REGULAR MEETING JULY 12, 2007 MINUTES of a Regular Meeting held by the Town Board of the Town of Shawangunk, County of Ulster, State of New York at the Town Office Building in Wallkill, New York on the 12 th day of July 2007. Present were Supervisor John Valk Jr., Councilwoman Ingrid Malloy, Councilmen Brian Amthor, Adrian DeWitt and Robert Miller, Town Clerk Margaret Tremper, Supt. of Highways Martin Hand, Planning Board members Alan White and Mark Watkins. APPROVAL OF MINUTES A motion was made by Councilman Amthor and seconded by Councilman Miller that the minutes of the Regular Meeting of June 21, 2007 be approved as submitted. SEAN ROGERS RE: DRAINAGE ON 4 TH STREET Mr. Sean Rogers addressed the Board about a drainage problem on Fourth Street and brought pictures showing the problem of water running down the pavement into his driveway and garage. He also reported that cars parking on the street for school events has worn down the pavement creating a dangerous ditch and the snow plows have broken a footing drain. Supt. of Highways Martin Hand will inspect the area and make a recommendation at the next meeting. ZONING VIOLATION ON LAUREL PARK ROAD The following residents of Laurel Park Road, George Belardo, Theodore Farley, Karen Farley, Ed Gatsen, Helen Greg, Ronald LaTuso and Robert Gorton came to report there is a commercial sanitation service operating out of a home on Laurel Park Road. Laurel Park is a residential area where no commercial businesses should be allowed. Garbage trucks are stored on the property, traffic has increased because the garbage trucks drive in and out at all hours of day and night. Salesman looking for the business annoy the neighbors, there is concern about drainage from washing the trucks causing problems on neighboring properties. There are deed restrictions intended to keep this development strictly residential. Supervisor Valk said the Town has no authority over the deed restrictions and we will ask the Code Enforcement Officers to investigate the complaint. TOM CARNEY RE: BRIDGE STREET Mr. Carney reported there is a dead tree on Town property in front of his house. He is concerned that the tree may fall on his house during a storm. Supt. of Highways Martin Hand will remove the tree.

PUBLIC SAFETY Police Sergeant Michael Smith reported on the meeting between NYS Dept. of Transportation, Representatives of the Wallkill School District, Town Police Officers, Supervisor Valk and Councilman DeWitt regarding traffic control at school entrances. The DOT will study speed limits and the flashing lights at the Middle School. Crosswalks need to be painted, there should be signs in the middle of Route 208 at the Middle School and the present signs should be replaced as soon as possible. Supervisor Valk reported there will be a meeting next week with the School district.. The NYS DOT is being very cooperative. Sergeant Michael Smith reported the department is making substantial progress on the burglary situation in the western end of Town. REPORTS & REMITTANCES OF TOWN OFFICERS The following reports were submitted: Town Clerk Driveway Bonds $600.00 Driveway Permits $ 300.00 Recreation Fees $ 800.00 Town Clerk Report $ 26,774.14 Total $ 28,474.14 HUGH CROWELL RE: ZONING VIOLATION Mr. Hugh Crowell reported there is an illegal lawn mower sales business being conducted on Lippincott Road. There is a sign and lawn mowers for sale on the lawn. Mr. Crowell asked that the law be enforced for a business being conducted in a residential area. The Code Enforcement Officer will be asked to investigate. HIGHWAY A motion was made by Councilman DeWitt and seconded by Councilman Miller that on the recommendation of the Supt. of Highways the driveway bonds for David White and William Anderson be released. A motion was made by Councilman Amthor and seconded by Councilman DeWitt to declare the Stow One Ton double drum roller as surplus and advertise to sell it to the highest bidder. Minimum bid will be $500. and bids will be opened at 2 pm on August 7, 2007.

MINUTES. PAGE THREE. JULY 12, 2007. SIDEWALK The Sidewalk Committee has completed their survey of the needed sidewalk repairs. Councilman DeWitt will help prepare the specifications for bidders. A motion was made by Councilman Amthor and seconded by Councilwoman Malloy to advertise for bids for sidewalk repairs. Bids to be opened at 2 pm on August 7, 2007. A walk through for bidders will be July 31, 2007 at 5 pm. PARKS Councilman DeWitt has prices for mulch for safety under playground equipment at the parks. Councilman Miller reported the Verkeerderkill Park Committee is planning to use the small pavilion for ice skating for small children and also using tarps for lining the skating areas instead of the expensive liner. Supervisor Valk reported he has applied for a grant for Galeville Park. RECREATION A motion was made by Councilwoman Malloy and seconded by Councilman DeWitt to set the salaries for the summer recreation personnel as follows: Adrienne Rascoe $ 11.36 per hour plus $25. per week for EMT Certification Courtney McGowen $ 10.71 per hour Ed Provanzano $ 10.00 per hour Shannon Mastersen $ 10.35 per hour PERSONNEL/PROCEDURES A motion was made by Councilman Amthor and seconded by Councilwoman Malloy to set the salary for the summer highway laborers at $ 12.50 per hour. A motion was made by Councilman Miller and seconded by Councilwoman Malloy to pay Municipal Worker Steve Tuthill $ 12.21 per hour. BUILDINGS Supervisor Valk reported we need to prepare a policy on how we can comply with the requirements for handi-capped accessibility. WATER/SEWER Councilman Miller reported the final determination on our new well is due August 2, 2007.

MINUTES. PAGE FOUR. JULY 12, 2007. PURCHASE OF DEVELOPMENT RIGHTS Supervisor Valk reported there are 2 property owners interested in the transfer of development rights program. A motion was made by Councilman DeWitt and seconded by Councilman Amthor to proceed with finding the costs and assessments for the 2 properties. VOTE: AMTHOR AYE, DEWITT AYE, MILLER ABSTAIN, MALLOY AYE, VALK AYE. AUDIT RESOLUTION The following resolution was offered by Councilwoman Malloy and seconded by Councilman Miller: WHEREAS, Section 2019-a of the Uniform Justice Court Act requires that Town Justices annually provide court records to be audited, and WHEREAS, Town Law requires that all Town departments records be audited annually, and WHEREAS, the Town Board of Shawangunk contracted with the firm of Cooper and Niemann to audit the Town s records for 2006, and WHEREAS, such audit was completed and the report filed with the Town, NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Shawangunk accept the audit report of Cooper and Niemann with their recommendations for accountability and controls. GEORGE LITHCO RE: WALLKILL FIRE DISTRICT Mr. George Lithco representing the Wallkill Fire District spoke to the Board about ways for the Town and fire district to work together to reduce costs to the tax payers. Mr. Lithco suggested the fire district use the Town planner and would like an agreement on what process to use. Supervisor Valk requested a map of the fire districts property and suggested we appoint a committee to discuss the options. SURPLUS PLANTERS A motion was made by Councilman Miller and seconded by Councilwoman Malloy to declare the two concrete planters stored at the highway garage to have no value and no further use to the Town and donate them to the Walker Valley Fire Co. INVESTMENTS Supervisor Valk requested permission to establish a collateral agreement with M&T Bank which will allow us to invest with them provided their rates are higher. A motion was made by Councilman Amthor and seconded by Councilwoman Malloy to authorize the Supervisor to sign an agreement on investments with M & T Bank.

Schoeberl to a 6 year term as Assessor for Town of Shawangunk from 10/1/2007 to 10/1/2013.
