General Aviation General Aviation (GA) aircraft are generally comprised of privately and commercially operated aircraft; and to a lesser extent, public aircraft. CFR definitions assist CBP officers in determining the difference between private, commercial, and public aircraft arriving in to and departing from the United States. 6

General Aviation Aircraft Arrivals CBP processes over 130,000 GA aircraft arrivals every year. 11,330 per month 370 per day From more than 80 foreign countries. 7

General Aviation Aircraft Arrivals CBP ensures every GA aircraft arriving in the United States undergoes the following routine processes: APIS Manifest Submission, Processing Landing Rights/Permission to Arrive Physical Aircraft Inspection In Person Inspection USDA Garbage Handling 8

Advance Passenger Information System (APIS) All commercial and private air operators regardless of size are required by legislation and regulation to electronically transmit APIS data for all passengers and crewmembers to CBP for all commercial and private aircraft arriving in to and departing from the United States. This APIS data is processed within seconds - before the flight departs and risk-based analysis decisions are made that have a direct impact on the scope of inspection and processing of the aircraft and travelers. GA APIS compliance is measured at over 99.9%. 9

Landing Rights/Permission to Land There are 384 airports where CBP services are normally available. Prior to departure from the foreign port or place, all GA aircraft operators must obtain permission to land. Certain additional restrictions and procedures apply to aircraft arriving in to the US from areas south of the United States as defined in 19 CFR 122.23. If the GA aircraft is arriving from South, the aircraft must arrive for CBP processing at the CBP designated airport nearest to the aircraft s border crossing point, unless an Overflight Exemption has been granted by CBP. 10

Physical Aircraft Inspection Upon arrival of the GA aircraft, CBP officers and CBP Agriculture Specialists are responsible for enforcing CBP laws in addition to laws of other U.S. agencies such as the Federal Aviation Administration (FAA), the Food and Drug Administration (FDA), United States Department of Agriculture (USDA), U.S. Fish and Wildlife Service, etc. CBP officers are responsible for processing all travelers (passengers and crewmembers) and articles, as well as physically inspecting the GA aircraft, storage compartments, and cargo. 11

In Person Inspection Under 19 CFR 162.6, All persons, baggage and merchandise arriving in the Customs territory of the United States from places outside thereof are liable to inspection by a CBP officer. Unless exempted by diplomatic status, all persons entering the United States, including U.S. citizens, are subject to examination, inspection, and/or search by CBP officers. Traveler identification is checked against APIS data transmitted, travel documents presented and law enforcement databases. As part of CBP s traveler processing, a traveler s citizenship, admissibility, reason for travel, and accompanied items are assessed and subject to further examination. 12

Regulated Garbage Handling In accordance with 7 CFR 330.400-330.403 and 9 CFR 94.5, regulated garbage is not allowed to be imported, except from Canada. Because of these regulations, GA aircraft arriving from foreign regions, other than Canada, must arrive at airports approved and capable of handling and processing international garbage as required by the US Department of Agriculture. Of the 384 airports where CBP services are normally available, only 207 possess USDA compliance agreements. Upon arrival in to the United States, CBP Agriculture Specialists at the port of entry ensure compliance with proper procedures for the handling, removing, and processing of international regulated garbage. 13

General Aviation Aircraft Arrivals Summary CBP ensures every GA aircraft arriving in the United States undergoes the following routine processes: APIS Manifest Submission, Processing Landing Rights/Permission to Arrive Physical Aircraft Inspection Aircraft Inspection In Person Inspection USDA Garbage Handling 14

Preclearance of General Aviation Aircraft Of the 15 CBP preclearance sites, only one, Shannon, Ireland, supports General Aviation aircraft as part of the preclearance agreement. 15
