RESOLUTION 2009-29 A RESOLUTION DECLARING LOST, STOLEN, UNCLAIMED OR EVIDENCE PROPERTY AS PUBLIC INTEREST USE HELD BY THE POLICE DEPARTMENT. WHEREAS, property which has been lost, abandoned, stolen, misplaced, lawfully seized or forfeited, and is in the custody of the Police Department shall be deposited and kept in a location Designated by the Chief of Police; and WHEREAS, UCA 77-24-1, et. seq., determines the process for qualifying and disposition of unclaimed property and states that property held by the Police Department for a period of no less than ninety (90) days may be considered unclaimed property and may be sold or disposed of if not claimed; and WHEREAS, certain property now in possession of the Riverdale City Police Department is no longer used for evidence purposes or is property unclaimed for the statutory number of days, or forfeited property, including but not limited to, alcohol, drugs, firearms, obscene materials, or other unclaimed or forfeited property as deemed appropriate, and may be destroyed or disposed of by the Police Department; and WHEREAS, this resolution expresses the Council s intent to declare the property as surplus or for public use now held by the Police Department; and BE IT RESOLVED by the City Council of Riverdale City, Utah: Section 1: That the property listed in Exhibit A, attached hereto and incorporated herein, is found and declared to be unclaimed, lost or otherwise considered as city surplus and all means to discover and notify the rightful owner of any recoverable property have been exhausted; Section 2: That the City administration is authorized to sell or otherwise dispose of any unclaimed property that is currently in the custody of the Police Department in accordance with state and local rules and regulations; Section 3: That any proceeds or credits obtained from the disposition of guns may be used by the Police Department for future purchases of department related guns, parts, equipment, supplies, and ammunition; Section 4: That this Resolution repeals all legislation previously enacted inconsistent with the terms and conditions contained herein. Section 5: That this Resolution shall be in full force and effect from and after the earliest period allowed by law. PASSED this 15 th day of September, 2009.
