BURNHAM MARKET PARISH COUNCIL Minutes of the Meeting of held in the Village Hall, Burnham Market on Monday 19 th November 2018 at 7.00p.m. Present: Councillors J Scoles (Chairman), C. Howell, R. Monbiot, R Campbell-Gray, W Owen, B Lynn, N Fryer, J Marshall & J Burt. 3 members of the public 1. Welcome from the Chairman Councillor J. Scoles welcomed everyone to the meeting. 2. Parishioners Participation. A resident asked who was responsible for maintaining the public areas on the Foundry Field development including the verges along the access road into the development and car park. He had not had any luck so far in finding who was responsible. He was informed that this would either be the Borough Council or Fleur Developments. 3. Apologies for Absence. Apologies were received from Councillors J Murphy, C Stimpson, Borough Councillor S. Sandell & County Councillor A. Jamieson. 4. Declarations of Interest. None. 5. Minutes. It was PROPOSED, SECONDED and APPROVED that the minutes of the meeting held on Monday 15th October 2018 were a correct record and were signed by the Chairman with the following amendment. Page 459 Item 10 17/00892 should read 6 dwellings. 6. Matters Arising from the Minutes None. 7. Clerks Report/Correspondence The Clerk gave the following report to the meeting: Actions since last meeting: 7 8 Additional bench Post Office green this had now been installed and the plaque ordered. Bench Church Walk near surgery The Clerk had received a response from the doctor s surgery stating that they were not in a position to install a bench as they are planning to move locations. It was agreed Councillor Howell would speak to the Harold Moorhouse Trust to see if they would consider providing a bench. Zip wire and adult equipment instructions these had now been completed. 13 j Completed. 17 Creake Road pavement the County Council had stated that the pavement was on their list for repairs but not in the foreseeable future. 11 -e Children s play area proposed hardstanding this was ongoing the Clerk was still awaiting details of the area and materials before she could action this further. It was agreed to ask Clive Thorner to supply the Clerk with details. Other items Reported fly tipping of 3 mattresses in Church Walk Planning response to enforcement enquiry sent from PC 22 nd December 2017 regarding the change of use from salon to accommodation This had been investigated and although planning permission had not been applied for it would be viewed favourably and therefore the Borough Council would not be taking any further action in this matter Email from resident of Angles Lane A resident had emailed about the condition of Angles Lane which was used by allotment holders. They felt was unfair that they have to bear the cost of improvement, when it was others who use the Lane regularly. It was agreed the Clerk would contact the resident and ask for further details of recent costs to repair the Lane. Dog Bin Herrings Lane The Clerk had been advised the Parish Council need a licence to put the bin in its new location in Herrings Lane so she would be submitting the paperwork to the County Council in the next week. Dissemination of Parish Council correspondence (including emails), communication and procedures to be discussed in a closed meeting at the end of the PC meeting Bins Thorofare Yard The number of bins in the Yard was increasing and the Clerk had received 2 complaints from residents who have vehicular access rights to their properties but were having to move several bins before they were able to do so. This would be discussed under Agenda item 10(a). 8. Allotments Most of the allotment rents have been collected. A committee meeting would be held Monday 10 th December 2018 at 6.15pm in the kitchen Burnham Market Village Hall. 9. Planning. Matters 18/01415/F Conversion of barns to two dwellings and extension of existing farmhouse at Gallow Hill Farm, Stanhoe Road, Burnham Market Parish Council recommend approval subject to highways issues being resolved. 18/01896/F Variation of Condition 3 of planning permission 17/00984/F Proposed change of use from ground floor retail (A1) and first floor residential (c3) to two storey restaurant (A3) including extension and alterations at No TWENTY 9 The Clerk would ask for clarification. As the response was due before the December meeting the Parish Council would agree their response by email. 