets, which are now mostly clear of work orders. As Jeff sated, Fair Point is committed to continue this effort and I have asked that Main Street (North Street College Street) be an area to focus attention on this construction season. Jeff believes that with cooperation from the partner companies, they should be able to complete the work this summer. He also stated that if we have particular areas of concern, we should pass them on to him. A spread sheet inventory of dual pole locations was prepared and presented for our information (attached). This inventory indentifies both completed and incomplete utility work. With 96 completed over the last 5-6 years, there are currently 74 dual pole projects awaiting completion in town or in the immediate vicinity (including a few new dual poles). Of this outstanding work, a large number will be addressed this summer, but a reliable schedule cannot be produced at this time. Much depends on resources, service demands and the line transfer schedules by other involved companies. I also spoke with the area engineer for Comcast, Bruce Bowser, who stated that they are in the midst of a state-wide project to clean up dual poles.we will certainly do our part to assist with the clean up in. Bruce mentioned that Comcast, GMP and Fair Point all subscribe to the National Joint Utility Notification system (NJUNS). This is a networking software method by which member utilities can keep each other apprized of utility pole work. It is not easy software to use and while GMP, Fair Point and Comcast are members, many of the smaller utilities (Sovernet, VTel, etc.) do not belong. Therefore it is not always a reliable means of coordinating work orders between the various companies. Bruce said that Comcast is using a contractor to clean-up and maintain the NJUNs database to assist them in this effort.
