TOWN OF DEXTER PLANNING BOARD MINUTES NOVEMBER 6, 2014 BOARD PRESENT: Peter Haskell, Geraldine Mountain, Dick Gilbert, Susan Long, Rick Fanjoy EXCUSED ABSENCE: Kevin Keene STAFF PRESENT: Al Tempesta, Susan Page ITEM #1: MINUTES Motion: Geraldine Mountain Vote: 4-1 (Haskell Abstain) ITEM #2: Shoreland Zone Application Map 38 Lot 04 Memory Lane Elaine Kitrosser Al Tempesta apologized to the Board for Mr. Santos not being at the meeting. He said that he personally called Mr. Santos and told him the Board was having a special meeting for him to approve his application and that Mr. Santos said that he would be there. Al said that the owner wants to add a bathroom on. Mr. Santos said he was throwing pads on the ground and was going to level everything up from there and no ground work would be involved. It is a 6x6 addition coming out from where the bathroom currently is. Dick asked if there was something on the front of the camp towards the lake. Al replied that there was a porch on the front that was put on before the ordinance was put in place allowing 30%. Al said he looked to see if any of the allowance was used and found they are allowed 358sq. ft. and will only use 36sq. ft. Peter asked if they can go back and do something later and Al said yes they will still have 322sq. ft. left. Dick asked if the Board wanted to move along with the application even though Mr. Santos wasn t there. Susan Long said she would like to see on the plans the shoreline setback of the structures. She mentioned that his plans didn t even show the lake and
she felt that it was necessary. Al said that she was right and the plans did not show it. She was concerned because a different applicant was asked to put a height requirement on his plans and this one should follow the same rules. Al said that he didn t catch it either and he agrees that it should be on the plans. Susan Long asked if the Board could approve the application with a condition that he puts an appropriate dimension on his plan. The Board agreed that would not be a good idea. The decision was made to table the approval until the dimensions were supplied. Al said he would call him and tell him the Board needed the setback from the lake to the porch. Motion: Geraldine Mountain made a motion to table the approval of the application. Vote: Unanimous ITEM #3: Discussion of New Shoreland Zoning Guidelines Al informed the Board that the DEP has just come out with optional nonconforming structure provisions that the Town can adopt. It would change the 30 footprint and volume. He informed the Board to read it for later discussion. He wasn t expecting to act on it right now. He said it gives smaller buildings within a 100 setback of the lake to be expanded up to 1500sq. ft. or the 30% whichever is larger. Al said it really only applies to camps within 100 of the lake in Dexter. The guidelines also say that the footprint calculations can be used in place of the volume calculations and also covers anything within 75 of a stream. He instructed the Board to read it and they can discuss it at a later meeting. Al said it would only cover camps that hadn t had an expansion already. He stated it is an alternative to what we have and would affect a few people but probably not as many as we would think. Al stated that he had another change to discuss. He said he had been approached by a Councilor to change the earthwork dates around the lake from October 1 st to November 1 st or November 15 th. Rick Fanjoy wanted to know why. Al stated that because of the new requirements that anyone doing work in the Shoreland Zone has to be a certified
contractor in erosion control. They have to use erosion control standards as far as silt control and to keep any silt from going into the lake. Geraldine Mountain stated that there is a lot of rainy falls and it wouldn t be a good idea to move the earth. Al stated that she was right. He said that the Councilor felt that with the new standards and with the contractors having to take classes every three years that we could relax the dates a little bit. Al said it is a consideration for the Board to think about. Al also stated there was a request that the Board change the zone from 350 to 250 which is what the State minimum is. He said he was passing it along to the Board and he could make an argument for either one. The reason we were more restrictive than the State is because it is a Town water supply and we were trying to protect it. Al stated that he does feel with the new erosion control standards that we are not going to have silt runoff into the lake although there is always that one person that is going to push it. Geraldine stated that she didn t see anything wrong with the way things are now. She asked if someone could come before the Board asking for an exception if the weather was good. Al said no we need to have a standard in place for everyone. Peter wanted to know why someone would go all summer long and then wait until it is time to stop digging to start. Al stated that some people buy places late in the season. Peter said they should take that into consideration when they buy it. It would be different if someone had an emergency. Al said that was right, and emergency is an emergency. If a septic system needed to be replaced, that would be allowed. Al stated that around the Little Lake you could relax that to 250 setback from 350 because it is proved all the water does go out through the gate it doesn t go back under the bridge. Al said Wassookeag is unique because it is the town water supply. He told the Board to read the guidelines and they would discuss it when the meetings resumed again and the Board could also discuss the dates for digging. Dick and Peter commented that they heard the October 1 st date came about because of the spawning of togue and they were afraid stuff would get in the water. Al said that does make sense as well. Dick asked if they decided to go with the new guidelines if it would have to go to
Public Hearing. Al said it would go to the Town Council and to Public Hearing. The Board then discussed if another November or a December meeting would be held. Susan Page asked about the application that was just tabled. Al said that we would have to have a meeting on the 20 th of November and Mr. Santos would have to provide the correct information to the Board before Thursday, November 13 th to make the agenda. It was opted to not have a December meeting it there was nothing going on. Dick asked if Mr. Santos wanted to start working on the project now since there was no earthwork. Al said that he did want to. It was decided to have a meeting on the 20 th of November if they heard from Mr. Santos by the 13 th. ITEM #4: Ceo Report Al stated that in addition to his letter he had talked to a couple of people about trash and he said there was also a problem on the Ripley Rd. by Rick Fanjoy s house. Al stated that he had talked to him and was told that he had been digging holes. Al told him to not dig anymore. Rick said that he was burying things. Al also did an inspection at the Motor Lodge because he had a complaint. He found some old cast iron sewer pipes that should be disposed of and there was a little bit of a smell. He did find a minor plumbing violation and told the owner to fix it. Al said that overall he couldn t find anything wrong. He said he did have a sewer pipe that had broken and by the time he got a hold of it he had lost control of the situation. Dick asked Al how he made out at the Owlsboro Road where the gate was. Al said he and Anita went up and the gate was open so they went in and rode around. He said it was a strange setup. They had hauled in a lot of campers with a lot of tote roads going from one camper to another. Dick asked if they were being taxed on anything. Al replied that Anita wasn t going to tax them because they didn t have any value to them. Al said that the guy that actually lives up there has a trailer and a generator and is trying to get a permit to cross the railroad tracks so he can get power. Susan Long asked if Al knew of anything happening on Bugbee Road. She said she had been approached by two different people saying that
there is a sign posted by a woman who owns property there saying that is a future pig farm. Susan wanted to know if that was happening. Al said that he thinks she did that to irritate her neighbors. She calls the cops a lot on her neighbors for different things. The Planning Board was familiar with her. ITEM #5: PUBLIC FORUM There were no comments from the public.