10. Action Plan. (a) The Clerk had received correspondence from the solicitor stating that Land Registry had refused the Parish Councils application for adverse possession of the Yard on the grounds that: The acts the user relied on relate only to maintenance of the land The applicant does not control the land The land is unfenced and accessible to the public at large As such the acts of the user are insufficient to amount to a claim of ownership and the requisite degree of exclusive possession has not been demonstrated. They would reject any renewal of our application. It was agreed that there was no further action that could be taken. (b) It was agreed to put in a bid for an additional SAM2 unit which would require a contribution from the Parish Council. The SAM2 unit in Church Walk was being moved to a more suitable location as requested. (c) This was discussed under agenda item 7. 11. Items for Discussion (a) Bin rehoming service - Discussion took place over the continuing problem of the bins in Thorofare Yard all of which did not belong to the properties that back onto the Yard and were mostly from residents of Front Street. Some of the bins had labels on them confirming they contain the wrong items and therefore would not be emptied. These were also now creating a health hazard and of course attract vermin particularly in the winter months being a potential source of food. It was agreed that the Parish Council would write to the residents in Front Street reminding them of the Borough Council rules which state that the bins must be returned to the properties by the end of the collection day. Details of the Parish Council bin rehoming scheme would be included in the letter. It was PROPOSED SECONDED and UNANIMOUSLY approved to charge 100 per annum for the rehoming of 2 bins and an additional 50 per annum for the brown bin which was collected on a different day. The Clerk had already received interest from one of the local letting agencies and several residents. The Clerk would need to seek advice on the employment of a resident to take on this responsibility and to ensure that all the legal requirements were covered. This would be discussed and approved at the December meeting. It was agreed to ask highways if they could do anything to help with the access problems. (b) It was PROPOSED SECONDED and UNANIMOUSLY approved to ask Hayes & Storr to hold all Parish Council legal documentation for a one -off fee of 100. (c) It was PROPOSED SECONDED and UNANIMOUSLY approved purchase a small fireproof and waterproof safe at a cost of 60 for the Parish Office. (d) It was approved for the Parish Clerk to seek quotations for a tree survey for the parish. (e) It was PROPOSED SECONDED and UNANIMOUSLY approved to book full council training with Norfolk Parish Training and Support for January 2019 at a cost of 250. (c) This had been approved under agenda item 11(e). 13. Draft Budget Copies had been circulated to all councillors. They were asked to contact the Clerk if they required any further information and the budget/precept would be approved at the December meeting. 14. Tennis Club The following report had been sent to the Parish Council and was read to the meeting: As you will have seen we re making good progress with the construction of the new pavilion. Following a recent site meeting we have ordered the roof tiles, cladding, windows and doors and expect to start work on making the building weather tight before winter proper sets in. We have experienced problems with the water supply. You may have noticed that Anglian Water Road Closure signs went up in Station Road on Wednesday 14 th only to come down on Thursday 15 th. We were scheduled for connection on the 26 th November but the Borough Council put a stop to the works claiming they hadn t been informed by Highways. The work is now re-scheduled for 12 th February 2019! As we have 465 P a g e S i g n e d : C h a i r m a n

already paid out c. 3000 to Anglian Water back in March, you can take it we re not best pleased and complaints have been lodged with Anglian Water, BCKL&WN, County Highways and a copy to Henry Bellingham. We await their replies with interest. 15. Highway Matters Councillor Howell reported a blocked drain at the bottom of Ringstead Road. 16. Footway Lighting The following lights were reported defective: Front Street (lantern light) 9065 not working Joan Shorts Lane 9008 North Street next to Urban Armour 17. Parishioners Participation A resident urged the Parish Council to use the opportunity of the new Number 29 application to reconsider their comments to support the additional hours. Residents had already suffered from the noise nuisance over the Summer months and were very concerned that their comments were being disregarded by the Parish Council. The comments were noted and the Parish Council would seek clarification on whether this was a new application before making any recommendations. 18. Next Meeting Monday 10 th December 2018 at 7pm..
